SECTION C – STATEMENT OF WORK

C.1 PURPOSE

The purpose is to procure 300 net metric tons of High Energy Biscuits (HEB) which are designed to be high in protein and supplemented with a premix of vitamins and minerals intended for general food distribution and school feeding.

C.2 STATEMENT OF WORK

Contractor shall produce High Energy Biscuits as specified in the Specification Section 3.0 below.

Contractor shall provide a timeline for the procurement of these items and be able to provide USAID/FFP with updates every two weeks on the status of the procurements. Contractor must provide point of contact information (name, email, 24-hour phone number) for a representative that will be available for communication regarding this procurement.

The contractor is not responsible for transporting the items to final destination. USAID/FFP is responsible for transporting the items from the manufacture warehouse location to the final destination. The contractor shall be responsible for preparing all the items for shipment with proper packaging. This includes the use of undamaged warehouse pallets, shrink wrapping items, and banding items when necessary. Items must be secured to pallets in order to prevent any damage to the cargo contents or packaging during shipment. Pallets shall be stackable (minimum double stock) without damage during shipment.

The Contractor must provide USAID/FFP with shipping details in the form of a Microsoft Excel spreadsheet. The shipping details must include the following:

• Number of total pallets

END OF SECTION D

SECTION E – INSPECTION AND ACCEPTANCE

E.1 INSPECTION

Inspection and acceptance of tendered items by USAID will be performed in accordance with clause FAR 52.246- 2, Inspection of Supplies- Fixed Price. Unless otherwise designated by the contracting officer, the contracting officer’s representative as designated in Section G is the authorized Government representative to accept supplies and/or services rendered by the contractor under this contract.

Inspection and either acceptance, rejection or conditional acceptance will be performed at the discretion of the COR. The contractor must obtain COR acceptance of all contract deliverables before contract payment will be made by USAID.

Inspection will take place at manufacture warehouse.

E.2 START-UP AND QUALITY ASSURANCE FOR HIGH ENERGY BISCUITS (HEB)

E.2.1 Start-up Phase. Start-up phase is a preparatory or first production run in which the supplier develops baseline data on composition, microbiology, operator training, grading table (sensory analysis) and all calibrations necessary before running at full capacity. This would avoid massive production during the fine-tuning of blending lines. Prior to the actual trial, the supplier shall propose a start-up proposal and discuss with the contracting officer. During start-up run, the supplier must run all the analytical required in Section 1.1E of HEB published Commodity Requirement Document (section C.3 of this solicitation) and ensure that the facility is capable of producing the product. If the supplier is new and has not successfully performed a start-up phase, or is an existing supplier that has not produced the product for over one year, contractor-paid USDA Agricultural Marketing Service (AMS) or Independent Laboratory in-plant inspection is required during the start-up phase. This inspection will include sampling and examination of start-up production for compliance with contract requirements. During this phase, the contracting agency or its representative may choose to be present. If the contracting agency does not attend during the start-up phase, data generated during this phase shall be provided to the contracting officer. These data include certificates from an independent laboratory facility for the testing required in Section 1.1E of HEB CRD. The supplier should factor this expense into their production cost. Product resulting from start-up may or may not be for delivery under the contract, depending on the level of defects and quality assurance compliance. Decision on acceptability of start-up product will be made by the contracting officer, using inputs from USAID, USDA and the vendor. Full production may continue if start-up initial assessment indicates that adequate process/packaging and food safety capability exists to comply with product specifications.

E.2.2 Production Phase. During production of HEB, continuous on-site presence of AMS or Independent inspectors is not required. However, contracting agency will continue monitoring food safety and quality through micronutrient and microbiology indicators. For microbiology purpose, only Salmonella and Enterobacteriaceae (EB) as hygiene indicator microbes will be reported in CoAs as part of invoices, as well as Vitamin A and Iron for micronutrient compliance. The rest of compositional compulsory tests in Table 4 of CRD are also required. Food safety and quality control systems to comply with FDA Food Safety Modernization Act (FDA FSMA) are expected, as established in Table 1 below.

1.

Table 1. General guidelines for food safety and quality control to comply with FDA Food Safety Modernization Act No. Activity Annotations

1 Qualification audit/ preliminary Survey

1. A preliminary USG audit, before granting contract to potential suppliers

2. Audit must be HACCP-based (i.e., the audit will include assessment of the firm’s food safety program with an expectation that HACCP-based principles are in in place)

3. Written manifestation from the suppliers indicating commitment to comply with highest levels quality, proving all their written quality programs

4. Third party audits to be requested from potential suppliers, if sharable

2 Start-up process 1. Process capability validation

2. Generation of baseline data (production, environmental, finished product compliance)

3. Validation of sampling plans (including for continuous monitoring by USG for new suppliers) 3 Ongoing monitoring through indicative parameters

1. Suppliers need to provide COAs

2. USG will continue to test indicative parameters. For HEB microbiology, Salmonella and EB are required as part of CoAs accompanying invoices, and for micronutrient compliance Vitamin A and Iron are required in a per-lot-basis

4 Spot, unannounced audits

1. According to supplier production capability, hopefully measured as a function of cPk (process variability), at least annual audits will take place

2. If it is a new contract, presence of AMS or Independent inspectors shall be compulsory at least during the start-up cycle.

E.2 WARRANTY

All contract warranties must be in accordance with contract clause FAR 52.212-4(o), Warranty.

END OF SECTION E
