PERFORMANCE WORK STATEMENT (PWS)
RIVERS PROJECT OFFICE VEGETATIVE MAINTENANCE
SECTION 1 – GENERAL INFORMATION
1.1.0 Scope. The work covered by this contract and its perspective task orders shall consist of performing vegetative management on U.S. Government Lands. The Contractor shall furnish all labor, equipment, materials and supplies necessary to perform mowing and turf maintenance, vegetation maintenance and control, debris removal, litter and trash removal, and snow and ice removal services for all associated territory of the U.S.
Army Corps of Engineers, Rivers Project. All Contract Area Directions are provided in Appendix A.
1.2.0 Contract Area. The contract area consists of the alluvial floodplains and watersheds in the Missouri Counties of Ralls, Pike, Lincoln, St. Charles, St. Louis, Franklin, Jefferson, Ste. Genevieve, Perry, Cape Girardeau, Scott, and Mississippi, and Illinois Counties of Pike, Calhoun, Cass, Scott, Greene, Jersey, Madison, St. Clair, Monroe, Randolph, Jackson, Union, and Alexander. Contract areas will be specified within each task order.
1.2.1 Special Information. Contract areas may be located in heavily visited public access areas that are within the floodplains and watersheds of the Mississippi and Illinois Rivers and are subject to frequent flooding.
1.2.2 Access. The Contractor shall be responsible for access to, into and through all locations. Contractor shall be responsible for securing all barricades or gates through which they access Government Property. In the event that the Contractor needs to access Government property via an adjacent landowner, the Contractor shall be responsible for securing and obtaining the consent of landowner, representative, or agent all necessary right-of-entry permits prior to any entry into/onto private property in conjunction with the performance of this contract at no cost to the Government.
1.3.0 Sustainability Compliance. The Contractor shall be responsible for meeting all Green Procurement
Compilation requirements during the performance of this contract.
a. EPA Designated (CPG). Under the Comprehensive Procurement Guidelines (CPG) program, the Environmental Protection Agency (EPA) designates products that are or can be made with recovered materials and recommends practices for buying these products. Any designated product that is being offered or supplied under this contract shall meet the minimum recommended content levels as identified under the CPG program. Visit http://www.epa.gov/epawaste/conserve/tools/cpg/products for a complete list of designated products and the associated recommended content levels. Offerors must be able to demonstrate that each offered product meets minimum content levels upon request.
b. Bio-based. The United States Department of Agriculture (USDA) designates certain biobased products for federal procurement and specifies minimum biobased content levels for those products. Any designated product that is being offered or supplied under this contract shall meet USDA BioPreferred’s minimum biobased content level. Visit the BioPreferred web site for the complete list of designated products and the associated minimum biobased content level requirements.
c. WaterSense. The contractor shall provide WaterSense labeled products under this contract, as applicable. The contractor is encouraged to visit http://www.epa.gov/watersense for complete product specifications and updated lists of qualifying products.
1.4.0 Security. The Contractor and Contractor Personnel performing work under this contract are responsible for applicable security requirements at time of the proposal submission and must maintain the level of security required for the life of the contract. The following requirements shall be implemented and adhered to throughout the life of the contract:
a. AT Level I Training. All contractor employees, to include subcontractor employees, requiring access to Army installations, facilities, controlled access areas, or require network access, shall complete AT Level I awareness training within 30 calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable. Upon request, the contractor shall submit certificates of completion for each affected contractor employee and subcontractor employee, to the COR or to the contracting officer (if a COR is not assigned), within 5 calendar days after completion of training by all employees and subcontractor personnel. AT Level I awareness training is available at the following website:
http://jko.jten.mil/courses/atl1/launch.html; or it can be provided by the RA ATO in presentation form which will be documented via memorandum.
b. Access and General Protection/Security Policy and Procedures. All contractor and all associated sub-contractors’ employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes.
Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05 / AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative, as NCIC and TSDB are available), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.
c. Suspicious Activity Reporting Training. The contractor and all associated sub-contractors shall receive a brief/training (provided by the RA) on the local suspicious activity reporting program.
