This is a request for quote for Washington State Patrol in accordance with the performance work statement for the U.S. Army Corps of Engineers, Walla Walla District, at 201 North 3rd Walla Walla, Washington 99362.

Registration at www.sam.gov is required. Failure to register in the SAM database will make an offeror ineligible for award. Effective 29 April 2018, the notarized letter process is now mandatory on all CURRENT registrants at SAM who have a requirement to update data on their SAM record. The notarized letter is mandatory and is required in order for the GSA Federal Service Desk (FSD) to activate the entity's registration. ADDENDUM TO FAR 52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS

Submission of Price Quote – Offeror shall submit 1 copy of the following:

1. Signed and dated Standard Form 1449 (Solicitation/Contract/Order for Commercial Items)

2. Signed and dated Standard Form 30, if applicable, for any Amendments to the Solicitation

3. Completed schedule (pricing information) for all contract line item numbers

4. Completed Clause 52.212-3 Alt I, “Offeror Representations and Certifications—Commercial Items” as noted above.

5. Washington State Patrol complies with the Performance Work Statement.

PRICES QUOTED MUST BE VALID FOR 30 DAYS. Solicitation shall result in a firm-fixed-price contract.

All pricings shall include shipping FOB destination (include shipping cost in price).

BUSINESS HOURS: The standard business hours for the Walla Walla District, Corps of Engineers are Monday through Friday from 8:00 a.m. to 4:00 p.m., excluding federal holidays.

BASIS FOR AWARD

The Government will award one contract resulting from this solicitation in accordance with FAR 13.106 to the responsible offeror meeting or exceeding all solicitation requirements and representing the best value based on price.

Bidder Inquiry:

Part 1

General Information

1. GENERAL: This is a non-personnel services contract to provide additional personal safety for approximately 40 U.S. Army Corps of Engineers (USACE) employees with citation authority (Citation Officer) in the Walla Walla District (NWW). Citation Officers require the services of the Washington State Patrol (WSP, Contractor) to legally request personal information from one of eight dispatch centers located within the State of Washington. Citation Officers may contact a WSP dispatch center by radio, telephone, or e-mail to request an individual’s personal information, including but not limited to; name, address, make of car or boat, date of birth, eye color, and age. This service will enhance a Citation Officer’s overall safety while carrying out his/her duties of enforcing Title 36 Code of Federal Regulation Chapter III, Part 327 (Title 36) on land and waters managed by the USACE. The Government shall not exercise any supervision or control over the Contractor’s agents. The Contractor is the single-source provider of this service. There is no other form of competition.

1.1 Description of Services/Introduction: The Contractor shall provide up to two dispatch communications training sessions per calendar year to all new Citation Officers authorizing access to the WSP Telecommunications System. This required training is to instruct Citation Officers on how to properly contact a WSP dispatch center by radio, telephone, or e-mail to request personal information. Personal information may include a driver’s license plate number or vessel registration number for the purpose of identifying someone who has violated the rules and regulations of Title 36 or for emergency purposes where law enforcement is needed in order for a Citation Officer to safely perform his or her Visitor Assistance duties. The Contractor agrees to dispatch an officer or contact the local law enforcement if an officer is unable to respond to a call from the USACE in a timely manner.

Citation Officers who have completed the mandatory training will be authorized to contact any one of WSP’s eight dispatch centers for help in identifying a person’s vehicle or vessel registration number to process collateral forfeiture citations and written warnings or to gather information for emergency purposes. Upon completing training, the WSP shall issue all new Citation Officers a 5-digit personal identification number (PIN) to identify each officer as having completed the training program. PIN’s may not be transferred or used for personal use.

The Contractor is not responsible for supplying the USACE with equipment, supplies, facilities, transportation, tools, materials, supervision, and other items associated with requesting personal information. The Contractor is responsible for keeping a log of all calls requested by the USACE for review by a Contracting Officer’s Representative (COR) for auditing purposes to ensure the scope of work is being performed to the satisfaction of the USACE.

