Performance Work Statement

A. DESCRIPTION OF SERVICES. The Contractor shall furnish all labor, supervision, tools, materials, equipment, and services necessary to ensure that grounds maintenance is performed at the Construction Engineering Research Laboratory (CERL), at the ERDC-CERL complex, Interstate Research Park, Champaign, Illinois in a manner that will maintain healthy grass, trees, shrubs, and plants; maintain clear and safe roads and pathways in the winter and present a clean, neat, and professional appearance. All services shall be performed in accordance with the following requirements and Technical Exhibits (TE) 1-3.

The Contractor shall, without additional expense to the Government, be responsible for obtaining any and all necessary licenses and permits and comply with any applicable Federal, State or local laws, codes or ordinances in connection with the performance of this contract. This contract includes a Base Period of 12 months with four 12 month option periods.

B. SITE SUPERVISOR. The Contractor shall designate a site supervisor in charge of the work being performed during the execution of the contract. The site supervisor shall be responsible for the work schedule, safety, and quality control. The site supervisor shall keep the Government's Technical Point of Contact (TPOC) or the contracting officer's representative (COR) informed of the work progress and be available to the TPOC in the event of a change in the schedule or if any problems arise. Identification of and contact information for the site supervisor shall be provided to the Government at or before the post-award conference. During the performance of the contract, Government notification of a change in the site supervisor shall be provided to the Contracting Officer's Representative (COR) not later than five (5) business days prior to the change.

C. SPECIAL PROVISIONS, SNOW AND ICE REMOVAL

1. Time and Place of Performance:

a. Services shall be performed at the ERDC-CERL complex, Interstate Research Park, Champaign, Illinois. See TE 01-03, for general maps of the facility area. The maps are a general representation of the facility and do not detail every grounds maintenance area to be maintained, it is the contractor's responsibility to verify actual service area that includes the entire lawn maintenance area, all trees, shrubs and flower bed areas, all sidewalks, and all roads. This contract requires Grounds Maintenance for the entirety of the CERL Facility in accordance with this performance work statement. Technical Exhibits will be updated only if there are substantial changes such as new construction or demolition of structures.

b. CERL's standard hours of operation are Monday through Friday 0600 - 1800 CST. Unless contacted and instructed otherwise, snow and ice removal shall occur only during the non-operation hours, between 1800 and 0600, and all work must be completed before 0600. Snow and Ice removal in accordance with this contract shall take place 365 days a year. (366 on leap year)

If snow removal and/or ice melt treatment cannot be completed prior to 0600, the Site Supervisor shall inform the COR prior to 0500 and provide an expected time of completion.

2. Supplies, Materials, and Equipment:

a. The Contractor shall provide all supplies, materials, and equipment necessary for the performance of the work under this contract.

b. The Contractor shall provide and maintain all equipment to be used during the performance of this purchase order in good operating condition to accomplish the work in a timely and efficient manner.

D. SNOW/ICE TREATMENT and REMOVAL (this shall be paid through line item XXX4) Monitoring shall be based on the Current Observation site https://stateclimatologist.isws.illinois.edu/data /champaign-urbana/

1. Specifications: Pretreatment shall be applied to all roads and sidewalks before every snow or ice event. Sidewalks shall be cleared after every snow or ice event and Melting Materials applied.

Road and parking lot Snow removal shall take place when snowfall accumulation is two (2) inches or more on parking lots, driveways, sidewalks, or walkways. Ice removal shall occur at 0.50 inch accumulation. The Contractor shall be responsible for monitoring local weather conditions and determining when services meet the minimum requirements. This shall be officially tracked at the following current observation site. https://stateclimatologist.isws.illinois.edu/data/champaign-urbana/

