52.212-2 Evaluation-Commercial Products and Commercial Services. (Nov 2021)

Evaluation-Commercial Products and Commercial Services (Nov 2021)

(a) The Government will utilize a Lowest Price Technically Acceptable (LPTA) evaluation method for this requirement. The Government will award a single contract to the offeror whose proposal is technically acceptable, the lowest price, is deemed responsible in accordance with the Federal Acquisition Regulation (FAR), Part 12 Acquisition of Commercial Items, in conjunction with FAR Subpart 13.5, Simplified Procedures for Certain Commercial Items, and FAR 19, Small Business Program, as supplemented, by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS), and whose offer conforms to the solicitation's requirements (to include all stated terms, conditions, and all other information required by the solicitation). Offers that fail to address all the requirements set forth in the Solicitation will be rejected. The Government intends to evaluate proposals and award a contract without discussions. Therefore, the Offeror's submission should contain their best terms from a cost and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government reserves the right to reject an offer upon initial submission and not consider it for contract award if any required data is absent or the data received conveys a misunderstanding of the requirement.

BASIS FOR AWARD

Award for All of the Work. The Government intends to award one contract as a result of this solicitation. Offers received for less than the stated number of items listed in the Proposal Schedule will be considered ineligible for award. The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a), Clarifications and award without discussions).

Therefore, the offeror's initial proposal should contain the offeror's best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In the event that discussions are held, a competitive range determination will be made. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer if the lowest offer is rated unacceptable; and waive informalities and minor irregularities in offers received. After responses have been received, MICC- Fort Jackson may request clarifications.

The Government will evaluate the contractor's technical proposal to ensure that it reflects a sound understanding of this requirement and complies with the requirements in the solicitation. An evaluation will be made to verify that the offeror is capable of providing the required services at a fair market price. Award will be made based on LPTA offeror. A determination of a fair and reasonable price will be conducted. The Federal Acquisition Regulation (FAR), as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS) and the Army Federal Acquisition Regulation Supplement (AFARS) will be used to evaluate the offer and award this requirement.

EVALUATION FACTORS

The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

The following factors shall be used to evaluate offers:

Factor I - Technical Capability

The Technical Capability Factor evaluation provides an assessment of the offeror's capability to satisfy the Government's minimum requirements. The Government will evaluate the contractor's technical proposal to ensure that it reflects a sound understanding of this requirement. The Government will evaluate proposals to determine each offeror's technical capability. The proposal must demonstrate a practical/functional approach that meets the requirements of the PWS. Failure to meet the criteria will render the proposal technically unacceptable and the proposal will not receive further consideration for award.

The Technical factor is divided into the following subfactors:

Subfactor 1 - Management Approach: The management approach for adapting to changing priorities, enhancing customer service, ensuring adequate levels of performance are maintained, and procedures for problem resolution will be evaluated to ensure a sound and comprehensive approach.

This evaluation will focus on the offeror's:

i. Management structure of key personnel and their roles and responsibilities in fulfilling the tasks outlined in the PWS.

ii. Approach to the management of personnel and capability to ensure the ability of proposed staff to perform work assignments accurately and in a timely manner.

iii. Approach to their proposed inspection system, including frequency and methods of identifying and preventing deficiencies for contract functions, to determine effectiveness and thoroughness of quality control procedures.

iv. Approach to development and implementation of an effective quality control plan that adheres to requirements specified in the PWS.

Subfactor 2 - Staffing Approach: The proposal will be evaluated to determine the methods and strategies the offeror uses to manage its workforce.

This evaluation will focus on how well offeror's:

i. Have demonstrated how personnel will fit into the overall organization, adequately described the responsibilities of each position, and adequately demonstrated sufficient experience to manage and execute all operating systems of the EST II platform.

ii. Demonstrated how they will ensure personnel's efficiency in the utilization of the TS-MATS platform in regards to schedule maintenance and monitoring of usage date for simulators.

iii. Demonstrated how they will ensure the quality of instruction and approach to maintaining proficiency on the most current version of EST II.

iv. Demonstrated their understanding and ability to comply with all Federal, State, Local, and safety regulations to include COVID-19 guidance.

Technical Capability will receive one of the adjectival ratings defined below. If determined to be unacceptable will result in an overall unacceptable rating and the proposal will not receive further consideration for award. An Offeror shall achieve a minimum rating of "Acceptable" in the Technical Capability factor to be viable for award and shall demonstrate a sound approach that meets all requirements and objectives of the PWS.

Technical Acceptable/Unacceptable Ratings

Ratings Description

Acceptable Proposal meets the minimum requirements of the solicitation

Unacceptable Proposal does not meet the minimum requirements of the solicitation

Factor II - Price

The resulting award will be a Firm Fixed Price contract. Unreasonably high, unbalanced, inaccurate or incomplete price proposals may be the grounds for eliminating a proposal from competition.

1. will not be scored or rated. The Government will evaluate the price for The Government will evaluate the pricing award purposes by adding the total price of the base year and option years; and comparing that total price for balance against all of the proposals found to be technically acceptable.

4. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic Options.

requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

5. As part of price evaluation, the government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding one-half of the proposed price for the last year of the performance to the Total Evaluated Price (TEP). Offerors are not required to propose a price for the six-
