List of Changes to SOL-R8-12-00001 via Amendment #001
1. The Section B clause, “Fixed Rates for Services – Indefinite Delivery/Indefinite Quantity Contract” has been modified to replace the paragraph at the bottom of page 6 with the following:
The Contractor shall voucher for only the time of the personnel whose services are applied directly to the work called for in individual task orders and accepted by the EPA Project Officer. The Government shall pay the Contractor throughout the life of the task order at the rates appropriate to the current period of performance. If a task order crosses into another performance period, the applicable fixed rates will change accordingly. The Contractor shall maintain time and labor distribution records for all employees who work under the contract. These records must document time worked and work performed by each individual on all task orders.
2. The Section B clause, “Fixed Rates for Services – Indefinite Delivery/Indefinite Quantity Contract” has been modified as follows:
5. In the event that on-going work on-site is interrupted at any time due to inclement weather, unsafe conditions, or other conditions beyond either the control of the contractor or the control of the Government, as determined by the on-scene coordinator, EPA will not pay the contractor for any labor or equipment costs during such interruptions; that is, EPA will not reimburse the contractor in excess of those hours actually worked on the site. The Contractor shall not be reimbursed for standby.
3. The Section B Clause, “Travel,” has been modified to remove the following language under (a):
The amounts specified in the schedule for travel are estimates only. The actual amount for travel may be greater or less than the amounts specified as long as the maximum contract ceiling amount is not exceeded.
4. The Section B Clause, “Other Direct Costs,” has been modified to remove the following language under (a):
The amounts specified in the schedule for specialized labor are estimates only and actual costs may be greater or less than the amount specified as long as the maximum contract ceiling amount is not exceeded.
5. The Section F clause, “Reports of Work” has been modified to remove the following requirements from the Monthly Progress Reports:
1.(d)(3) Labor hours.
(i) A list of employees, their labor categories, and the numbers of hours worked for the reporting period.
(ii) For the current reporting period, display the expended direct labor hours and costs broken out by EPA contract labor hour category for the prime contractor and each subcontractor and consultant.
(iii) For the cumulative contract period and the cumulative contract life display:
the negotiated, expended and remaining direct labor hours and costs broken out by EPA contract labor hour category for the prime contractor, and each subcontractor and consultant.
(iv) Display the estimated direct labor hours and costs to be expended during the next reporting period.
1.(d)(6) Average cost of direct labor. Compare the actual average cost per hour to date with the average cost per hour of the approved work plans for the current contract period.
1.(e)(5) Average cost of direct labor. Display the actual average cost per hour with the cost per hour estimated in the workplan.
Note: The removal of these three requirements has affected the numbering of other components of this clause.
6. The Section G clause, “Ordering – By Designated Ordering Officers” has been modified to remove “and the Contract-level Contracting Officer’s Representative (COR)” from the last sentence of the first paragraph. This language was misleading, as it is not a requirement for the Contract-level COR be an OSC, so the COR may not necessarily be authorized as an ordering officer.
7. The Section L provision, “Proposal Preparation Instructions,” has been modified to add the following requirement to the “Technical Ability” section of the Technical Proposal Instructions:
For the Response Activities task area, the offeror shall also provide a Readiness Plan, to be included in Appendix E, which meets the requirements described in Attachment 2, “RESPONSE QUALIFICATIONS.”
The following additional Appendix has been added to the Technical Proposal Instructions to accommodate this requirement:
APPENDIX E – READINESS PLAN
In this appendix the offeror shall include its Readiness Plan as required in Technical Proposal Instructions – Section 1 above. Specific requirements for the Readiness Plan are described in Attachment 2 under “RESPONSE QUALIFICATIONS.”
(Note: The Readiness Plan is to be included in an Appendix and as such is excluded from the overall page limitation for the Technical Proposal.)
Accordingly, the Section M provision, “Evaluation Factors for Award,” has been modified to add the following subfactor to Factor 1, Technical Ability:
• Quality of the offeror’s Readiness Plan
8. The Section L provision, “Proposal Preparation Instructions” has been modified to remove the following incomplete sentence under Section 3 of the Technical Proposal Instructions, p.
82:
“This page limit is inclusive of”
9. The Section L provision, “Past Performance Information,” has been modified as follows:
(e)(2) Client Authorization Letters should be mailed or E-mailed to individual references in sufficient time for clients to respond by the proposal due date. The offeror should forward a copy of the Client Authorization Letter to the contracting officer simultaneously with mailing to references.
10. The Section M provision, “Evaluation Factors for Award,” has been modified to remove the following bullet from Factor 4, Management Ability:
• Demonstration of the offeror’s ability to select an effective staffing mix appropriate to individual tasks
11. Attachment 1, Statement of Work, has been modified to replace the acronym “NRCB” with “CBRNE” under “Counter Terrorism Response” on page 1-7.
12. Attachment 2, Response and Key Personnel Qualifications, has been modified to replace the last requirement for the Geologist with the following:
