About this file

This document is a Project Labor Agreement (PLA) Request for Information (RFI) seeking input from the construction community on the potential use of project labor agreements for a federal construction project. The first page details the legal basis for PLAs, citing Executive Order 14063 which requires agencies to use project labor agreements in large-scale construction projects to promote economy and efficiency. The subsequent pages present a detailed questionnaire for construction firms to provide feedback on various aspects of PLA implementation, including local market conditions, labor availability, scheduling requirements, and potential project impacts. The document requests firms to share information about their past projects, including project details, cost comparisons, completion timelines, craft trades involved, and their willingness to work under a PLA. Respondents are asked to provide perspectives on both the potential benefits and drawbacks of using a PLA for the referenced project, with the goal of gathering comprehensive industry insights to inform the federal procurement decision.

A Project Labor Agreement (PLA) is defined as a pre-hire collective bargaining agreement with one or more labor organizations that establishes the terms and conditions of employment for a specific construction project and is an agreement described in 29 U.S.C. 158(f). Federal Acquisition Regulation (FAR) 22.503 Policy provides that:

(a) Executive Order 14063, Use of PLA’s for Federal Construction Projects, requires agencies to use project labor agreements in large-scale construction projects to promote economy and efficiency in the administration and completion of Federal construction projects.

(b) When awarding a contract in connection with a large-scale construction project (see 22.502), agencies shall require use of project labor agreements for contractors and subcontractors engaged in construction on the project, unless an exception at 22.504(d) applies.

Refer also to FAR 52.222-33 Notice of Requirement for Project Labor Agreement and FAR 52.222-34 Project Labor Agreement.

The construction community is invited to comment on the use of PLAs pertaining to this project.