1.2 Background: The Contractor has previously provided training, and to date, approximately 40 Citation Officers have completed the training and have been issued PINs authorizing those officers to contact a WSP dispatch center by radio, telephone or e-mail to request personal information described in the Section 1.1 Description of Services.

1.3 Objectives: The USACE requests to:

Provide approximately 40 Citation Officers authorization to request personal information from the Contractor too aide in the enforcement of Title 36. Personal information may include a vehicle owner’s name, age, date of birth, address, height, eye color, and if the individual is wanted for a felony by another law enforcement agency.

When necessary, the Contractor will provide a Citation Officer with an individual’s information to better inform the Citation Officer on whether an individual is safe to approach or if additional law enforcement is required.

Personal information received by the USACE agents may be used to issue a collateral forfeiture citation or written warnings.

The USACE requests up to two training sessions per calendar year, as needed by all new Citation Officers. This annual training is to be conducted each year for the duration of this contract.

1.4 Scope: Services include providing dispatch services for approximately 40 Citation Officers. In addition, the Contractor shall provide up to two training sessions per calendar year to all new Citation Officers. Upon completion of training, Citation Officers will be assigned a PIN identifying each Citation Officer as having legal access to sensitive information. The Contractor will charge the purchaser a fixed monthly fee for this service.

1.5 Period of Performance: The Period of Performance shall be for one (1) Base Year of 12 months and one (1) 12-month Option Year.

Base Year: 1 October 2024 through 30 September 2025 Option Year 1: 1 October 2025 through 30 September 2026

1.6 General Information

1.6.1 Quality Control: The Contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this Performance Work Statement. The Contractor will make a log for each request for information on a subject or vehicle made by the USACE and will make those logs available to the USACE upon request for audit purposes only.

The Contractor may require the USACE to conduct periodic in-house training to refresh all authorized employees on the proper protocol for requesting personal data by use of radio, telephone or e-mail. The Contractor may require the Citation Officer to use a standardized communication procedure, i.e.; officer call number, the purpose for calling the Contractor, and signing off. The Contractor is to notify the USACE if improper protocol is being used by a Citation Officer.

The Contractor has the right to refuse service to the USACE if higher priority radio traffic or law enforcement action that requires imminent radio traffic is already in progress.

The Contractor agrees to dispatch an officer or contact the local law enforcement if an officer is unable to respond to a call from the USACE in a timely manner.

The USACE agrees to notify the Contractor, in writing, when a Citation Officer authorized to request personal information leaves NWW. USACE will provide an updated Citation Officer roster to the Contractor no less often than twice per year. The Contractor is to remove departed USACE employee names and PINs from the authorized Citation Officer list.

The USACE and the Contractor will agree on a zero-tolerance policy for improper use of the Contractor’s services and that all laws, rules, and regulations of the Federal Communications Commission will be strictly adhered to.

1.6.2 Quality Assurance: The Government shall evaluate the Contractor’s performance under this contract, in accordance with the Quality Assurance Surveillance Plan. This plan focuses on what the Government must do to ensure that the Contractor has performed in accordance with the performance standards. Performance Standards are outlined within the Performance Requirements Summary (Technical Exhibit 1) which defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).

1.6.3 Recognized Holidays: The Contractor is required to perform services on holidays.

1.6.4 Hours of Operation: The Contractor is responsible for providing 24-hour radio, telephone, and/or email support to Citation Officers 365 days a year.

1.6.5 Place of Performance: The services to be provided to the USACE under this contract are from the Contractor’s eight dispatch offices including Tacoma, Yakima, Bellevue, Spokane, Vancouver, Wenatchee, Marysville, and Bremerton, Washington areas.

1.6.6 Type of Contract: The Government will award a firm-fixed price contract with a base year and one option year for services outlined in Section 1.1, Description of Services.

