PART 1

1.0 General Information:

1.1 This is a supplies contract to provide: Medical Gas Tanks to outlying clinics.

1.2 Description of supplies/introduction: The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform delivery of medical gases tanks as defined in this Performance Work Statement (PWS) except for those items specified as government furnished property and services. The contractor shall perform to the standards in this PWS.

1.3 Background: The Contractor shall supply medical gases in tanks to the outlying clinics as needed and in the quantities listed in section 1.5.

1.4 Objectives: The Contractor shall supply medical gases tanks to Navy Medicine and Readiness Training Command Portsmouth, Portsmouth, VA or Military Treatment Facility (hereafter referred to as “NMRTC Portsmouth” and/or “MTF”) located at 620 John Paul Jones Circle, Portsmouth, VA 23708 outlying clinics as described in scope at section 1.5.

1.5 Scope: Medical Gases Tanks Supplies include medical gases tanks, also referred as cylinders for NMRTC Portsmouth outing clinics to include the following clinics and amounts and sizes:

1.6 Period of Performance (PoP): Base year of 1 Apr 2024 to 31 Mar 2025 and 4 option years.

1.7 Administrative specifications:

1.7.1 Place of performance: The work shall be performed at NMRTC Portsmouth outlying clinics. The contractor shall coordinate the delivery of medical gases tanks to the clinics listed in section 1.5.

1.7.2 Recognized Federal holidays: Not Required to perform on federal holidays.

1.7.3 Hours of operation: The contractor is responsible for conducting business Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. The contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons.

1.7.4 Emergency Services: On occasion, services may be required to support an activation or exercise of contingency plans outside the normal duty hours.

1.8 Equipment and Supplies:

The Contractor shall furnish all medical gases in tanks that meet medical standards and in proper working order to meet the original equipment manufacturers (OEM) specifications.

1.9 Other Direct Costs (ODC):

1.9.1The Contractor shall be responsible for maintaining and replacing tanks as needed in a proper working order.

1.9.2 Each contract employee is responsible for complying with all applicable licensure and certification regulations.

1.9.3 Contractor Furnished Items:

Insurance: This is a supplies Contract to be delivered at various locations indicated in this PWS; the Contractor is required to have their own insurance.

2.0 Insurance:

2.1 Automobile Liability Insurance:

Before commencing work under this Contract, the Contractor shall certify to the Contracting Officer in writing that the required automobile insurance has been obtained. The following insurance as referenced in Federal Acquisition Regulations FAR Clause 52.228-10, is the minimum insurance required:

Automobile liability insurance written on the comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing this Contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage. The amount of liability coverage on other policies shall be commensurate with any legal requirements of the locality and sufficient to meet normal and customary claims.

2.2 Workers Compensation and Employers Liability:

The Contractor shall comply with applicable Federal and State workers' compensation, and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with the Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 shall be required, except in states with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers.

3.0 Background Investigation Crime Control Act 1990 Requirement:

The Government will conduct criminal background investigations for all potential contract employees who will be accessing the Branch Health Clinics and their Military bases.

4.0. Restriction on the use of Government- Affiliated Personnel:

Except in very limited cases, the federal criminal statutes at 18 U.S.C. 203 and 18 U.S.C. 205 bar government personnel, both active duty and civil service, from working as a contract employee in a government workplace, including a medical treatment facility, either as a second job ("moonlighting") or while on terminal leave. The Contractor agrees that, before making an employment offer to an active-duty member or a civil servant, it shall inform the individual of the potential applicability of these statutes and further agrees to encourage that individual to seek an advisory opinion from his/her local ethics counsel before accepting an employment offer.

5.0 Standards:

If a problem, defect, or damage is reported to the contractor regarding the medical gases or gas cylinders by any of the treatment facilities, the Contractor will immediately report the incident to the Government Point of Contact (POC) for action.

6.0 Quality:

6.1 Quality Control (QC): The contractor shall develop and maintain an effective QC program to ensure work is performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure nonrecurrence of defective services. The contractor’s QC program is the means by which the work complies with stated requirements.

Contractor shall provide quality, timely, transport and delivery of medical gases tanks as described in section 1.5.