Performance of snow and ice removal shall maintain clear and safe Sidewalks, roads, gates, and pathways in the winter. The Contractor is responsible for snow and ice removal and treatment with salt and ice melt for every sidewalk, road, and parking lot on the CERL facility. Technical Exhibit 02 is only a representation of the facility and all areas shall be serviced, it is the Contractor's responsibility to verify the service area. The Contractor shall provide all labor, material, equipment, transportation, and supervision required to perform the following tasks: snow/ice removal and spreading melting materials. The Contractor shall be responsible for monitoring local weather conditions and determining when services are required in accordance with this performance work statement. Contractor shall ensure the sidewalks, driveways, parking lots, roadways, gates, ramps, building entrance areas, bus shelter, etc. are maintained. When snow, ice, freezing rain, or sleet events occur, the Contractor shall ensure clear, non-slippery walking and driving surfaces. The five

(5) sliding gates and two (2) pedestrian gates of the perimeter fence, shall be kept clear of snow and ice sufficient to allow normal operation. All gates are marked with a black X on Technical Exhibit 01. The X at the bottom left corner of Technical Exhibit 01, between Building 1 and the Bus Shelter, represents one sliding gate and one pedestrian gate which are side by side. All removal of snow and ice, and applications of melting materials shall be accomplished in an efficient and timely manner.

Winter snow removal period is for five (5) months, from November through March, but the Government may require snow removal if necessary April-October.

2. Performance:

a. Task 1: Snow Removal, Parking Lot and Sidewalks

(1) Prior to the first snowfall, the Contractor shall be responsible to locate and mark the location of all fire hydrants, curbs, sidewalks, roadways, driveways, parked cars, parking bumpers, basketball poles, concrete stoops and ramps, card readers, fire hydrants, telephone boxes, mailboxes, gate operators, and any other equipment, as needed, to avoid damage to property.

(2) All Sidewalks shall be cleared after every snow or ice event. Roads and parking lots on the facility shall be cleared of snow in accordance with the PWS. The Technical exhibits are general representation of the facility and do not detail every Grounds maintenance area, it is the contractor's responsibility to verify all areas.

(3) Snow shall not be piled on sidewalks, streets, roadways, parking lots, shrubs, or at intersections which may impede foot or automobile traffic flow or visibility. Snow shall not be pushed or stored against any fence, gate, gate operator or building. Snow shall not be pushed off the property. Snow shall be piled in areas shown on Technical Exhibit 03. Snow shall be removed to a point vertical with the edge of roadways and sidewalks to within six (6) inches of driveways and curbs, and within twelve (12) inches of privately and Government owned vehicles and equipment parked on or near to sidewalks, roadways, and driveways.

b. Task 2: Ice Melt

(1) The Contractor shall apply salt and melting materials to all sidewalks, parking lots, driveways, roadways, exterior of building entrance areas, and ramps in order to provide clear, non-slippery walking and driving surfaces before all snow or ice events. Melting materials used at gates, doorways, and sidewalks shall be of the type that will not harm vegetation, concrete, or metal.

Asphalt parking areas may use other types of melting material. The Technical exhibits are general representation of the facility and do not detail every Grounds maintenance area, it is the contractor's responsibility to verify all areas.

(i) Materials applied to the sidewalks and around the gates, buildings, and other structures shall be calcium chloride or a government approved equivalent to prevent harm to vegetation, concrete, or metal.

(ii) Materials applied to the asphalt parking lots and driveways (away from all vegetation and structures) shall depend on the anticipated temperature.

E. LAWN MAINTENANCE:

1. Time and Place of Performance:

The spring, summer, and fall grounds maintenance season is seven (7) months long, from April through October. Fall and Spring Cleanup occur November through March and shall occur as outlined in this PWS and technical exhibits. Grounds maintenance shall achieve healthy grass, trees, shrubs, and plants, and present a clean, neat, and professional appearance of the installation. Services shall be performed at the ERDC-CERL complex, Interstate Research Park, Champaign, Illinois, as specified in this performance Work Statement.

The grass cutting work shall be performed during evening hours between 06:00 p.m. through 0600 a.m. or on weekends when the parking lots at ERDC-CERL are at lowest occupancy, e.g., Saturdays, Sundays, and holidays. Outlying areas, at least thirty (30) yards from any vehicle or occupied building, may be mowed during normal business hours.

