VARIATION IN FACILITY NUMBERS.

The totals for each category of facilities contained in Appendix A may be changed by the COR by no more than plus 10% without any adjustment in the contract price. This adjustment may be made based on the total for each type of facility, as shown in Appendix A, and neither the total for the facility in each location nor the total for a given time.

Therefore, adjustments at any location may be larger on an individual area percentage basis than the total percentage change for the type of facility. As an example, if the total number of exterior trash receptacles was 500, then the number of receptacles in any single area or a group of areas may be increased by 50; i.e., 10%.

Notification of any change in numbers will be provided in writing to the Contractor by the COR at least 5 calendar days in advance of the change. In applying the percentage limit, the nearest whole number, as selected by applying standard rounding procedures, shall be used.

For example, if the total number of comfort stations was 7, 10% of 7 equals 0.7 which will be rounded to the next whole number, i.e., 1 comfort station. For facilities whose totals are 5 or less, the maximum variance without any adjustment in the contract price shall be one for each type of facility.

Appendix A is furnished for information purposes only and is subject to change by the COR.

PAYMENT ADJUSTMENT PROCEDURES

1. Payment Adjustment Procedures Associated with Government Correction of Performance Deficiencies. If the Government corrects performance deficiencies either using its own resources or with other commercial resources, payment adjustments may be made in the amount of the excess costs of such corrective actions. The procedure for determining these excess costs entails the Contractor including the costs of the deficient work in his/her invoice as if it were acceptable; and then, upon receipt of the invoice the Government deducting the total costs of corrective actions from the invoice amount. The Contractor will be advised in advance by the Contracting Officer or COR of such deductions, but not of the corrective actions themselves.

Also, the amount of the related deductions as well as their method of computation will be furnished to the Contractor for his/her information.

2. Value Determination for Individual Item Cleaning Services. Since the bidding schedule contains pricing for services on a monthly, lump-sum basis, the individual costs for performing services for each type of facility or requirement, is not readily available. Therefore, based upon:

a. the historical costing of unit-price type contracts for the same services, and,

b. an analysis of the amount of effort required to properly clean each type of facility, The Government will establish relative weights representing the effort and total individual costs for each job. These weights will be used to subdivide costs for each job.

3. Sample Weights. Sample weights are shown below. However, these sample weights are not binding and should not be taken as being in any way accurate. They are presented only to illustrate how the system will work. This list is not/does not represent all types of facilities to be serviced.

Facility Weight Facility Weight Office Building 15 Bench 2 Comfort Station 25 Picnic Shelter 10 Jug Filler Hydrant 1 Picnic Table 10 Grill 8 Exterior Trash Receptacle 4 Grill Service Table 3 Drinking Fountain 2 Playground Equipment 10 Playground (Surface) / Ball 10

Courts

4. Payment Adjustments Associated with Deficient Work Not Corrected by the Government.

When performance deficiencies are not corrected by the Government, payment adjustments are to be made for each item of work determined to be unacceptable. Such adjustments will be made based on the applicable monthly price for the item multiplied by the quantities of deficiencies for that item. This payment adjustment procedure will be used only in relation to item cleaning services and not for litter-pickup services. The total monthly value of deficiencies determined by this method will be deducted from the Contractor's invoice amount in accordance with Paragraph 5.2.3.
