As prescribed in 12.205(a)(2), insert a provision substantially as follows:
Evaluation--Commercial Products and Commercial Services (Deviation Date)
(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:
(b) The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussion if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
Basis on which award will be made: Best Value, Price and other factors:
Price: Evaluation of price will be performed using one or more of the price analysis techniques in FAR 12.203. Through these techniques the Government will determine whether prices are reasonable, complete, and are not unbalanced.
A. Quote must be good for at least 60 days after submittal.
Technical Submission: Evaluation of technical submission will be performed using one more of the techniques in FAR 12.203.
A. Quote must clearly describe how each element of the Statement of Work has been met.
B. Quotes that do not submit technical information (descriptive literature/specifications) will be unacceptable.
C. A general statement of compliance or restatement of the requirement will be unacceptable.
D. New Equipment ONLY. Used or remanufactured products will be unacceptable.
E. Shipping is FOB Destination CONUS (Continental U.S.). FOB Origin will be unacceptable.
F. The Government may pay more for quotes offering any additional warranties and or additional specifications, etc., that benefit the intended product use, if advantageous to the Government.
G. The Government may pay more for quotes offering a higher quality product if advantageous to the Government.
H. The Government may pay more for products offering the best solution to the Government in comparison to lowest priced acceptable quote.
I. Quote includes all the requirements in section 7 of the SOW.
Past Performance: Evaluation of Past Performance will be performed using on more of the techniques in FAR 12.203.
A. Will be evaluated utilizing any method available to the Government. Negative or adverse action in the last three years may render the quote to be rated lower.
(b) Options (if applicable). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).
(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
