DESCRIPTION/SPECIFICATION

1. Statement of Work:

A. Description of Services The Contractor shall establish and operate the food service facilities described herein for the purpose of dispensing quality food, nonalcoholic beverages, supporting catering events as requested, and such other items as may be authorized by the Contracting Officer (CO) in accordance with the terms and conditions of this contract. USPTO expects the cafeteria to be operational by December 1, 2023

B. Scope of Work The Contractor is responsible to ensure full execution of the terms of the contract between GSA and the Contractor. The following documents constitute the full contractual agreement between GSA and the Contractor:

1. Contractor’s Response to Request for Proposal (RFP) that is accepted by GSA and upon which the contract was awarded to the contractor.

2. The RFP used by GSA during the bid process that outlines the work statement and GSA expectations related to the award of the contract; and,

3. Any amendments and documents issued by the CO to the contractor.

This foodservice facility will be operated for the benefit of approximately 1300 staff that are assigned to the USPTO facility on a full-time basis. On average, 1,082 employees are on location on Mondays, and 1246 to 1275 on Tuesday, Wednesday, and Thursday, and 928 on Fridays.

The USPTO utilizes Telework (TW) and/or Alternate Work Schedules (AWS). AWS provides employees one day off (typically a Monday or Friday) every week or every other week depending on their work schedule.

Telework supports employees who works from home on select days of the week with a wide range of telework options from one day to full time programs

In addition, staff use the auditorium and lower atrium for events to include public outreach events.

These visitors have access to the cafeteria but may not necessarily “overlap” the breakfast or lunch period. Post-COVID, USPTO has seen a consistent increase in in-person events and hybrid events. The Auditorium is active the most on Tues-Thursday and can run 2 events in this space simultaneously when split including use of the lower atrium as event space. See attachment 9: “Auditorium In-Person Attendance

RFP for Dining Services Page 9

2022-2023”. The Conference Service teams share large event information to the cafeteria. Pre-COVID, the request for catering was significant for events and holiday celebrations.

Restaurants, amenities, and other competition in the area should be studied and evaluated by the prospective Contractor. The Contractor’s proposed program should include a foodservice program to mitigate outside competition and maximize operational success of the Contractor’s proposed food service program. Innovation, creativity in culinary cuisine, flexibility, agility, and the desire to understand the unique and diverse culture that make up staff at USPTO in the program are the main elements of its success.

The USPTO and GSA shall not be held responsible for any variation or annotations regarding building and/or visitor population figures or any other assumptions noted herein.

C. Term of Contract The contract shall be for a period of 5 years, effective with the beginning date specified in the Notice to Proceed, subject to the rights of termination set forth in the termination clauses. At the option of the Contracting Officer, and in concurrence with the Contractor, the contract may be extended thereafter for a term or terms of one to five years, provided that the Contracting Officer shall give written notice to the Contractor at least 180 days before the end of contract, or any extensions thereof, would otherwise expire. In no event shall the contract period, as extended, exceed a period of 15 years from the beginning date of the original contract.

The Contractor shall employ sufficient and suitable personnel to support this contract, and observe contract requirements, as set forth herein.

3. The contractor shall make available for customers to capture their dining and food experience through various means such as a website and/or survey cards in facility. RFP for Dining Services Page 12 the breakfast and lunch service periods. Contractor is responsible for cleaning and maintaining kitchen area, emptying kitchen and cook area trash (designated area).

B. Menus It shall be the responsibility of the Contractor to provide a variety of quality prepared foods that are a model for wellness and sustainability, to offer meat and poultry products that are in line with the responsible use of antibiotic polices in accordance with the Presidential memo to monitor and implement industry trends, industry standard practices and the industry’s latest innovative concepts.

Menus must also include items for people with dietary restrictions and offer “low fat”, "low sodium", "low calorie" and "reduced sugar" menu items as defined in Attachment #7 - “Food Service Guidelines for Federal Facilities.”

Considering the emphasis placed on the wellness program in this solicitation, and to ensure optimum visibility of the healthy menu offerings, the Contractor should take into consideration the positive effects of priority placement of the products in the cafeteria and on the serving lines. Examples of product placement may include placement of healthy menu offerings as the first thing the customer encounters at each serving line, or at the cash register or at key places on serving lines that are closest to eye level.

For Contractor standard menu items only: The Contractor shall comply with the nutritional information requirements of the 2010 and all subsequent revisions of U.S. Dietary Guidelines for Americans (www.health.gov/dietaryguidelines), including the following:

1. Prior to the start date of service, the Contractor shall provide to the COR, a price/portion book, accounting for all standard menu offerings only (e.g., hamburger - list patty size; list ounces of meat, included toppings, and selling price)

2. During each serving period, easy-to-read menus with prices and nutrition data listed shall be prominently displayed for the information of patrons at the cafeteria. Contractor shall identify menu items that offer meat and poultry products that are in line with the responsible use of antibiotic.

It is incumbent upon the Contractor to be creative in the development of the menu profile in the facility and utilize all the service points within the serving area keeping in mind the latest market trends.