7.0 Contractor Personnel

7.1 Base Access Commercial Deliveries:

The Commander, Navy Installations Command (CNIC), has established the Navy Commercial Access Control System (NCACS), a standardized process for granting unescorted access privileges to vendors, contractors, suppliers’ providers not otherwise entitled to the issuance of a Common Access Card (CAC) who seek access to and can provide justification to enter Navy installations and facilities. Vendors visiting Naval Medical Center Portsmouth (NMCP) may obtain daily passes directly from Naval Station Norfolk (NSN) Pass and ID office, located at NSN (Bldg. CD-9), 9040 Hampton Blvd, Norfolk, Virginia, 23505, by submitting identification credentials for verification and undergoing a criminal screening/ background check.

7.1.1 The contractor shall return all (if any) retainable ID cards, access passes, etc. to the POC upon the separation from this contract.

7.2 Contractor onboarding and training: The contractor shall complete all requirements, training, and forms as prescribed in the following requirements:

7.2.1 The DHA’s “Onboarding Checklist for Contractor Employees” is located at the DHA Onboarding and Offboarding Portal at https://info.health.mil/cos/admin/hr/IO/SitePages/Home.aspx

7.2.2 The DHA’s contractor training instructions embedded at Part 7 Section 7.2.1.

(Government (DHA) requirements development staff must cut/paste onboarding checklist at https://info.health.mil/sites/DOP/OnboardingCtr/Contractor_OnBoarding_Checklist.pdf and embed most up-to-date form in Part 7, Section 7.2.1.)

8.0 Physical Security:

The contractor shall be responsible for safeguarding all government equipment, information and property provided for contractor use. At the close of each work period, government facilities, equipment, and materials shall be secured.

9.0 Key personnel (Contractor):

The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the KO (Contracting Officer). The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The contract manager or alternate shall be available 5 days a week, from 0800-1600 and requests for service shall be made Monday through Friday.

Qualifications for all key personnel are listed below: The Contractor shall provide personnel having certain minimum levels of training and experience. This section is in no way intended to dictate a staffing plan to the Contractor for the performance of the services described herein. The services require that contract employees possess the following minimum qualifications to meet contract requirements:

Contract employees shall maintain all necessary certification, licenses, and other permits required to perform their duties under this Contract. The Contractor shall ensure, prior to employment that all contract employees are at least eighteen (18) years and have at least a high school education or equivalent.

10.0 Reporting:

The Contractor shall recognize the importance of a successful start-up of contract work and the timely recruitment of qualified personnel to meet all contract requirements. The Contractor shall assign a lead manager to interface with the POC within fourteen (14) days after contract award.

10.1 Government’s POC: The POC monitors all technical aspects of the contract and assists in contract administration. The POC is authorized to perform the following functions: assure that the contractor performs the technical requirements of the contract; perform inspections necessary in connection with contract performance; maintain written and oral communications with the contractor concerning technical aspects of the contract; issue written interpretations of technical requirements, including Government drawings, designs, specifications; monitor contractor's performance and notifies both the KO and contractor of any deficiencies;

coordinate availability of government furnished property; and provide site entry of contractor personnel. The POC is not authorized to change any of the terms and conditions of the resulting contract.

10.2 Post award conference/periodic progress meetings: The contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with FAR Subpart 42.5. The KO, POC, and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance.

At these meetings the KO will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.

11.0 Contractor Identification:

11.1 Contractor personnel performing services, tasks or deliveries in a contractor capacity in a government facility are required to possess and wear an identification badge that displays his or her name and the name of their company. All contractor personnel shall identify themselves as contractor support personnel in all forms of communication with all entities with whom DHA/Deputy Assistant Director for Acquisition (DAD-A)/Head of the Contracting Activity (HCA) has business dealings. The contractor shall: Answer all telephone calls and have a personalized voice message with an introductory statement that includes the fact that the person is contractor support personnel. Ensure all those with whom the person interacts in any face-to-face dealings while supporting the DAD-A understands that the person is contractor support personnel. Include a title block in all emails that states the fact that the person is contractor support personnel. Ensure all those with whom the person interacts in any face-to-face dealings while supporting DHA/DAD-A/HCA understands that the person is contractor support personnel.