This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the project manager, security representative or law enforcement entity. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT 5 calendar days after the completion of the training.
d. Pre-Screen Candidates using E-Verify Program. The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award.
1.5.0 Safety. The Contractor shall perform all work in accordance with safety requirements set forth in Corps of
Engineers' Manual, EM 385-1-1, entitled "Safety and Health Requirements Manual", updated 30 NOV 2014 copies of which are available at the Rivers Project Office or online at http://www.usace.army.mil/SafetyandOccupationalHealth/EM38511,2008BeingRevised.aspx. The Contractor shall complete an Accident Prevention Plan, as required in Appendix A of EM 385-1-1, and submit document for approval before commencement of work.
1.5.1 Safety Exposure Report. The Contractor shall submit, in writing, a monthly safety exposure report. The report shall be submitted by the fifth (5th) working day of the following month, (i.e., January’s report is due by the fifth working day of February). This report shall include (1) the total employee hours worked by employees during the preceding month, and (2) detailed descriptions of any accidents or injuries sustained on the project by their employees during the preceding month, including copies of documents for claims under Workman’s Compensation. Safety Exposure Report Example: Month of October Mowing five (5) People at six (6) hours per day for ten (10) days equals (=) three hundred (300) man-hours; Trimming two (2) People four (4) hours per day for two (2) days equals (=) sixteen (16) man-hours; Total man-hours for the month of October equals three hundred sixteen (316).
1.6.0 Vehicles. The Contractor shall keep all vehicles clearly marked with identification showing, Contractor’s name and type of business. Signage shall be of professional quality and shall be subject to the approval of the Contracting Officer.
1.7.0 Post Award Orientation. Within fifteen (15) days after Contract award, the Contractor shall attend a Post
Award Orientation which shall be held at the Rivers Project Office, 301 Riverlands Way, West Alton, MO 63386.
1.8.0 Working Hours. The Contractor shall schedule all work to be performed daily Sunday through Saturday, except for Federal Holidays or as approved in writing in advance by the Contracting Officer.
1.9.0 Recognized Holidays.

1.10.0 Unusual Conditions. The Contractor shall immediately inform the Contracting Officer Representative by phone and follow up in writing, when requested, of any unusual conditions observed on Government Lands or Waters such as dumping, vandalism, or damages.
1.10.1 Flooding. Areas of performance are located within the alluvial floodplains of the Mississippi River and are susceptible to occasional floodwaters inundating areas and/or access roads. Therefore, it may be deemed necessary to decrease or increase service frequencies in any or all portions of areas of performance, and/or close areas and delete any subsequent service for the closed area of performance. Payment for the decreased service due to flooding will still be paid to the Contractor.
1.11.0 Contractor Representative. The Contractor shall provide, in writing, to the Contracting Officer
Representative, the name or names of a Contractor Representative who will be on site with the authority and power to conduct overall management, coordination, and supervision whenever work specified herein is being performed. The Contractor Representative will serve as the central point of contact with the Government for performance of all work under this contract. The Contractor Representative shall deal directly with the Government for normal day-to-day administration of this contract. Contractor Representative must be present at post award orientation.
1.12.1 Conduct. The majority of work will be performed in the presence of the general public; thus, the conduct of contract personnel during the performance of this contract is critical. The Contractor shall ensure that all personnel conduct all duties in a professional manner. All personnel shall not use or be under the influence of drugs or alcohol at any time while performing the obligations under this contract. Firearms are prohibited on Government Property. Contractor and personnel must comply with CFR 36 Rules and Regulations. Any personnel activity, which, in the opinion of the Government, is deemed detrimental to the performance of the contract may result in the removal of Contractor employee/employees and/or termination of the contract.
1.13.0 Damages to Government and Private Property. The Contractor shall be responsible for restoring any
Government facilities, structures, and landscape features (trees, grasses, shrubs etc.) damaged as a result of the Contractor’s actions. The Contractor shall also be responsible for any damage to private property or injury to any person as a result of the Contractor’s operations. The Contractor shall notify the Contracting Officer Representative immediately of any damage to Government and Private property as well as any injury to any person(s) resulting from the Contractor’s operations.
