PERFORMANCE WORK STATEMENT

CHEMICAL ANALYSES OF ENVIRONMENTAL SAMPLES IN SUPPORT OF DREDGE

MATERIAL SUITABILITY DETERMINATIONS

1.0 Blanket Purchase Agreement (BPA) Terms and Conditions (IAW FAR 12.201-1(e)(3)):

1.1 Description of Agreement: The purpose of this BPA is to provide an indefinite quantity of physical and chemical analyses of soil, sediment, and water samples. The intent of this BPA is to provide the Government with a cost-effective, rapid response way to conduct analyses within the required timeframe. The awarded Contractor shall furnish all labor, materials and equipment necessary to perform physical and chemical analysis of soil, sediment, and water samples that will provided by the New England District (NAE) of the U.S. Army Corps of Engineers (USACE) throughout the Blanket Purchase Agreement Period of Performance. The results of analysis will be used to support dredge material suitability determinations and to identify potential environmental impacts associated with a wide range of navigation and planning projects. Under this BPA, your organization shall provide analyses in accordance with the attached Price Schedule and Performance Work Statement, when called by the Contracting Officer or their designated representative(s). Services will be requested through purchases made under this BPA that shall be referred to as Calls.

1.2 Period of Performance: The duration of the BPA shall be three (3) years from date of award, or upon reaching the BPA master limit, whichever occurs first. Calls can be placed up to the date of the BPA expiration. The period of performance of any call placed prior to the BPA expiration can extend past the date of the BPA expiration.

1.3 Extent of Obligation: In accordance with FAR 12.201-1(e)(3), the Government is obligated only to the extent of authorized purchases (calls) made under the BPA. The establishment of the BPA does not imply any agreement on the part of the Government to place future calls with the BPA holder. The Government makes no representation as to the number of calls or actual amount of work to be ordered.

1.4 Purchase Limitation: The Contractor shall furnish all labor, materials, and equipment necessary to execute physical and chemical analyses for each BPA call under this agreement.

No single BPA call may exceed $25,000 in total cost of labor and materials. The BPA master dollar limit is $350,000.

1.5 Individuals Authorized to Purchase under the BPA: Only the Contracting Officer is authorized to purchase under this BPA.

1.6 Call Procedures: The Government may have multiple BPAs in place with various Contractors for the same Services. The Government intends to compete each Call among a pool of up to three (3) BPA holders to determine if a Contractor can provide the services in the required time frame and the price. Award will be based on the lowest price that will provide the services in the required time frame.

2.0 Requirements

2.1 General: The vendors' quote shall include a price schedule for all analyses and services as indicated in the Price (Bid) Schedule. This list shall include optional surcharges for expedited turn-around times. Other requirements specific to laboratory qualifications and capabilities which shall be demonstrated in the quote are as follows:

1. The Laboratory facility where work is performed shall be located within the footprint of the New England District states (6 New England states) in order to facilitate transport and minimize the risk of exceeding sample holding times.

2. The Laboratory shall deliver pre-preserved bottleware and receive soil, sediment, and water samples from the NAE Environmental Laboratory located on Fort Devens, MA. The courier shall be responsible for maintaining these samples in accordance with the requirements outlined in Table 4-3 of the Regional Implementation Manual ("Regional Implementation Manual for the Evaluation of Dredged Material Proposed for Disposal in New England Waters" (EPA/USACE, 2025)) during transport.

3. The Laboratory shall have a Laboratory Quality Assurance Plan (LQAP) which meets the requirements of the Regional Implementation Manual and has been accepted by the NAE Dredged Material Management Team. This acceptance must indicate that the lab is able to perform bulk chemical analysis of sediment (metals, PAHs, PCBs, and pesticides) as well as both fresh and saltwater aqueous chemistry. A list of laboratories with accepted LQAPs which details the types of analyses they approved to provide is available from the NAE Regulatory Division website: https://www.nae.usace.army.mil/Missions/Regulatory/Dredged-Material- Program/.