11.2 Contractor personnel will be required to attend meetings or otherwise communicate with Government and/or other contract representatives to meet the requirements of this order.

Contractor personnel shall make their contractor status known during introductions.

11.3 Contractor personnel, while performing in a contractor capacity, are prohibited from using their retired or reserve component military rank or title in any written or verbal communications associated with the contracts in which they provide services.

12.0 Personnel Security

12.1 The contractor shall comply with DoD 8570.01-M, “Information Assurance Workforce Improvement Program, CH4” November 10, 2015 as amended (if applicable); 8500.01, “Cybersecurity”, dated March 14, 2014 (if applicable); DoD Manual (DoDM) 6025.18, “Implementation of the Health Insurance Portability and Accountability Act (HIPAA) Privacy Rule Compliance in DoD Health Care Programs” dated March 3, 2019, Department of Defense Instruction (DoDI) 6025.18 “HIPAA Privacy Rule Compliance in DoD Health Care Programs”, dated March 13, 2019; and DoDM 5200.02 “Procedures for the DoD Personnel Security Program (PSP),” incorporation change 3, effective September 24, 2020. Contractor responsibilities for ensuring personnel security include, but are not limited to, meeting the following requirements:

12.1.1 Follow the DHA Personnel Security Office guidelines for submittal of security clearances. Contact the DHA Personnel Security Office for guidance on the appropriate background investigation required for personnel on the contract. The DHA Personnel Security Office can be reached at (703) 275-6038.

12.1.2 Initiate, maintain, and document personnel security investigations appropriate to the individual’s responsibilities and required access to Controlled Unclassified Information

(CUI).

12.1.3 DHA Personnel Security Office does not deny any access to any automated information system (AIS), network, or Controlled Unclassified Information (CUI). If a contractor receives an unfavorable background investigation, the request for access will be sent back to the FSO (Field Security Officer) for further action. Any unfavorable adjudication will result in DHA Personnel Security Office not signing off on any access request.

PART 2

1.0 Definitions:

CONTRACTING OFFICER (KO): The Government employees with the authority to enter into, administer, and/or terminate contracts and make related determinations and findings. The term includes certain authorized representatives of the Contracting Officer acting within the limits of their authority as delegated by the Contracting Officer.

CONTRACTING OFFICER'S REPRESENTATIVE (COR): The Government employee responsible for assuring Contractor performance through audit, documentation, and liaison with the Contracting Officer. The COR is appointed in writing by the Contracting Officer. The COR has no authority to resolve disputes or obligate funds.

CONTRACTOR: That entity or its representative responsible for the delivery of the services or materials specified in this contract, as designated by award.

DOCUMENT: (verb) To completely, accurately and legibly record information, including on prescribed forms or via a computer terminal, as appropriate.

EMPLOYEE. For the purpose of this contract, an individual either employed or contracted to provide services.

JOINT COMMISSION ON ACCREDITATION OF HEALTHCARE ORGANIZATIONS

(JOINT COMMISSION). A national organization dedicated to improving the care, safety, and treatment of patients in healthcare facilities, publishers of the Joint Commission Accreditation Manual for Hospitals.

MILITARY TREATMENT FACILITY (MTF). Unless otherwise specified, "the MTF" refers to the NMRTC Portsmouth, Portsmouth, Virginia.

PERFORMANCE IMPROVEMENT (PI) (formerly quality assurance). Ongoing activities designed to objectively and systematically evaluate the performance of patient care and services, identify, and pursue opportunities to improve patient care and services and resolve identified problems.

QUALITY CONTROL. Those actions taken by a Contractor to control the provision of services so that they meet the requirements of the Performance Work Statement.

1.0 Contractor Furnished Items and Services

__ The Contractor shall acquire, maintain and provide in good working order medical gas tanks that meet medical standards and in proper working order to meet the original equipment manufacturers (OEM) specifications.

1.2 General: The contractor shall furnish all supplies, equipment, facilities, and services required to perform work listed under Part 1 of this PWS.