1.14.0 Contractor Quality Control Plan. The Contractor shall be responsible for establishing and maintaining an adequate quality control system to satisfactorily inspect and ensure that all work performed is in full compliance with contract specifications, drawings, and maps. The program shall include, but not limited to an inspection system and records system as indicated herein. The Contractor’s Quality Control Plan shall be submitted to and approved by the Contracting Officer Representative prior to beginning any work.
1.14.1 Inspection System. The Contractor shall provide an inspection system indicating a method for identifying deficiencies in the quality of work performed during the performance period of this contract. The inspection system shall specify a phase or area of work to be inspected on a scheduled or unscheduled basis, the work requirement to be inspected, the method of inspection, and the individual(s) who will do the inspection.
Contractor shall take all necessary measures to correct deficiencies identified in each inspection during period of performance at no cost to the Government.
1.14.2 Records System. The Contractor shall have a records system in place of all inspections conducted and all corrective actions taken. All documentation shall be made available to the Government at any time during the contract period of performance.
1.15.0 Removal of Materials and Rubbish. Before final payment is made, the Contractor shall remove from the site of work all equipment, unused supplies/materials, waste materials, and rubbish resulting from the operations performed. The Contractor shall properly dispose of materials, wastes, effluents, trash, garbage, oil, grease, chemicals, etc., within work areas in such manner that harmful debris will not enter project lands, lakes, ditches, rivers, canals, waterways, or reservoirs.
1.16.0 Applicable Publications. The Contractor shall perform all work in accordance with applicable publications.
They include but are not limited to:
-Manufacturer’s Recommendations: For equipment and supplies/materials used by the Contractor.
-Operating Manuals.
-Industrial Standards and Codes (latest editions).
-American National Standards Institute (ANSI).
-American Society for Testing and Materials (ASTM).

SECTION 2 – DEFINITIONS
2.1.0 Contractor. The term Contractor refers to the prime Contractor and all contractor employees and personnel.
The prime Contractor shall be responsible for ensuring all subcontractors comply with the provisions of this contract.
2.2.0 Contractor Representative. A superintendent assigned to represent the interests of the contractor with regards to all matters involving the contract.
2.3.0 Contracting Officer (CO). The term "Contracting Officer" shall mean the person executing this contract on behalf of the Government, and any other officer or civilian employee who is properly designated Contracting Officer; and the term shall include, except as otherwise provided in this contract, the authorized representative of a Contracting Officer acting within the limits of their authority.
2.4.0 Contracting Officer’s Representative (COR). An Individual designated in writing by the Contracting Officer to be responsible for administration of the contract and Quality Assurance Representative.
2.5.0 Quality Control (QC). The term “Quality Control” refers to action taken by the Contractor and/or their personnel to document, inspect, and control performance of services to ensure they meet the specifications and requirements of this contract.
2.6.0 Quality Assurance (QA). The term “Quality Assurance” refers to action taken by the Government to ensure the Contractor’s quality control system is functioning and effective, and the Contractor is providing services, which are in accordance with this contract.
2.7.0 Q.A.S.P. The term “Quality Assurance Surveillance Plan” refers to the Government’s plan and inspection system to ensure the work is performed in accordance with the contract.
2.8.0 C.D.R. The term “Control Deficiency Report” refers to written record of unsatisfactory performance by the
Contractor as observed by the Quality Assurance Inspector.
2.9.0 Accident Reporting. An accident constitutes any and all incidents or acts involving the Contractor, which may or may not have caused obvious damage to persons or property. All accidents shall be reported to the Contracting Officer within 24 hours of the occurrence. All serious accidents (those resulting in death or injury requiring medical attention) shall be reported immediately.
2.10.0 Flood and Storm Debris. Large amounts of flotsam (logs, trees, and manmade materials), silt, etc. damaged or floated in due to results of high water, flooding, and storms.
2.11.0 Litter and Debris. Trash, debris, animal remains shall include, but are not limited to, all garbage, paper, metal, plastic and glass materials, cigarette butts, bottle caps, unused snow removal materials including, cinders and salt, mud, gravel, vegetation growth (includes growing within cracks, and expansion joints) extinguished fire ring trash materials, grass clippings, tree limbs, sticks, rocks, and dead fish and animals and/or remains.
