PART I - THE SCHEDULE
SECTION B
SUPPLIES OR SERVICES AND PRICES/COSTS
Acquisition Subject to Boeing Rights Guard (BRG) Restrictions:
It is the intention of DLA Aviation at Oklahoma City to allow a 45-Day Solicitation period for Boeing Rights Guard applicable acquisitions with days 1 through 15 being allotted to allow time for additional potential sources to submit requests for, and receive, the BRG Technical Data Package CD-ROM. This additional time over-and-above the standard 30-day Solicitation timeframe is a courtesy and serves as constructive notice that it is the affirmative responsibility of potential offerors to monitor the FBO and quickly process requests for the BRG Technical Data Package CD-ROM and that Solicitation Closing Dates WILL NOT be extended for the sole-purpose to allow for additional time to propose.
Multiple awards are NOT contemplated. The Government intends to award to a SINGLE source.
The Maximum number of units that are contemplated under this contractual action is 22 ea, to include any First Article unit(s), if required. The final award quantity is TBD, with a possible final buy quantity range for this acquisition between 4ea up to a Maximum quantity of 22 ea, if any contract is awarded at all. Bid “A” and Bid “B” below account for this possibility, with and without First Articles units.
If the offeror proposes any Non-Recurring (NRE) or Miscellaneous expenses, the offeror shall clearly identify these cost elements separate and apart from the Unit-Price offer(s). Offers contingent upon Minimum/Maximum Contractual Quantity are NOT to be made, and if made will also constitute an alternate offer and be determined Non-Responsive.
Surplus is NOT authorized for this procurement.
NOTES APPLICABLE TO BID "A" FIRST ARTICLE (FA) 0001 and SubCLINs 0001AA - 0001AB:
3ea First Article unit ARE required for this acquisition. ALL offerors are required to bid First Article Bid "A".
There is a requirement for a First Article Test Report and First Article Fit Check. After the First Article Test Report has been performed by the contractor in accordance with FAR clause 52.209-3 (Contractor Test), the First Article item is to be shipped to Tinker AFB. The Government will perform a Proper Fit/Function Test in accordance with FAR clause 52.209-4 (Government Test). If the First Article Report and Fit Check are approved, the First Article exhibit will remain on the aircraft and will not be forwarded to USAF supply, but will be considered part of the contract quantity. The contractor shall NOT proceed with production quantities (0001AC) until notice of First Article approval and authorization to proceed is received from the Contracting Officer.
Contractor's notification to ACO and the USAF Engineering Office (424 SCMS/GUEA) of test time and location is due 45-days prior to start of testing at: Tinker.First.Article@us.af.mil.
The First Article units offered must be manufactured at the facilities in which that item is to be produced under the contract, or if the First Article is a component not manufactured by the contractor, such component must be manufactured at the facilities in which the component is to be produced for the contract. A certification to this effect must accompany each First Article which is offered.
--Please note that the “Ship To” address for the exhibit is different than the “Ship To” address for the First Article Test Report.

SECTION F
DELIVERIES OR PERFORMANCE
52.211-8 TIME OF DELIVERY (JUN 1997)
(IAW FAR 11.404(a)(2))
(a) The Government requires delivery to be made according to the following schedule:
DELIVERY FOR EACH ITEM IS ANNOTATED IN THE SCHEDULE (PART I SECTION B) UNDER EACH LINE ITEM.
The Government will evaluate equally, as regards time of delivery, offers that propose delivery of each quantity within the applicable delivery period specified above. Offers that propose delivery that will not clearly fall within the applicable required delivery period specified above, will be considered nonresponsive and rejected. The Government reserves the right to award under either the required delivery schedule or the proposed delivery schedule, when an offeror offers an earlier delivery schedule than required above. If the offeror proposes no other delivery schedule, the required delivery schedule above will apply.
ANNOTATE YOUR PROPOSED DELIVERY, IF ANY, UNDER THE GOVERNMENT’S DELIVERY SET FORTH UNDER EACH ITEM IN THE
SCHEDULE.
(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed, or otherwise furnished to the successful offeror, results in a binding contract. The Government will mail or otherwise furnish to the offeror an award or notice of award not later than the day award is dated. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor's date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the award through the ordinary mails, or (2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term "working day" excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer will be considered nonresponsive and rejected.
(Applicable when the Government desires delivery by a certain time but requires delivery by a specified later time, and the delivery schedule is to be based on the date of the contract)
52.211-8 TIME OF DELIVERY -- ALTERNATE I (APR 1984)
(IAW FAR 11.404(a)(2)) If the delivery schedule is expressed in terms of specific calendar dates or specific periods and is based on an assumed date of award, the contracting officer may substitute the following paragraph (b) for paragraph (b) of the basic clause. The time may be expressed by substituting "on or before"; "during the months ..."; or "not sooner than ... or later than ..." as headings for the third column of paragraph (a) the basic clause.
(b) The delivery dates or specific periods above are based on the assumption that the Government will make award by 9 JULY 2021. Each delivery date in the delivery schedule above will be extended by the number of calendar days after the above date that the contract is in fact awarded. Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed or otherwise furnished to the successful offeror results in a binding contract.
Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails.
(The above Clause/Provision has been modified.)
(Applicable when the delivery schedule is expressed in terms of specific calendar dates or specific periods and is based on an assumed date of award)
52.211-9 DESIRED AND REQUIRED TIME OF DELIVERY (JUN 1997)

(IAW AFFARS 5301.9103)
(a) An ombudsman has been appointed to hear and facilitate the resolution of concerns from offerors, potential offerors, and others for this acquisition. When requested, the ombudsman will maintain strict confidentiality as to the source of the concern.
The existence of the ombudsman does not affect the authority of the program manager, contracting officer, or source selection official. Further, the ombudsman does not participate in the evaluation of proposals, the source selection process, or the adjudication of protests or formal contract disputes. The ombudsman may refer the interested party to another official who can resolve the concern.
(b) Before consulting with an ombudsman, interested parties must first address their concerns, issues, disagreements, and/or recommendations to the contracting officer for resolution. (c) The Competition Advocate (CA) at each contracting activity/office (as defined in DLAD 2.101) shall act as the ombudsman and attempt to resolve contractor complaints. DLA AVIATION – AOCA’s CA/ombudsman can be reached at 405-855-3556, facsimile (405) 734-8129. Each activity is responsible for developing procedures for executing the duties and responsibilities.
(d) The ombudsman has no authority to render a decision that binds the agency.
(e) Do not contact the ombudsman to request copies of the solicitation, verify offer due date, or clarify technical requirements.
Such inquiries shall be directed to the contracting officer.