1.6.7 Security Requirements:

1.6.7.1 E-Verify Screening: The Contractor shall comply with the requirements set forth in FAR Clause 52.222-54 Employment eligibility verification and FAR Subpart 22.18 in using E-Verify Program at (https://www.e-verify.gov/) to meet the contract employment eligibility requirements. Contractors are encouraged to cooperate with Federal and State agencies responsible for enforcing labor requirements to include eligibility for employment under United States immigration laws in accordance with FAR 22.102- 1(i). An initial list of verified/eligible candidates shall be provided to the USACE COR no later than three business days after the initial contract award.

1.6.8 Special Qualifications: The Contractor is responsible for ensuring that all agents who operate the eight dispatch centers respond to radio, telephone and e-mail requests from trained Citations Offices in a timely manner or refer the Citation Officer to another law enforcement agency for assistance or technical support.

1.6.9 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office, in accordance with Federal Acquisition Regulation Subpart 42.5. The Contracting Officer (CO), Contracting Officer’s Representative, and other Government personnel, as appropriate, may meet periodically with the Contractor to review the Contractor's performance. At these meetings, the CO will apprise the Contractor of how the Government views the Contractor’s performance. The Contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues.

These meetings shall be at no additional cost to the Government.

1.6.10 Contracting Officer’s Representative (COR): The COR monitors all technical aspects of the contract and assists in contract administration. The COR is authorized to perform the following functions:

assures that the Contractor performs the technical requirements of the contract; performs inspections necessary in connection with contract performance; maintains written and oral communications with the Contractor concerning technical aspects of the contract; issues written interpretations of technical requirements; and monitors the Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies. The COR is not authorized to change any of the terms and conditions of the resulting order.

1.6.11 Key Personnel: Contract Manager: The Contractor shall provide a Contract Manager who shall be responsible for the performance of the work. The name of this person and an alternate or alternates, who shall act for the Contractor when the manager is absent, shall be designated, in writing, to the CO. The Contract Manager or alternate must have full authority to act for the Contractor on all contract matters relating to daily operation of this contract. The Contract Manager shall maintain a workforce to complete work in accordance with the time and quality standards contained hereunder.

1.6.11.1 Work Control: The Contractor shall implement all necessary work control procedures to ensure timely accomplishment of work requirements, as well as to permit tracking of work in progress. The

Contractor shall plan and schedule work to ensure material, labor, supplies and equipment are available to complete work requirements within the specified time limits and in conformance with the quality standards established herein. Verbal scheduling and reports on the status of service call shall be provided when requested by the CO’s Representative / Government.

1.6.11.2 Work Schedule: The Contractor's work schedule shall provide 24-hour support to Citation Officers 365 days a year.

1.6.11.3 Interference with Government Business: The Contractor shall schedule and arrange work so as to cause the least interference with the normal occurrence of Government business and mission. In those cases where some interference may be essentially unavoidable, the Contractor shall be responsible to make every effort to minimize the impact of the interference, inconvenience, customer discomfort, etc.

1.6.11.4 Notification of Non-Accessibility: N/A

1.6.12 Identification of Contractor Employees: N/A

1.6.13 Contractor Travel: The Contractor shall not require travel costs.

1.6.14 Other Direct Costs: For each year of the contract, the USACE agrees to pay for mandatory radio training, as needed, by all new Citation Officers.

1.6.15 Data Rights The Government does NOT have rights to review NCIC documents. The USACE has requested to review the transmission logs for radio or telephone requests made by Citation Officers for auditing purposes only and to cross check the monthly service fees charged to the USACE.

1.6.16 Organizational Conflict of Interest: Contractor and sub-Contractor personnel performing work under this contract may receive, have access to, or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent Organizational Conflict of Interests (OCI), as defined in FAR Subpart 9.5. The Contractor shall notify the CO immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the CO to avoid or mitigate any such OCI’s mitigation plan will be determined acceptable solely at the discretion of the CO and in the event the CO unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the CO may effect other remedies as he or she deems necessary, including prohibiting from participation in subsequent contracted requirements which may be affected by the OCI.

