Statement of Objectives (SOO) for Professional Support Services for USTP
I. Purpose / Background:
Congress established the United States Trustee Program (USTP) in 1978 as a pilot effort in 18 federal judicial districts. In 1986, Congress made the USTP permanent.
The Program now covers all federal judicial districts except those in Alabama and North Carolina, where bankruptcy court officials called Bankruptcy Administrators perform a similar function. The USTP has standing to participate in every individual and business bankruptcy case in the 88 federal judicial districts under its jurisdiction, and on average it participates in more than 1 million active cases annually. This represents about half of all active cases annually in the federal judicial system.
The USTP consists of 21 regions with 89 field offices nationwide and an Executive Office in Washington, D.C. The USTP’s expansive field structure enables it to participate in about 250 bankruptcy courts, detect and address multijurisdictional violations through coordinated enforcement efforts, and ensure meaningful access to the bankruptcy system by both debtors and creditors.
As part of the oversight function of Chapter 11 cases, the USTP is authorized by law to assess fees on Chapter 11 debtors. The amount of fees is calculated on a quarterly basis and debtors are mailed an account statement at the start of the first month of a quarter. For those accounts having a balance due at the beginning of each of the second and/or third months of a quarter, a delinquency statement is also mailed to the debtor. For those debtors who fail to pay the full amount due after their bankruptcy case closes, a collection letter may be generated and mailed to those debtors as well.
II. Scope or Mission:
Contractor support is needed to assist in the printing and mailing of these statements and collection letters (defined above). The contractor must have the ability to pre-print and manage the inventory of specially designed statements and letters. The printing /mailing contractor also pre-prints and manages the inventory of an information brochure that is included in selected statements, as well as the mailing and return envelopes. Additionally, it is common for the USTP to request the contractor to print one-time informational letters and insert these into every debtor’s statement package. The contractor will receive an encrypted file containing data records to be printed on pre-printed "statement" stock once per month. Each file will contain between 1 and up to 15,000 or more accounts to be processed.
In order to manage and coordinate USTP’s programs, the Department of Justice (DOJ), Executive Office for United States Trustees (EOUST) Program has a need to acquire Professional Services Support in support of the business needs of the following functions within the Office of Administration (OA): Budget (Budget Formulation, and/or Budget Execution), Security (Personnel, and/or Physical), Facility, Finance, Record Management, and Administration.
The Contractor shall provide all services necessary to support the USTP EOUST Staff as specified herein. All work and services shall be performed in accordance with the terms and conditions of the SOW and the solicitation and resulting contract.
Hours may vary and are to be determined based on the need of the Government.