Areas generally include but are not limited to parking lots, sidewalks, roadways, and their shoulders, all mowed areas, and shorelines to the water's edge to include rip rap areas around and/or along roadways.
2.12.0 Inclement Winter Weather Event. When the National Weather Service issues a Winter Weather Advisory, Winter Weather Watch, or Winter Weather Warning, the duration of the Advisory, Watch, or Warning, from issuance to cancellation, shall be considered an Inclement Winter Weather Event. When the National weather Service issues a Winter Weather Outlook or Forecast, this shall also be considered an Inclement Winter Weather Event.
2.13.0 Improved Grounds Mowing. Grounds that are maintained on a basis to keep vegetation looking well-manicured, neat, and professional in appearance. Grounds are historically maintained between 1 and 4 times a month and mowed to heights generally between 2 – 5 inches.
2.14.0 Unimproved Grounds Mowing. Grounds that are not maintained on a regular basis. Grounds are generally maintained less than 1 time a month and are mowed at heights generally between 6 – 12 inches.
SECTION 3 – ENVIRONMENTAL PROTECTION
3.1.0 Scope. This section covers prevention of environmental pollution and damage as result of services performed under this contract. For the purpose of this specification, environmental pollution and damage are defined as the presence of chemical, physical, or biological elements or agents which adversely affect human health or welfare, unfavorably alter ecological balances of importance to human life; affect other species of importance to man; or degrade the utility of the environment or aesthetically, cultural and/or historical purposes. The control of environmental pollution and damage requires consideration of air, water, and land and includes management of visual esthetics, noise, solid waste, radiant energy, and radioactive materials, as well as their pollutants.
3.2.0 Contractor Quality Control Program. The Contractor shall establish and maintain a complete quality control program for all work required herein to assure the requirements of the contract are provided. The program shall include the inspections system and records system requirements as listed below.
(1) Inspection System. The Contractor shall provide for an inspection system and a method of identifying deficiencies in the quality of work covering the work required herein before the level of performance becomes unacceptable. The inspection system shall specify the phase or area of work to be inspected on a scheduled or unscheduled basis, the work requirement to be inspected, the method of inspection, and the individual(s) who will do the inspection. The system shall include inspection of (1) Schedules, (2) Methods of performing work, (3) Materials, (4) Equipment, (5) Personnel, and (6) Results of completed tasks.
(2) Records System. The Contractor shall provide for a records system and file of all inspections conducted by the Contractor and the corrective actions taken. This documentation and copies shall be made available to the Government during the contract period.
3.2.1 General. The contractor shall establish and maintain quality control for environmental protection operations to assure compliance with contract requirements and maintain detailed records of quality control for all services including, but not limited to, the following:
(1) Law, Regulations and Ordinances. (Compliance with all Federal, State, and local laws, regulations, and ordinances concerning pollution control.)
(2) Protection of Land Resources. (See Section 2-7.1)
(3) Protection of Water Resources. (See Section 2-7.2)
(4) Protection of Air Resources. (See Section 2-7.3)
(5) Protection of Fish and Wildlife. (See Section 2-7.4)
(6) Protection of Historical, Archaeological, and Cultural Resources. (See Section 2-7.5)
3.2.2 Reporting. One copy of these records and tests, as well as records of corrective action taken, shall be furnished to the Government daily when work covered by this section is being performed.
3.3.0 Permits and Licenses. The Contractor shall obtain and comply with all required permits and licenses. Copies of all applications, permits and licenses obtained from Federal, State, and local governing bodies pursuant to this contract shall be submitted to the Contracting Officer.
3.4.0 Environmental Protection Plan (EPP). Within 15 days after receipt of Award, the Contractor shall submit in writing an EPP and meet with representatives of the Contracting Officer to develop mutual understanding relative to compliance with this provision and administration of the EPP. The Contractor shall also furnish, within 15 days of receiving each task order, specific updates to the EPP. Acceptance of the Contractor's plan will not relieve the Contractor of responsibility for adequate and continuing control of pollutants and other environmental protection measures. The Government reserves the right to require the Contractor to make changes in EPP and operation as necessary to maintain satisfactory environmental protection performance.