C. Menu Calorie Labeling Rules The U.S. Food and Drug Administration established two rules requiring that calorie information be listed on menus and menu boards in retail food establishments to provide consumers with more nutritional information about the foods they eat outside of the home. The rules are required by the 2010 Patient Protection and Affordable Care Act.

RFP for Dining Services Page 13

1. Food establishments are required to display calorie information clearly and conspicuously for standard items on menus and menu boards, next to the name or price of the item.

Seasonal menu items offered for sale as temporary menu items, daily specials, and condiments for general use typically available on a counter or table are exempt from the labeling requirements.

2. The menu labeling rule also requires covered establishments to provide, upon consumer request and as noted on menus and menu boards, written nutrition information about total calories, total fat, calories from fat, saturated fat, trans fat, cholesterol, sodium, total carbohydrates, fiber, sugars, and protein.

3. To help consumers understand the significance of the calorie information in the context of a total daily diet, under the rule, menus and menu boards will include the statement: “2,000 calories a day is used for general nutrition advice, but calorie needs vary.”

4. To obtain additional information the full rules are available in the Federal Register:

https://www.federalregister.gov/articles/2014/12/01/2014-27833/food-labeling-nutrition-labeling-of-standard-menu-items-in-restaurants-and-similar-retail-food

D. Food Service Guidelines for Federal Facilities: – See Attachment 7

The U.S. Department of Health and Human Services (HHS) and the U.S. General Services Administration (GSA) collaboratively released the first food service guidelines for Federal facilities in March 2011 to assist employees in making healthier food and beverage choices and to create an efficient and environmentally beneficial food service system. Those guidelines, ‘Health and Sustainability Guidelines for Federal Concessions and Vending Operation’ (referred to here as the 2011 HHS/GSA Guidelines) have been updated and renamed ‘Food Service Guidelines for Federal Facilities’. Any future modifications of the existing guidelines as issued by HHS shall apply in its entirety.

E. Procedures for Future Price Adjustments/Changes Future price adjustments/changes must be submitted with supporting documentation for approval in a spreadsheet format that includes:

1. Any changes to standard menu prices, portions, or items offered for sale shall be submitted to the Contracting Officer’s Representative 30 days in advance. Daily or weekly promotional menu items are excluded.

2. Date of proposed price adjustment.

3. A market basket survey of at least 3 similar non-commercial food facilities in the local area (COR accepted locations).

4. In situations where one or more critical food or supply items have sudden upward price fluctuations due to an “Act-of-God” or other situation considered by the Contractor to be out of its control, the COR/CO are to be contacted with a request for a temporary surcharge or https://www.federalregister.gov/articles/2014/12/01/2014-27833/food-labeling-nutrition-labeling-of-standard-menu-items-in-restaurants-and-similar-retail-food https://www.federalregister.gov/articles/2014/12/01/2014-27833/food-labeling-nutrition-labeling-of-standard-menu-items-in-restaurants-and-similar-retail-food

RFP for Dining Services Page 14 menu change. Once the subject item cost has stabilized, the former approved price is to be reestablished or the item returned the menu as specified.

If the price change/adjustment is accepted by the COR/CO, a notice to the customers is then created by the Contractor and posted in prominent locations at least 14 working days prior to the on-site implementation. Every effort will be made by the COR to reach consensus on the final price adjustment within 45 days.

It should be noted that the GSA’s expectation for pricing menu items be less than regional pricing of similar commercial facilities by a minimum of 10% due to the Government providing a fully furnished facility and not charging rent or utilities.

F. Equipment and Utensils Furnished by the Contractor

1. All required Contractor equipment and utensils (sample list below) shall be provided by the Contractor who shall replace such equipment and utensils when necessary. Equipment and utensils provided by the Contractor shall be of a quality in keeping with that provided by the Government.

The Contractor may also sell items for lower cost/discount refills (such as coffee mugs and charging less per XX oz) and shopping bags instead of plastic carry out bags.

4. The Contractor shall provide complete Point of Sale (POS) system to include the acceptance of patron’s use of credit and debit cards in an expeditious manner at cafeteria. A pre-paid debit card system and a self-checkout system are highly encouraged. Pre-ordering and paying for selected menu items via web or e-mail is encouraged to speed customer processing.

G. Sanitation and Quality

1. The Contractor shall serve quality food under clean and sanitary conditions in accordance with the provisions and recommendations contained in the most recently published Food Code, U.S. Public Health Service publication. Products containing high fructose corn syrup, modified corn starch, and other similar additives, as well as products including preservatives, are highly discouraged from wholesale ingredients to be incorporated in menu items that will be prepared onsite.

Products purchased must meet the sodium level recommended in the 2010 and all subsequent revisions of U.S. Dietary Guidelines for Americans. If such products are not available in the marketplace, alternative products should be used and may include fresh prepared products.

Freshly prepared menu items (soups, entrees, side dishes, salads etc.) are highly desirable.
