INSTRUCTIONS/ NOTES TO OFFERORS

1. Submit quotes by email to Jeanine.J.Goral@usda.gov by the time specified in the solicitation.

2. This Request for Quote for commercial items is being conducted in accordance with FAR Subpart 12.6, “Streamlined Procedures for Evaluation and Solicitation for Commercial Items,” as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. This solicitation will result in the award of a Firm-Fixed Price Commercial Supply Purchase Order.

This solicitation is being issued as a Small Business set-aside. The associated NAICS code for this effort is 326199- All Other Plastics Product Manufacturing and Small Business size standard is 750 employees.

A COMPLETE QUOTATION PACKAGE MUST CONTAIN THE FOLLOWING ITEMS:

☐Signed Standard Form (SF) 1449 Schedule with blocks 17a, 30a, b and c completed Reference the solicitation number and include company name, address, DUNS number and point of contact information.

4. Quotes will be evaluated in accordance with Simplified Acquisition Procedures (FAR Part 13). The Government will award a contract resulting from this solicitation to the responsible firm whose quote conforming to the solicitation represents the lowest priced of the quotations having the highest past performance rating when compared to any lower priced quotation.

Upon counsel of USDA Acquisition, USDA MRPBS Contracting Personnel been advised that "Any other terms, including those on a purchase order, in a vendor registration application, or part of an RFP, are considered void and shall have no force or effect.”

USDA MRPBS Contracting Personnel are not permitted to sign your Quote/Proposal as it may have terms and conditions which cannot be approved and therefore would make the acquisition invalid.

Specifications

1.0 Project Background

The United States Department of Agriculture (USDA), Animal Plant Health Inspection Service (APHIS), Wildlife Services (WS) Guam State Office intends to procure 250 section panels of 10ft by 100ft nylon netting to create enclosures for ungulate trapping, exclusion, and eradication.

1.1 Scope of Work

The work to be performed under this contract consists of furnishing all materials, equipment, supplies, labor and transportation as required by the Pricing Schedule of the contract, and in accordance with these specifications. All work materials and services not expressly called for in this performance work statement but are necessary for completion of the contract requirements shall be performed and furnished by the Contractor at no additional cost to the Government.

1.2 Product Specifications

APHIS is requesting a Brand Name or equal Nylon Netting in accordance with the specifications outlined below. Equal products must have the following salient characteristics:

Rope bordered with four 2 in. rings.

Each panel will be 10 ft in height and 100 ft in length Dyed black Nylon netting bonded for protective weather treatment.

#36 netting is .085 in diameter and has 320 lb. test twine.

Mesh holes will be no larger than 2 inches

1.3 Delivery

Purchase price will include all shipping costs, FOB destination, to the delivery address specified below.

Inspection and acceptance will occur at delivery location with each order in accordance with FAR Clause 52.212-4(a)

1.4 Receipt and Acceptance of Purchase

Shipment will be FOB Destination and inspection and acceptance is in accordance with FAR Clause 52.212-4(a), and performance requirements.

Receipt of services shall be indicated by signature and date on the appropriate form by the authorized Government representative.

1.5 Contract Administration

The COR is responsible for monitoring the performance of work under this Purchase Order and is the local Government contact. In no event, however, will any understanding, agreement, modification or other matter deviating from the terms of the BPA be effective or binding upon the Government unless a modification to the Purchase Order is issued by the Contracting Officer prior to performing the work.

The COR shall inform the contracting Officer as soon as possible of any understandings, tentative agreements, recommended modifications, and actions or inactions of the Contractor or the Government which could affect the Contractor’s ability to comply with the contract performance requirements or completion times.

Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the Purchase Order, the Contractor shall advise the COR and the Contracting Officer. If the COR persists and there still exists a disagreement as to proper contractual coverage, the Contracting Officer shall be notified immediately.

PROCEEDING WITH WORK WITHOUT PROPER CONTRACTUAL COVERAGE AND APPROVAL OF THE CO

COULD RESULT IN A BREACH OF CONTRACT AND NONPAYMENT.