The EPP shall include, but not be limited to, the following:
(1) Methods for protection of features to be preserved within authorized work areas. The Contractor shall prepare a listing of methods to protect resources needing protection, i.e., trees, shrubs, vines, grasses and ground cover, landscape features, air and water quality, fish and wildlife, soil, historical, archaeological, and cultural resources.
(2) Procedures to be implemented to provide the required environmental protection and to comply with the applicable laws and regulation. The Contractor shall set out the procedures to be followed to correct pollution of the environment due to accident; natural causes or failure to follow the procedures set out in accordance with the environmental protection plan.
(3) Permit or license and the location of solid waste disposal areas.
(4) Drawings showing location of any proposed temporary excavations or embankments for haul roads, stream crossings, materials storage areas, temporary structures, sanitary facilities, and stockpiles of materials.
(5) Environmental monitoring plans for the worksite, including land, water, air, and noise monitoring.
(6) Traffic control plan.
(7) Methods of protecting surface and ground water during contract activities.
(8) Work area plan showing the proposed activity in each portion of the area and identifying the areas of limited use or non-use. Plan shall include measures for marking the limits of use areas.
3.5.0 Subcontractors. Assurance of compliance with this section by subcontractors will be the responsibility of the
Contractor.
3.6.0 Noncompliance. The Contracting Officer will notify the Contractor in writing of any observed noncompliance with the Contractor's EPP. The Contractor shall after receipt of such notice, inform the Contracting Officer of proposed corrective action and take such action as may be approved. If the Contractor fails to comply promptly, the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken. No time extensions will be granted, nor costs or damages allowed to the Contractor for any such suspension.
3.7.0 Protection of Environmental Resources. The environmental resources within the project boundaries and those affected outside the limits of permanent work under this contract shall be protected during the entire period of performance of each task order. The Contractor shall confine activities to areas defined by the drawings and specifications in each task order.
3.7.1 Protection of Land Resources. Prior to the beginning of any services, the Contracting Officer will identify all land resources to be preserved within the Contractor's work area. The Contractor shall not remove, cut, deface, injure, or destroy land resources including trees, shrubs, vines, grasses, topsoil, and landforms without special permission from the Contracting Officer. No ropes, cables, or guys shall be fastened to or attached to any trees for anchorage unless specifically authorized. Where such special emergency use is permitted, the Contractor shall provide effective protection for land and vegetation resources at all times as defined in the following subparagraphs.
3.7.2 Work Area Limits. Prior to any services, the Contractor shall mark the areas that are not required to accomplish all work to be performed under task orders. Where operations are to be conducted during darkness, the marker shall be visible during darkness. The Contractor shall convey to personnel the purpose of marking and/or protection of all necessary objects.
3.7.3 Reduction of Exposure of Unprotected Erodible Soils. Earthwork brought to final grade shall be finished as indicated and specified. Side slopes and back slopes shall be protected as soon as practicable upon completion of rough grading. All dirt work shall be planned and conducted to minimize the duration of exposure of unprotected soils.
3.7.4 Temporary Protection of Disturbed Areas. Such methods as necessary shall be utilized to effectively prevent erosion and control sedimentation, including but not limited to the following:
(1) Retardation and Control of Runoff. Runoff from the work site shall be controlled by construction of diversion ditches, benches and beams to retard and divert runoff to protected drainage courses. The Contractor shall also utilize any measures required by area-wide plans approved under paragraph 208 of the Clean Water Act.
3.7.5 Location of Field Offices, Storage and Other Contractor Facilities. The Contractor's field offices, staging areas, stockpile, storage, and temporary buildings shall be placed in areas approved by the Contracting Officer. The Contracting Officer shall make temporary movement or relocation of Contractor facilities only on approval.
3.7.6 Temporary Excavations and Embankments. Temporary excavations and embankments for plant and/or work areas shall be controlled to protect adjacent areas from despoilment.