4. The Laboratory must be able to meet the requirements specified in the Regional Implementation Manual for analytical reporting limits, sample handling protocols, quality assurance and quality control measures, and Electronic Data Deliverables (EDDs) (Details at https://www.nae.usace.army.mil/Missions/Regulatory/ Dredged-Material-Program/Regional- Implementation-Manual/).

5. The requirements in the Regional Implementation Manual shall be applied in conjunction with the national guidance found in the Ocean Testing Manual ("Evaluation of Dredged Material

Proposed for Ocean Disposal - Testing Manual" (EPA/USACE, 1991)); the Inland Testing Manual ("Evaluation of Dredged Material Proposed for Discharge in Waters of the U.S. - Testing Manual" (EPA/USACE, 1998)), and the Quality Assurance/Quality Control Manual ("Guidance for Sampling and Analysis of Sediments, Water and Tissue for Dredged Material Evaluations: Chemical Evaluations" (EPA/USACE, 1995).

6. Courier Services: The Contractor shall ensure that any courier services used will preserve chain of custody and deliver samples in accordance with the holding times for sample analysis.

The pricing for courier services shall include a blanket rate per call for the Contractor to transport, via courier, all samples for laboratory analysis. The price for courier services shall not be included in the test price, rather shall be listed separately on the Bid Schedule.

Contractor shall collect samples at the New England District Environmental Laboratory located at Fort Devens, MA. Courier services shall only be included once per BPA call. If the Contractor does not charge for these services, then either $0 or Not Separately Priced (NSP) shall be indicated on the Bid Schedule.

2.2 Data Management: The vendor's quote shall demonstrate that the Laboratory is able to meet the data reporting requirements outlined on the EDD page of the NAE Disposal Area Monitoring Program website: https://www.nae.usace.army.mil/Missions/Disposal-Area- Monitoring-System-DAMOS/Electronic-Data-Deliverables.aspx. Deliverables to be provided by the laboratory for each BPA call shall include an NAE format EDD, electronic data tables summarizing the results of analysis, and an electronic copy of the full laboratory data report.

Supplemental information such as chromatograms, instrument calibrations, or bench sheets shall be available to NAE upon request.

Deliverables shall be transmitted to NAE by e-mail, external hard drive, or ftp site. All deliverables shall include a transmittal letter to certify that the data provided is complete and accurate. All EDDs submitted by the Laboratory shall be error-free, and in complete agreement with the project data report. The Laboratory shall be responsible for correction of reporting errors identified by NAE or any retesting that may occur if the results QA/QC analysis are unacceptable.

2.3 Chain of Custody: The Laboratory will follow the Chain of Custody for each project with respect to requests for analyses, data deliverables, and any project specific instructions unless amended by NAE technical point of contact assigned to the project.

2.4 Invoices: Invoices shall be submitted upon completion of work and transmittal of deliverables under each BPA call. Invoices shall be sent to the attention of the NAE technical point of contact assigned to the project. The mailing address and default point of contact are listed in section 4 of this document. Invoice shall contain the following information:

BPA number

BPA call number

Project name

Sampling date(s)

Deliverable date(s)

Itemized list of analyses and associated costs

Summary of any issues or corrections

Copy of Chain of Custody

2.5 Pricing: Individual analysis rates under this agreement shall be determined prior to the BPA award based on the Laboratory's response to the attached Price (Bid) Schedule.

3.0 Evaluation Criteria

A BPA award will be made to the Contractor(s) who demonstrates the ability to meet the requirements of Section 2.0 and provides the lowest total pricing for the analyses specified in the Price (Bid) Schedule. Pricing shall be included for all analysis methods and for all three years of the Price (Bid) Schedule. Failure to price an analysis method or year of the BPA will result in the Contractor's quote being deemed non-responsive. The analytical methods listed in the Price (Bid) Schedule are recommended but can be replaced by other methods that will meet the required reporting limits. Along with their proposed costs, the laboratory shall submit their proposed analytical methods, Limits of Detection (LODs) and Limits of Quantitation (LOQs) for the required analytes as well as measurement performance criteria for precision and accuracy.

4.0 Coordination

Once a call is made against the BPA, liaison will be maintained for the duration of the call through periodic communications with the USACE technical point of contact assigned to the project. The default point of contact is listed below.