F. LAWN MAINTENANCE AT ERDC-CERL

1. Specifications: The Contractor shall perform the following tasks at the ERDC-CERL complex:

grass cutting, trimming, weeding, flower bed maintenance, and leaf pickup of the lawn areas, sidewalks, and other paved areas. Any damage caused by the contractor shall be repaired by the contractor. If cuttings left by the Contractor cause damage to the lawn, the Contactor shall make repairs at their own expense. Special care shall be taken while mowing and trimming the research area at the Northeast corner of property. Test mounds at this location shall not be damaged, scalped or gouged. The Contractor shall be responsible for the following performance standards.

2. Performance:

a. Task 1: Lawn Maintenance, Trimming, Weeding, and Disposal (This shall be paid through line item XXX1)

(1) Mowing: The Contractor shall ensure that the lawn areas shall be cut not less than two (2) inches above the surface of the soil and the maximum height for the grass shall be five (5) inches at any time. Grass shall be cut a minimum of the first and third week of every month; if the grass is ever over 5 inches a reduction in monthly payment will occur. The areas to be cut are identified on Technical Exhibit 01, Grass Maintenance Areas. The contractor shall ensure that the grass clippings are removed during or after each cutting if the amount of cut grass is dense enough to damage or destroy underlying turf. Leaves shall be mulched prior to the spring season and at the end of the fall season. Windrowing of clippings is not acceptable. Each successive cutting shall be accomplished in a different direction and at approximately right angles to the directions of the previous cutting, where practical. Waste materials, grass clippings and debris shall be removed from Government property and disposed of at an off-site location in accordance with existing local, state, and federal regulations.

(2) Trimming: Each time the grass of an area is mowed; all grass shall be trimmed even with the edges of all curbs, sidewalks, driveways, lots, buildings, fences, trees, signs, and other structures.

Grass growing under fences shall be trimmed each time the lawn is cut. Alternatively, the contractor may use herbicide immediately under fences, and around equipment, structures, and mulched areas. Use of herbicide, in these areas, may not extend more than 6" from the edge of the item. Damage to trees and shrubs from trimming shall be repaired by the Contractor. If a plant should die or become unhealthy due to damage, the Contractor will be responsible for replacing the damaged plant with a plant of same size and type. If not available, the closest size shall be used. Plant replacement shall occur within 15 days of noticed damage.

(3) Blow Parking lots/Sidewalks of Leaves/Debris: Blow all paved areas clear of yard waste to include leaves, pine needles, twigs and trash. Debris shall be removed from Government property and disposed of at an off-site location in accordance with existing local, state, and federal regulations. Blowing of parking lots and sidewalks for leaves and debris shall be performed during every lawn cutting.

(4) Trash, Yard Waste, and Limb Cleanup: Prior to and after mowing, all waste materials, yard waste and debris (trash, tree limbs up to 6" in diameter, leaves, dry brush, rodent habitats, dead animals, etc.), shall be removed from the area. Research project debris is not part of this requirement. Sidewalks and paved areas shall be blown/swept clean. All trash and debris shall be removed and disposed of campus. If a tree or limb falls which is too large to pick up, the contractor shall notify the COR who will arrange to have it cut up into manageable pieces by a member of the DPW staff. Any debris in excess of what the contractor can haul, DPW will dispose of.

(5) Spraying Fenceline: Grass growing under fences shall be trimmed each time the lawn is cut.

Alternatively, the contractor may use herbicide immediately under fences, and around equipment, structures, and mulched areas. Use of herbicide, in these areas, may not extend more than 6" from the edge of the item.

(6) Weeding Pavement, Gravel Areas Weed Control-Pre Emergent: Weeds in areas adjacent to all curbs, sidewalks, driveways, paved lots, buildings, fences, trees, mulched areas, Plant Beds, signs, and other structures shall be free of weeds and grass. This may be accomplished by Herbicide applications and the use of Granular planter bed weed control.