3.7.7 Borrow Areas. Borrow areas on Government property shall be managed to minimize erosion and to prevent sediment from entering nearby watercourses or lakes.
3.7.8 Disposal Areas. Disposal areas on Government property shall be managed and controlled to limit material to areas designated on drawings and prevent erosion of soil or sediment form entering nearby watercourses or lakes.
3.7.9 Disposal of Cleared and Grubbed Material and Other Debris. All material and debris resulting from clearing and grubbing operations on this contract shall be disposed of by burning accomplished with a fire box system, supplemented by burying or removal from the site. The Contractor shall make a reasonable effort to utilize the removal method to channel materials of value resulting from clearing operations into beneficial use.
3.7.10 Burning. Material and debris resulting from clearing and grubbing operations on this contract may be burned within the contract areas and any time within the task order work period, provided such burning does not cause air pollution restrictions applicable to this project as outlined in paragraph 2-7.3 to be exceeded.
Burning operations shall be conducted to prevent damage to standing timber or other flammable growth. The Contractor shall be required to obtain all necessary burning permits. The Contractor will be responsible for any damage to life and/or property resulting from fires that are started by employees or as a result of operations. The Contractor shall furnish, at the site of burning operations, adequate firefighting equipment to properly equip personnel for fighting fires. Fires shall be guarded at all times and shall be under constant surveillance until they have been extinguished.
3.7.11 Burying. Material and debris resulting from clearing and grubbing operations on this contract that are, in the
Contracting Officer's opinion, impracticable to burn, shall be buried within designated disposal area(s) set by the Contracting Officer. No material or debris shall be buried within 100 feet of the top of stream courses or beneath any designated fill area. All material or debris shall be buried with a minimum cover of three feet.
The finished surface over buried items shall be left smooth and free to drain and without abrupt changes.
3.7.12 Removal. The Contractor shall remove all of the debris from the site of the work. Such disposal shall comply with all applicable Federal, State, and local laws. The Contractor shall, at option; either retain for own use or dispose of by sale or otherwise, any such material of value. The Government will not be responsible for the protection and safekeeping of any material retained by the Contractor. Such materials shall be removed from the site of the work before the date of completion of the work. If disposal material is placed on adjacent property, the Contractor shall obtain without cost to the Government, additional right-of-way for such purposes. Such material shall be so placed as not to interfere with roads, drainage, or other improvements and in such a manner as to eliminate the possibility of it entering channels, ditches, or streams.
The Contractor shall submit written evidence to the Contracting Officer that he has obtained permission from the property owner for disposal of material on the owner's property. The written evidence shall consist of an authenticated copy of the conveyance under which the Contractor acquired the property rights and access thereto, prepared and executed in accordance with the laws of the States of Illinois or Missouri as appropriate. If the Contractor obtains temporary rights, and then the period of time shall coincide with the time specified in paragraph SC-1, plus a reasonable time for any extension granted for completion of the work.
3.7.13 Disposal of Solid Wastes. Solid Wastes shall be placed in containers, which are emptied on a regular schedule. All handling and disposal shall be conducted to prevent contamination. The Contractor shall transport all solid wastes off Government property and dispose of them in compliance with Federal, State, and local requirements for solid waste disposal.
3.7.14 Disposal of Discarded Materials. Discarded materials other than those, which can be included in the solid waste category, shall be handled as directed by the Contracting Officer.
3.7.15 Restoration of Landscape Damage. The Contractor shall restore all landscape features damaged or destroyed during task order operation outside the limits of the approved work areas. Such restoration shall be in accordance with the plans submitted for approval to the Contracting Officer.
3.7.16 Post Task Order Clean Up. The Contractor shall clean up and remove any waste at all areas used for task order performance and return areas to original condition.
3.8.0 Protection of Water Resources. The Contractor shall keep task order activities under surveillance, management, and control to avoid pollution of surface and ground waters.
3.8.1 Monitoring. Monitoring of water areas affected by service activities shall be the responsibility of the
Contractor.