1.6.17 Phase In /Phase Out Period: This contract includes a base year plus one (1) additional option year. This is intended for continuity of services and requires no phase in / phase out period.

PART 2

DEFINITIONS & ACRONYMS

2. DEFINITIONS AND ACRONYMS:

2.1 DEFINITIONS

2.1.1 CITATION OFFICER. All USACE employees with citation authority and who wear the Natural Resources\ Management Park Ranger uniform. All employees requiring citation authority must take an USACE Approved course with successful completion to become a Citation Officer. USACE employees requiring citation authority include park rangers, natural resource specialists, natural resource managers, park managers, foresters, and wildlife biologists.

2.1.2 CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the Government. The term used in this contract refers to the prime.

2.1.3 CONTRACTING OFFICER (CO). A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the Government. Note: The only individual who can legally bind the Government.

2.1.4 CONTRACTING OFFICER'S REPRESENTATIVE (COR). An employee of the U.S. Government appointed by the Contracting Officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.

2.1.5 DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement.

2.1.6 DELIVERABLE. Anything that can be physically delivered but may include non-manufactured things such as meeting minutes or reports.

2.1.7 KEY PERSONNEL. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS.

When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.

2.1.8 MEMORANDUM OF UNDERSTANDING (MOU). A legal document outlining the terms and details of an agreement between parties, including each parties’ requirements and responsibilities.

2.1.9 PHYSICAL SECURITY. Actions that prevent the loss or damage of Government property.

2.1.10 QUALITY ASSURANCE. The Government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.

2.1.11 QUALITY ASSURANCE SURVEILLANCE PLAN (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of Contractor performance.

2.1.12 QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.

2.1.13 SUBCONTRACTOR. One that enters into a contract with a prime Contractor. The Government does not have privity of contract with the subcontractor.

2.1.14 WORK DAY. The number of hours per day the Contractor provides services in accordance with the contract.

2.1.15 WORK WEEK. Monday through Friday, unless specified otherwise.

3. Specific Tasks:

3.1 Basic Services. The Contractor will authorize approximately 40 citation officers from NWW access to eight dispatch centers outlined in Section 1.6.5, Place of Performance, to request their personal information on the ownership of a vessel or vehicle including, but not limited to, a driver’s name, mailing address, age, date of birth, hair and eye color, height and weight or other pertinent information that aid an agent’s personal safety while executing the duties as a Citation Officer while enforcing the rules and regulations of Title 36.

3.2 Access to 8 Dispatch Centers. The Contractor will allow authorized Citation Officers to call into one of the eight Dispatch Centers using a radio or telephone for information to ensure officer safety while enforcing the government’s rules and regulations of Title 36. Dispatch Centers are located in Tacoma, Yakima, Bellevue, Spokane, Vancouver, Wenatchee, Marysville, and Bremerton, Washington areas.

3.3 Training. The Contractor shall provide up to two dispatch communications training sessions per calendar year to all new Citation Officers authorizing access to the WSP Telecommunications System.

This required training is to instruct Citation Officers on how to properly contact a WSP dispatch center by radio, telephone, or e-mail to request personal information.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO

SURVEILLANCE SERVICES OR EQUIPMENT (NOV 2021)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

(a) Definitions. As used in this provision-

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."

(d) Representations. The Offeror represents that--

(1) It [ ___ ] will, [ ___ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and

(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that--

(1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment--

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);

(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and

(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(ii) For covered services--

(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or

(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.

(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:

(i) For covered equipment--

(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known);

(a) Definitions. As used in this provision, “covered telecommunications equipment or services” and "reasonable inquiry" have the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.

(c) Representations.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL PRODUCTS AND

COMMERCIAL SERVICES (MAY 2024)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.

(a) Definitions. As used in this provision --

"Covered telecommunications equipment or services" has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

"Economically disadvantaged women-owned small business (EDWOSB) concern" means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127, and the concern is certified by SBA or an approved third-party certifier in accordance with 13 CFR 127.300.
