Continuation of Description

Section A Narrative:

1. The Army Contracting Command - Rock Island (ACC-RI), CCRI-AIH hereby issues Solicitation W519TC-26-Q-A110 KINGSBURY/M119- BRACKET, GEAR (EXTRUSION) in support of the Rock Island Arsenal - Joint Manufacturing and Technology Center (RIA-JMTC).

The award will be issued in accordance with FAR Part 12 (Acquisition of Commercial Items) and FAR Part 13 (Simplified Acquisition Procedures). The Government intends to award one

(1) Firm Fixed Price (FFP) Purchase Order to the lowest price, responsive, and responsible contractor whose quote conforms to the terms and conditions of the solicitation and represents the lowest total evaluated price. Contractors are responsible for providing their best price at the time of the quote submission. Contractor's responsibility will be determined as outlined in FAR 9.104-1. The Government intends to evaluate proposals and issue an award without discussion with Offerors (except for clarifications as described in FAR 15.306 (a)).

2. Quotes shall be valid for a period of 60 calendar days from the required submission date.

Attachments:

Attachment 0001: 12593241Drawings C-Distro

3. Quotes MUST include all costs, including delivery of supplies to Rock Island Arsenal, IL 61299.

4. Invoicing is to be done via the Wide Area Workflow (WAWF), with payment being made by the Defense Finance and Accounting Service (DFAS).

5. The one-year warranty period will begin once the equipment has been delivered to Rock Island Arsenal and the invoice has been accepted in WAWF.

6. On time delivery is very critical. Therefore, the contractor must adhere to the delivery requirements indicated in the subsequent award. Failure to comply with the contractual delivery schedule in the subsequent award may result in termination of the order or require consideration if the Government elects to extend the delivery. The Government is not required to extend the delivery schedule if you encounter delays. The nonavailability of raw materials, subcontractor issues, scheduling conflicts, etc. are not acceptable excuse for failing to meet the delivery schedule. If there is going to be a delay in delivery, the contractor is required to notify the Contract Specialist and/or Contracting Officer designated in this contract prior to being late.

Contractors must provide written notice of what the delay is, the new proposed delivery schedule, and offered consideration for the delay for Government consideration. If the Government elects to extend your delivery, a formal modification will be implemented.

It is the responsibility of the contractor to ensure they are providing quality products that conform to the contract terms and conditions (to include delivery schedule). Delivery of nonconforming products results in delivery/acceptance delays and increased cost to the Government. Early Delivery is acceptable as long as the warrant for each item starts on the date delivery has been requested.

Earlier deliveries are authorized at no additional cost to the Government.

7. Army Contracting Command Government Point of Contact (POC):

Contract Specialist: Angel Traman angel.j.traman.civ@army.mil

Contracting Officer: Daniel Sinnott daniel.s.sinnott.civ@army.mil

Pre-registration of visitors allows for the National Crime Information Center NCIC-111 background check to be conducted prior to the individual arriving at RIA, reducing their wait time upon arrival.

It is the responsibility of the prime contractor to ensure that this information is passed along to any subcontractor or transportation provider used during the performance of this purchase order. DRIVERS WHO DO NOT MEET THE INSTALLATION ACCESS REQUIREMENTS WILL

NOT BE ALLOWED ON THE INSTALLLATION AND WILL BE TURNED AWAY.

Long-term contract means a contract of more than five years in duration, including options.

However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.

Small business concern-

(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in its field of operation, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause.

(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships. SBA determines affiliation based on the factors set forth at 13 CFR 121.103.

(b) If the Contractor represented that it was a small business concern, a small disadvantaged business concern, or a joint venture that was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (e) of this clause or, if applicable, paragraph (g) of this clause, upon occurrence of any of the following:

(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.

(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.

(3) For long-term contracts-

(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and

(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.

(c) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code(s) assigned to this contract. The small business size standard corresponding to this NAICS code(s) can be found at https://www.sba.gov /document/support--table-size-standards.

(d) The small business size standard for a Contractor providing an end item that it does not manufacture, process, or produce itself, for a contract other than a construction or service contract, is 500 employees, or 150 employees for information technology value-added resellers under NAICS code 541519, if the acquisition-

(1) Was set aside for small business and has a value above the simplified acquisition threshold;

(2) Used the HUBZone price evaluation preference regardless of dollar value, unless the Contractor waived the price evaluation preference; or

(3) Was an 8(a), HUBZone, service-disabled veteran-owned, economically disadvantaged women-owned, or women-owned small business set-aside or sole-source award regardless of dollar value.

(e) Except as provided in paragraph (g) of this clause, the Contractor shall make the representation(s) required by paragraph (b) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting officer in writing within the timeframes specified in paragraph (b) of this clause, that the data have been validated or updated, and provide the date of the validation or update.

(f) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (e) or (g) of this clause.

(g) If the Contractor does not have representations and certifications in SAM, or does not have a representation in SAM for the NAICS code applicable to this contract, the Contractor is required to complete the following rerepresentation and submit it to the contracting office, along with the contract number and the date on which the rerepresentation was completed:

2021-11

Economic Price Adjustment-Standard Supplies (Nov 2021)

(a) The Contractor warrants that the unit price stated in the Schedule for ____ [offeror insert Schedule line item number] is not in excess of the Contractor's applicable established price in effect on the contract date for like quantities of the same item. The term "unit price" excludes any part of the price directly resulting from requirements for preservation, packaging, or packing beyond standard commercial practice. The term "established price" means a price that-

(1) Is an established catalog or market price for a commercial product sold in substantial quantities to the general public; and

(2) Is the net price after applying any standard trade discounts offered by the Contractor.

(b) The Contractor shall promptly notify the Contracting Officer of the amount and effective date of each decrease in any applicable established price. Each corresponding contract unit price shall be decreased by the same percentage that the established price is decreased.

The decrease shall apply to those items delivered on and after the effective date of the decrease in the Contractor's established price, and this contract shall be modified accordingly.

(c) If the Contractor's applicable established price is increased after the contract date, the corresponding contract unit price shall be increased, upon the Contractor's written request to the Contracting Officer, by the same percentage that the established price is increased, and the contract shall be modified accordingly, subject to the following limitations:

(1) The aggregate of the increases in any contract unit price under this clause shall not exceed 10 percent of the original contract unit price.

(2) The increased contract unit price shall be effective-

(i) On the effective date of the increase in the applicable established price if the Contracting Officer receives the Contractor's written request within 10 days thereafter; or