3.9.0 Protection of Air Resources. The Contractor shall keep service activities under surveillance, management, and control to minimize pollution of air resources. All activities, equipment processes, and work operated or performed by the Contractor in accomplishing the specified services shall be in strict accordance with the State of Missouri and/or the State of Illinois and all federal emission and performance laws and standards.
Ambient Air Quality Standards set by the Environmental Protection Agency shall be maintained for those service operations and activities specified in this section.
3.9.1 Particulates. Dust particles, aerosols, and gaseous by-products from all service activities, processing and preparation of materials shall be controlled at all times including weekends, holidays, and hours when work is not in progress.
3.9.2 Particulates Control. The Contractor must have sufficient equipment available to accomplish this task.
Particulate control shall be performed as the work proceeds and whenever a particulate nuisance or hazard occurs.
3.9.3 Hydrocarbons and Carbon Monoxide. Hydrocarbons and carbon monoxide emissions from equipment shall be controlled to Federal and State allowable limits at all times.
3.9.4 Odors. Odors shall be controlled at all times for all service activities, processing, and preparation of materials.
3.9.5 Monitoring. Monitoring of air quality of all areas affected by service activities shall be the responsibility of the Contractor.
3.10.0 Protection of Fish and Wildlife. The Contractor shall keep service activities under surveillance, management, and control to minimize interference with, disturbance to, and damage of fish and wildlife. The Contractor prior to beginning of service operations shall list species that require specific attention along with measures for their protection.
3.11.0 Protection of Historical, Archaeological, and Cultural Resources. The preservation and recovery of existing historical, archaeological, and cultural resources within the Contractor's work area will be so designated by the Contracting Officer and precautions shall be taken to preserve all such resources as they existed at the time they were identified to the Contractor. The Contractor shall install all protection for these resources and shall be responsible for their preservation during task order work periods. Any item that may have historical or archaeological value discovered during service performance shall be left undisturbed, and the Contracting Officer shall be immediately notified of such discovery.
3.12.0 Protection of Sound Intrusion. The Contractor shall keep service activities under surveillance and control to minimize damage to the environment by noise.
3.13.0 Maintenance of Pollution Control Facilities. The Contractor shall maintain all constructed facilities and portable pollution control devices for the duration of task orders, or for that length of time service activities create that particular pollutant.
3.14.0 Training of Contractor Personnel in Pollution Control. The Contractor shall train personnel in all phases of environmental protection. The training shall include methods of detecting and avoiding pollution, familiarization with pollution standards, both statutory and contractual, and installation and care of facilities
(vegetative covers and instruments required for monitoring purposes) to ensure adequate and continuous environmental pollution control.
3.15.0 Payment. No separate payment or direct payment will be made for the cost of the work covered under this section and all costs in connection therewith shall be included in other items for which payment is provided.
SECTION 4 – MOWING
4.1.0 Description of Services. The Contractor shall provide non-personal services, to include all labor, personnel, equipment, tools, materials, supervision, mobilization/demobilization, incidentals and any other items and services necessary to ensure that vegetative maintenance is performed at Rivers Project associated Recreational Areas identified herein in a manner that will promote the growth of healthy grasses, trees, shrubs/plants, and present a clean, neat, and professional appearance during growing season months. Mowing requirements for recreational areas shall be that no uncut strips of vegetation remain and there is a neat and professional cut appearance, shall include removal of all grass clippings and debris generated by this contract from all roadways, signs, sidewalks, parking lots and other objects or facilities within each specified area.
Mowing shall not be performed when ground conditions are such that mowing operations will cause damage to areas of performance, such as wheel rutting, etc. UNDER NO CIRCUMSTANCES SHALL ANY
BUILDING, INFRASTRUCTURE, PLANTS, TREES, OR OTHER GOVERNMENT OWNED
PERMANENT OR NON-PERMANENT PROPERTY/OBSTACLES BE DAMAGED BY MOWING
OPERATIONS. In the event that damage does occur as a result of mowing operations, the Contractor will be held responsible for fixing and/or replacing damaged item(s) at no cost to the Government. The Contractor’s performance will be based on the Contracting Officer’s (CO) and/or Contracting Officer’s Representative (COR) evaluation of services completed each time performance is scheduled. The evaluation results will be based on COR performance assessment, customer satisfaction, and customer complaints. Final results of the evaluations will be the determining factor for the success or failure of this contract. The contractor shall comply with applicable federal, regional, state, and local laws and commercial standards. Recreational area Maps are provided in Appendix B, Facilities area Maps are provided in Appendix C. Levee area Maps are provided in Appendix D.
