Section SF 1449 - CONTINUATION SHEET

ADMINISTRATIVE INFORMATION

The U.S. Army Corps of Engineers, Engineer Research and Development Center (ERDC) Directorate of Public Works (DPW) requires commercial sources for the procurement of Electrical Supplies in order to accomplish their mission in supporting the ERDC Laboratories. ERDC intends to establish Master Blanket Purchase Agreements (BPA’s) in order to facilitate the procurement of these supplies. A BPA is a simplified method of filling anticipated repetitive needs for supplies by establishing “charge accounts” with qualified sources of supply. Pursuant to Federal Acquisition Regulation (FAR) 13.303, Blanket Purchase Agreements (BPAs), the Contractor agrees to the identified terms and conditions for a BPA to provide the required Electrical Supplies exclusively with the U.S. Army Corps of Engineers, Engineer Research and Development Center (ERDC).

If and when requested, the vendor shall provide Electrical Supplies which may include, but are not limited to:

Boxes, conduit, connectors, distribution equipment, controls and signaling, video-audio, lighting, security, motors and controls, utility pole and pole line hardware, wire and cables, relays, tools, fasteners, transformers, sensors and heating/ventilation items.

Delivery for ordered Electrical Supplies shall be FOB Destination. Anticipated delivery locations are ERDC Vicksburg, 3909 Hall Ferry Road, Vicksburg, MS 39180; Fort Polk, LA; ERDC Champaign, Champaign, IL; and ERDC CRREL, Hanover, NH, 03755.

Common commercial electrical supplies and materials shall be readily available within 24 hours from the time the order is placed.

The Master Blanket Purchase Agreement (BPA) does not obligate any funds. The government shall be obligated only to the extent of authorized purchases actually made via a properly executed BPA Delivery Order.

The Government estimates, but does not guarantee, that the total volume of purchases through this agreement will be $950,000.00 over a 5-year period. Individual purchases shall not exceed the simplified acquisition threshold which is currently $250,000. There shall be no guaranteed minimum or maximum order limits established and no guaranteed dollar amount of expenditures with the vendor.

Appointed Micro-Purchase Contracting Officers, in good standing, are authorized to place delivery orders against this BPA up to Agency/Organization Program Coordinator (A/OPC) delegated single purchase authority limit, not to exceed the Micro-purchase threshold of $10,000 (10 U.S.C. 2338). Cardholders/Micro-Purchase Contracting Officers throughout ERDC possess varying purchase limits, for example, $3,500, $5,000, and $10,000. A cardholder cannot place a delivery order that exceeds their delegated GPC authority/appointment.

Actions greater than $10,000 or greater than the A/OPC delegated single purchase authority limit require a complete Procurement Action Request (PAR) submitted to the Contracting Office for processing. Only a warranted.

Contracting Officer is authorized to initiate and complete a BPA delivery order greater than $10,000.

The Master BPA’s will expire in five (5) years from date of award or total purchases reaching the BPA limit, (whichever occurs first).

Actual purchases will be made via properly executed BPA Delivery Orders. These orders will be initiated at the time the supplies are needed by an authorized representative of the Contracting Office or by a warranted Micro-purchase Contracting Officer.

All BPA delivery orders shall be supported by a delivery ticket or sales slip that must contain the following information at a minimum:

1) Name of supplier.

2) BPA number.

3) Date.

4) BPA delivery order number and/or PR&C number.

5) Itemized list of supplies provided.

6) Quantity, unit price, and extension of each item; less applicable discounts (unit prices and extensions need not be shown when incompatible with the use of automated systems, provided that the invoice is itemized to show this information).

7) Date of delivery.

INVOICE INSTRUCTIONS:

Invoices will be submitted and processed for each delivery of supplies.

(1) A proper invoice must be in accordance with FAR 32.905 (b)(1).

(2) Submit invoice via email to: CEFC-payments@usace.army.mil

To avoid delay in payment, a copy must also be emailed to the person ordering the supplies.

RESPONSE REQUIREMENTS

The U.S. Army Corps of Engineers Research and Development Center (ERDC) intends to establish Master Blanket Purchase Agreements (BPA’s) for Electrical Supplies. A BPA is a simplified method of filling anticipated repetitive needs for supplies by establishing “charge accounts” with qualified sources of supply.

The needed Electrical Supplies include, but are not limited to:

Boxes, conduit, connectors, distribution equipment, controls and signaling, video-audio, lighting, security, motors and controls, utility pole and pole line hardware, wire and cables, relays, tools, fasteners, transformers, sensors and heating/ventilation items.

Interested vendors need only provide a response (letter format) which verifies the company interest in providing the needed Electrical Supplies and confirmation that they can provide the requested supplies within the delivery guidelines identified in the Administrative Information.

Interested vendors response shall include a web site, price list, or catalog which shows representative Electrical Supply items.

Interested vendors response shall include documentation of past performance for the past five (5) years in meeting requirements as outlined above. The past performance will be considered in selection of Master BPA’s.

Interested vendors response shall include the company Cage Code and/or DUNS number. There is no requirement for a “pricing bid” associated with this action.

Responses shall be submitted electronically to: Adrienne Bingham at Adrienne.Y.Bingham@usace.army.mil.

(h) Certification Regarding Responsibility Matters (Executive Order 12689). (Applies only if the contract value is expected to exceed the simplified acquisition threshold.) The offeror certifies, to the best of its knowledge and belief, that the offeror and/or any of its principals--

(1) [ ___ ] Are, [ ___ ] are not presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(2) [ ___ ] Have, [ ___ ] have not, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a Federal, state or local government contract or subcontract; violation of Federal or state antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property; and

(3) [ ___ ] Are, [ ___ ] are not presently indicted for, or otherwise criminally or civilly charged by a Government entity with, commission of any of these offenses enumerated in paragraph (h)(2) of this clause; and

(4) [ ___ ] Have, [ ___ ] have not, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,500 for which the liability remains unsatisfied.

(i) Taxes are considered delinquent if both of the following criteria apply:

(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) Examples.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability.

Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appear rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals Contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code).
