JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (JOFOC)

Sherwin-Williams and ProClean Products under the

Regional Facility Cyclical Maintenance Single Award IDIQ Contract

Identification Number: NWWR4000-21-00075

1. Identification of the agency and contracting activity (FAR 6.303-2(b)(1)).

The NOAA Acquisition and Grants Office (AGO) Western Acquisition Division located in Seattle, proposes to enter into a contract on the basis of other than full and open competition in support of the National Weather Service Central Region (NWSCR).

2. The nature and/or description of the action being approved (FAR 6.303-2(b)(2)).

This is a sole source, brand name justification for using Sherwin-Williams 950A Siliconized Acrylic Latex Caulk (white) (Sales Number 151-8323/Product Number WL0950A), Sherwin-Williams SherMax Urethanized Elastomeric Sealant (white) (Sales Number 133-5223/Product Number WL001360A), Sherwin-Williams Pro Industrial DTM Acrylic Primer/Finish (Sales Number 6509-30605/Product Number B66W00011-16), Sherwin-Williams Pro Industrial DTM Acrylic Gloss (Sales Number 6505-15398/Product Number B66W01251-16), and ProClean Power Cleaner Concentrate (UPC 611864545196) for the dome coating of upper air inflation buildings (UAIB) as part of the cyclical maintenance activities under the Indefinite Delivery Indefinite Quantity (IDIQ) type contract for the NWSCR Field Offices.

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value)

(FAR 6.303-2(b)(3)).

This requirement is to provide the use of Sherwin-Williams and ProClean products for 38 Weather Forecast Offices (WFOs) in the 14-state Central Region at a total cost of approximately $70,000 for the anticipated period of performance of 10 September 2021 to 9 September 2026. The total value of the IDIQ is $2,000,000.00. This will allow the NWSCR to accomplish its mission to “Provide weather, water, and climate data, forecasts and warnings for the protection of life and property and enhancement of the national economy.”

4. An identification of the statutory authority permitting other than full and open competition (FAR 6.303-2(b)(4)).

The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5. A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority (FAR 6.303-2(b)(5)).

The contracting officer has determined the following circumstances justify the use of Sherwin-Williams’s and ProClean products as supported below:

Brand Name/Compatibility to existing systems or equipment–The Sherwin-Williams and ProClean products specified have been used successfully for the dome coating of UAIBs. The UAIBs release radiosondes attached to weather balloons that are tracked by a radio direction-finding device to receive data from the radiosonde. The transmission coefficient on the coatings affect the flux through the dome and therefore the ability to track the radiosondes for data collection. The weather balloon and radiosonde can ascend to over 115,000 feet and drift more than 180 miles from the release point. Therefore, even a small shift in the ability to track the radiosonde through the UAIB's coating could result in loss of critical weather data. Testing alternative coatings for the UAIBs would be cost and time prohibitive relative to the cost of using the known working Sherwin-Williams and ProClean products.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by FAR 5.2 and, if not, which exception under FAR 5.202 applies (FAR 6.303-2(b)(6)).

The IDIQ itself will be synopsized and solicited as required, but a notice for the Sherwin-Williams and ProClean products specifically is not required because per 5.202(a)(11), “The proposed contract action is made under the terms of an existing contract that was previously synopsized in sufficient detail to comply with the requirements of 5.207 with respect to the current proposed contract action.”

The described Sherwin-Williams and ProClean products are brand name commercial items authorized for resale in the commercial market place.

7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable (FAR 6.303-2(b)(7)).

The contracting officer will make a determination of price reasonableness at the IDIQ level based on a comparison of proposed pricing to prices paid under previous contracts, the IGE, and/or adequate competition. The pricing related to tasks for which the Sherwin-Williams and ProClean products are required is “UAIB Dome Coating – UAIB Dome Costing per Dome (EA) (Removal and Replacement of caulk joints included” per the IDIQ price schedule and Statement of Work.

8. A description of the market research conducted (see FAR Part 10) and the results or a statement of the reason market research was not conducted (FAR 6.303-2(b)(8)).

Market research was conducted by NWSCR and WAD-Seattle to identify available sources and to evaluate the availability of the marketplace to meet the requirement as follows:

Based on the results of market research, the government determined that many vendors are available to provide the specific Sherwin-Williams and ProClean products required and that the IDIQ contractor would therefore be able to provide them at a fair and reasonable price.

9. Any other facts supporting the use of other than full and open competition (FAR 6.303-2(b)(9)).

All supporting facts have been documented herein. There are no additional facts to be reported in this section.

10. A listing of any sources that expressed a written interest in the acquisition (FAR 6.303-2(b)(10)).

Impact Painting and Shekar Engineering.

11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated (FAR 6.303-2(b)(11)).

Competition will be sought among small businesses on beta.SAM.gov during the solicitation period. Sherwin- Williams’s and ProClean products are available in the competitive market place as a commercial item authorized for resale.