4.2.0 Specific Requirements.
4.2.1 Mowing. The Contractor shall mow recreational area(s) to look well-manicured with a neat and professional appearance at all times. The Contractor shall mow grass to a height that is uniform in appearance, free of skips, gaps, rutting or scalping each time mowing is performed. Included with mowing performance, the Contractor shall edge and trim (where applicable) within the limits specified for each recreational area.
The Contractor shall be required to pick up litter and debris, natural and manmade, prior to mowing any area.
The Contractor shall remove or mulch all grass clippings when visible after mowing, before leaving work areas. Types of mowing are listed below in paragraph 4.2.4.
4.2.2 Edging. The Contractor shall perform edging (where applicable) during each mowing performance of each recreational area. The Contractor shall edge sidewalks, driveways, road edges, curbs and all other hard surfaced areas located within the recreational area so that grass height matches surrounding area grasses.
Edging shall include removal of vegetation from expansion joints and cracks in all hard surfaced areas within the recreational grounds. Grass, vegetation, and weeds shall be cut back no more than ½ inch from the surface edged, maintaining an even contour with the edged surface, uniform in appearance and free of scalping, rutting, and uneven or rough cutting. Prior to leaving each work area, the Contractor shall remove all clippings from all edged surfaces when visible after edging.
4.2.3 Trimming. The Contractor shall perform trimming (where applicable) during each mowing performance of each recreational area. The Contractor shall trim grass and weeds along and around all features, to include trees, shrubs/plants, buildings, fences and fence posts, gates and gate posts, fire hydrants, parking lot bumpers, boulders, grills, fire rings, trashcans, and all other fixed obstacles and/or temporary obstacles/objects within each recreational area. Trimming height shall match surrounding area grass height. Prior to leaving each work area, the Contractor shall remove or mulch grass clippings when visible after trimming.
4.2.4 Mowing Types. Satisfactory mowing requirements will be designated by three types of mowing as they relate to length of grass. Several measurements shall be taken within a designated mowing area and an average calculated to determine acceptance of the contract area.
Type One: Areas designated as type one mowing shall have grass maintained between three (3) and four (4) inches in height.
Type Two: Areas designated as type two mowing shall have the grass maintained between three (3) and five (5) inches in height.
Type Three: Areas designated as type three mowing shall have grass maintained between eight (8) and twelve (12) inches in height.
*East/West Levee cannot be mowed until July 1st due to documented threatened species nesting in the area.
SECTION 5 – LITTER PICK UP AND TRASH CANS.
5.1.0 Description of Services. The Contractor shall provide non-personal services, to include all labor, personnel, equipment, tools, materials, supervision, mobilization/demobilization, incidentals and any other items and services necessary to ensure that litter and trash cans are maintained at all Rivers Project Office associated Recreational and Facility Areas identified within Appendix G in a manner that will promote a sanitary appearance, maintain a litter free area, and present a clean, neat and professional appearance. Litter Pick up and Trash Can requirements shall be that no litter remains within each area, trash cans are free of refuse and there is a neat, sanitary, and professional appearance achieved within area(s) after services are performed.
Services shall include the removal of all litter and debris (reference paragraph 2.11.0 Litter and Debris), picked up and disposed of from all roadways, signs, sidewalks, parking lots, and other objects and/or facilities. All refuse collected shall be disposed of by the contractor in accordance with paragraph 3.7.13, Disposal of Solid Wastes. All trash cans shall be provided by the government in designated areas. The Contractor shall refer to Appendix F for historical trash can locations, cleaning frequencies, and quantities.
Trash can quantities are for reference only, the government reserves the right to add or subtract trash cans during the duration of the contract. The Contractor’s performance shall be based on the Contracting Officer’s (CO) evaluation of each monthly performance.
