52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Factor 1: Technical Technical criteria consists of the following two sub-factors:

Sub-Factor 1a – Resources - Contractor shall provide a list of all currently owned equipment; identify any equipment that may be needed in addition to what is owned, and detail how equipment will be acquired. Contractor shall identify all labor skills/categories that shall be used during the duration of the contract.

Sub-Factor 1b – Experience - Contractors shall list three (3) previous jobs where the same or similar services as described in PWS were performed (see Appendix A). Include the name of the business, contact information, the types of services performed, and the duration and dollar value of each job.

Factor 2: Past Performance Past performance will be based on the Government’s knowledge of performance under current and previous contracts, information provided by references directly to the Government or through other means, or based on any other reasonable basis. If past performance information is not available for the offeror; the offeror shall be assigned a neutral rating which is neither favorable nor unfavorable.

Factor 3: Price Contractor shall provide a Firm-Fixed price for each CLIN. Price will be based on the grand total for the base and all option years. Offeror shall also break out labor categories, labor rates, estimated hours, and profit rate.

Technical and Past Performance are significantly more important than price.

Within the Technical factor, the sub-factors are listed in descending order of importance with Resources being more important than Experience.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