(7) Turf Maintenance/Broadleaf Weed Control: The Contractor shall perform an effective turf application of a non-selective herbicide to areas damaged by insects or overgrown by invasive plants, weeds and poison ivy with prior approval of the COR. The approved herbicide shall be applied in accordance with the manufacturer's instructions. Contractor may use only approved herbicides to destroy weeds and shall provide data sheets (MSDS) to COR for all chemicals used to treat required areas.

b. Task 2: Fall and Spring Cleanup (This shall be paid through line item XXX2)

Cleanups shall occur a total of two times per year. Cleanup includes Leaf removal, Trash cleanup, Yard Waste removal, Limb Cleanup, blowing Lawns, Blowing Parking lots/Sidewalks, removing all Leaves/Debris from lawns, parking lots and flower beds. Contractor will blow leaves from corners of buildings and out of fence lines and remove from site. All leaves shall be removed from Government property and disposed of in an appropriate and legal manner by the Contractor. The contractor may mulch leaves as long as this method is effective in eliminating them from the grounds. Cleanup dates shall be determined by the CERL Contracting Officer Representative (COR). The COR will provide the Contractor a 14-calendar day notice to provide Fall and Spring Cleanups.

c. Task 3: Trees/Shrubs/Flower Bed Maintenance (This shall be conducted in April, and August of every year and paid through line item XXX3)

(1) Tree Trimming-Low Trim: Contractor shall prune trees to maintain a neat and professional appearance as well as a safe environment. These services shall be provided in May and October of every year. Minimum safety clearance is 12 feet over driveways, 8 feet over walk areas, 5 feet above fence lines, and 4 feet from buildings. Dead branches should be removed 12 ft. from driveways, 8 ft. from sidewalks, and 5 ft. over the fences. Any other dead limbs that can be safely removed from the ground, and also any limb that looks unsafe above these limits should be reported to the COR right away. Evergreen pruning should only be done twice a year. Other trees shall be pruned on an as-required basis to provide safety, clearances and/or to prevent structural damage. This includes the inspection of all trees for dead or rotten limbs that require removal to maintain a safe environment.

(2) Hedges/Bushes/Shrubs Pruning: Hedges next to buildings shall be trimmed to keep growth below window level. Broadleaf evergreens and flowers beds shall be pruned to maintain clearances of a minimum of 3 inches from buildings, sidewalks, or other obstructions. All branches and trimmings should be removed from Government property and disposed of in an appropriate and legal manner by the Contractor.

(3) Fungicide for Colorado Blue Spruce for Needle Cast Disease & Perennial Plants/Shrubs and Trees Insecticide: The Contractor shall perform an effective application of a pesticide to prevent trees being damaged by insects (e.g. bagworms) with prior approval of the COR. The approved pesticide shall be applied in accordance with the manufacturer's instructions. All at-risk trees should be treated for prevention, along with any other susceptible bushes and shrubs.

(4) Flower Beds: Remove and Dispose of all Dead Plant Vegetation, Replacement up to 25 Perennials per year, Plant Bed Weed Control (Granular), Prune vegetation, level all ground in river rock beds and provide vegetation control. Eliminate weeds; repair or replace damaged plants in flower beds and shrub and planter areas; replace up to 25 of the current perennial plants. No annual flowers are included in this requirement. All weeds shall be removed or eradicated manually or mechanically, but not chemically with spray. Granular planter bed weed control is acceptable. Areas where perennial plants are planted should be watered on a weekly basis when there is not adequate rainfall to maintain plant health.

(5) Organic Wood Mulch Maintenance: In April all areas that currently have wood mulch shall have a new layer of mulch applied. This includes flower beds, sloped areas, tree bases, hedges, shrubs, planters, etc. The new layer of fine ground dark brown mulch shall be applied at a minimum of two

(2) inches. The contractor shall clean out and dispose of old mulch when mulch thickness reaches eight (8) inches thick prior to applying new mulch.

G. SUPERVISION: The Contractor shall designate in writing to the Contracting Officer or his representative the names of on-site contractor supervisors.

H. IDENTIFICATIONS AND CONDUCT OF EMPLOYEES: All contractor personnel performing under this purchase order shall carry personal identification issued IAW FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel and follow ERDC-CERL security procedures and shall produce such identification when requested by the Contracting Officer or his/her authorized representative. The Contractor shall designate in writing to the Contracting Officer or his/her representative the names of all employees working under this contract.