The designation (delegation of authority) is provided in writing to the COR and is available to the Contractor. The delegation of authority clearly explains the CORs roles and responsibilities on the contract and limitations of authority.

The COR does not have the authority to modify the terms and conditions of the contract.

The Contracting Officer is the only individual who can legally obligate the Government to the expenditure of public funds. No person other than the Contracting Officer can make any changes to the terms, conditions, general provisions, or other stipulations of this Purchase Order. Any other commitment, either explicit or implied, is invalid. The CO is the only person with authority to act as agent of the Government under this Purchase Order. Only the Contracting Officer has authority to: (1) direct or negotiate any changes in the statement of work; (2) modify or extend the period of performance; (3) change the delivery schedule; (4) authorize reimbursement to the Contractor for any costs incurred during the performance of this Purchase Order; (5) obligate or deobligate funds on Purchase Order orders; or (6) otherwise change any terms and conditions of this Purchase Order. No information, other than that which may be contained in an authorized modification to this Purchase Order duly issued by the Contracting Officer, which may be received from any person employed by the United States Government, or otherwise, shall be considered grounds for deviation from any stipulation of this contract.

1.6 Invoicing

Please show the order number on all invoices.

Payment is 30 days after receipt of a proper invoice, in accordance with the Prompt Payment Act (31 U.S.C. 3903).

Under FAR 52.232-40 Providing Accelerated Payments to Small Business Subcontractors;

Agencies shall make their payments to small business contractors as soon as practicable, with the goal of making payments within 15 days.

Invoices will be handled in accordance with the Prompt Payment Act (31 U.S.C. 3903) and Office of Management and Budget (OMB) Circular A-125, Prompt Payment. Contractors are encouraged to assign an identification number to each invoice. The invoice will be verified by the customer and processed.

The Contractor shall submit an invoice into IPP at (https://www.ipp.gov).

An invoice shall include the following:

(1) Name and address of the Contractor

(2) Invoice date; Invoice number;

(3) Delivery Order number;

(4) Description, quantity, unit of measure, unit price and extended price of the items delivered;

Contractors are encouraged to assign an identification number to each invoice.

The Government reserves the right to reject an invoice that does not include the information above.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

4.0 Evaluation

4.1 Evaluation Factors

The Government will award a Purchase Order in accordance with FAR part 13.106-1 (2) and FAR 13.106-2(b)(3), resulting from this solicitation to the responsible Contractor(s) whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Award will be made to the quote determined to be the best value which will include an evaluation of contractor quotes considering the following: Product Offered, Price, and Delivery are the factors to be considered.

In accordance with FAR Provision: 52.211-6 Brand Name or Equal (c) & (d).

The Contracting Officer will evaluate “equal” products based on information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer.

Unless the offeror clearly indicates in its offer that the product being offered is an “equal” product, the offeror shall provide the brand name product referenced in the solicitation.

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

(a) Definitions. As used in this provision—

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. 52.211-6 Brand Name or Equal (Aug 1999)

(a) If an item in this solicitation is identified as “brand name or equal,” the purchase description reflects the characteristics and level of quality that will satisfy the Government’s needs. The salient physical, functional, or performance characteristics that “equal” products must meet are specified in the solicitation.

(b) To be considered for award, offers of “equal” products, including “equal” products of the brand name manufacturer, must—

(1) Meet the salient physical, functional, or performance characteristic specified in this solicitation located in the Statement of Work, found on pages 5 & 6 in Section 3.2 Scope/Requirements.

(2) Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and

(3) Clearly describe any modification the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modification.

(c) The Contracting Officer will evaluate “equal” products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer.

52.212-3 Offeror Representations and Certifications-Commercial Items. (Feb 2021)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v)) of this provision.

(a) Definitions. As used in this provision—

127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

Forced or indentured child labor means all work or service—

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

Immediate owner means an entity, other than the offeror, that has direct control of the offeror.

Indicators of control include, but are not limited to, one or more of the following: ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