I. CONTRACTING OFFICER'S TECHNICAL REPRESENTATIVE (COTR): COTRs will be designated per DFARS 252.201-7000 at time of award. No Government personnel, other than the Contracting Officer, will have the authority to change or alter these requirements. The ERDC-CERL COTR shall clarify technical points or supply relevant information, but no requirement in these specifications may be altered as a sole result of such verbal clarification.

J. DELIVERABLES:

The Contractor shall submit the following to the ERDC-CERL COTR:

1. A list of employees and supervisors shall be due within one (1) week of award.

2. A copy of the insurance policy shall be due within one (1) week after award.

3. Contractor shall prepare and submit an abbreviated Accident Prevention Plan (APP) to the COR for approval by the ERDC-CERL Safety Office within one (1) week of award. The APP shall focus on the Contractor's Safety Programs and shall be site specific to the work being performed. This plan will be a statement of the company's policy concerning accident prevention and any other guidance statements normally furnished new employees. Notification to the COR no later than

4am, if 6am snow clearing and/or melting material application cannot be met due to continuing snowfall or other extenuating circumstances. This notification shall include best estimate of when clearing/treatment shall be completed.

4. A copy of the data sheets (MSDS) each time a different chemical is used to treat required areas shall be due within 48 hours prior to use.

K. SAFETY REQUIREMENTS: Contractor and Contractor personnel shall conform to applicable provisions of U.S. Army Corps of Engineers Safety and Health Requirements Manual, EM 385-1-1, available at http://www.usace.army.mil/publications/eng-manuals/em385-1-1/toc.htm. All applicable state and federal safety regulations relating to protection of eyes, other extremities, and hearing protection shall be followed. Machinery and equipment shall be operated in accordance with the manufacturer's instructions and recommendations.

1. Footwear: Protective footwear shall be worn by all contractor personnel who operate equipment in the performance of the work specified herein in accordance with EM 385-1- 1, Para. 05.E.

2. Eye Protection: The Contractor shall ensure all employees wear hearing and eye protection when operating machines or performing operations present potential eye or face injury from physical agents in accordance with EM 385-1-1.

3. Hearing Protection and Noise Control: The Contractor shall comply with American Conference of Governmental Industrial Hygienists Threshold Limit Values and EM 385- 1-1, Para. 05.C at a minimum. When personnel are subjected to sound level exceeding limits specified in EM 385-1-1, Para. 05.C.2, personal protective equipment shall be provided by the Contractor and used by contractor personnel to reduce the sound levels in accordance with EM 385-1-1, Para. 05.C.4.

4. Accident Prevention Plan. Contractor shall prepare and submit an abbreviated Accident Prevention Plan (APP) to the COR for approval by the ERDC-CERL Safety Office within one (1) week of award. The APP shall focus on the Contractor's Safety Programs and shall be site specific to the work being performed. This plan will be a statement of the company's policy concerning accident prevention and any other guidance statements normally furnished new employees. The minimum basic outline for an APP is set forth in EM 385-1-1, Appendix A and attached in Section J attachments.

5. Material Safety Data Sheets. The Contractor shall provide one (1) copy Material Safety Data Sheets (MSDSs) for any products or materials brought on the facility for use in the performance of this contract (e.g. ice melt, weed killer, etc.) no later than forty- eight (48) hours prior to use. No product or material may be used without the prior approval from the COTR.

L. SCHEDULE OF INSURANCE: The Contractor shall, at his own expense, procure and maintain during the entire performance of this purchase order, insurance of at least the kinds and minimum amounts set forth below.

1. General Liability Insurance per Occurrence: $500,000.00.

2. Comprehensive Automobile Liability Insurance: The minimum limits of

$200,000.00 per person, and $500,000.00 per occurrence for bodily injury, and

$20,000.00 per occurrence for property damage.

3. Workman's Compensation and Employer's Liability Insurance: $100,000.00

M. ANTITERRORISM/OPERATIONS SECURITY LANGUAGE:

1. Access and General Protection/Security Policy and Procedures. All contractor and all associated sub-contractor employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes.

2. For Contractors Who Do Not Require CAC, but Require Access to a DoD Facility or Installation.

Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC- III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05 / AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative, as NCIC and TSDB are available), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