PART 5

1.0 Specific Tasks

1.1 Task Headings: This is a supplies contract that supports the NMRTC Portsmouth mission to oversee and coordinate the delivery of economical and effective medical, dental and other health care products. The supplies specified in this work statement shall be performed in accordance with established principles and ethics of the medical profession. The quality of healthcare provided will meet or exceed the current recognized standards established by the Joint Commission on Accreditation of Healthcare Organizations (Joint Commission), the American Hospital Association (AHA), the National Registry of Emergency Medical Technicians (NREMT); Commonwealth of Virginia Office of EMS; Defense Health Agency (DHA), Bureau of Medicine and Surgery of the Department of the Navy (BUMED), the MTF, and those other professional associations which specify standards of performance for the medical profession. The Contractor shall comply with applicable provisions of law and the rules and regulations of any and all governmental authorities pertaining to licensure and regulation of healthcare personnel and medical treatment facilities, the regulations and standards of medical practice of NMRTC Portsmouth.

1.2 Special Qualifications: The Contractor shall provide personnel having certain minimum levels of training and experience to perform the tasks in this PWS while conforming to all federal, state and local laws. This section is in no way intended to dictate a staffing plan to the Contractor for the performance of the services described herein.

PREPARATION INSTRUCTIONS.

A. Offerors shall clearly demonstrate their ability to meet the requirements and deliverable schedule as outlined in the associated solicitation.

B. As set forth in FAR 52.212-1 (g), Contract award, the Government intends to evaluate quotations and award one contract without discussions with offerors. The offerors’ initial quotation should contain the offerors best terms from a price and technical standpoint.

The Government reserves the right to conduct discussions if the Contracting Officer later determines it necessary.

D. SUBMITTAL INSTRUCTIONS

1. SUBMIT ONE QUOTE VIA EMAIL. The quote shall be organized, concise, and tabbed. Each factor shall be described in a separate tabbed section. Those Offerors that meet the requirement described in this announcement and wish to be considered must submit one (1) electronic email with the RFQ response no later than 2:00PM EDT, 09 October 2023

3. Proposal Expenses and Pre-Contract Costs

a. The RFQ solicitation does not commit the Government to pay any costs incurred in the preparation and submission of a proposal or for any other costs incurred by any offeror submitting a proposal in response to this solicitation. Offerors are cautioned against submitting conditional RFQ.

b. The Government will not make assumptions concerning intent, capabilities, or experiences. Clear identification of proposal details shall be the sole responsibility of the offeror.

c. Failure to clearly address all submittal requirements, evaluation criteria and information requirements of the RFQ above may result in rejection of the submission.

III. ADDENDUM TO FAR 52.212-2, EVALUATION -- COMMERCIAL ITEMS -

EVALUATION CRITERIA AND BASIS FOR AWARD

A. The Government intends to evaluate quotations and issue a firm fixed price contract based on the initial quotations received, utilizing FAR 13.106

SOLICITING COMPETITION, EVALUATION OF QUOTATIONS OR

OFFERS, AWARD AND DOCUMENTATION. The Government will evaluate quotes utilizing the procedures found at FAR 13.106-2 EVALUATION OF QUOTATIONS OR OFFERS. The Government reserves the right to request revised quotations from, or negotiate final contract terms with, one or more, but not all, Offerors if later determined by the Contracting Officer to be necessary.

The Government may reject any or all quotations if such action is in the public interest and issue a contract to other than the Offeror with the lowest priced quotation.

B. Incomplete quotations may be considered non-responsive and removed from further consideration. Quotations shall be clearly and concisely written as well as being neat, indexed (cross-indexed as appropriate) and logically assembled. All pages of each part shall be appropriately numbered and identified with the name of the offeror, the date, and the solicitation number.

C. Basis For Award: The Government will consider price and technical nonprice factors to determine the quotation that is most advantageous and represents the Lowest Priced Technically Acceptable (LPTA) quote. The Government will not use the formal source selection procedures described in FAR part 15. The Government will evaluate quotations utilizing the procedures of 13.106-2 EVALUATION OF QUOTATIONS OR OFFERS. This will be a firm fixed price contract.

EVALUATION CRITERIA. Evaluation of Technical Capability will be based on the information provided in the quotation. Documentation submitted in the quotation shall be evaluated to determine that the proposed equipment meets or exceeds the Governments minimum required specifications. Failure to clearly and unambiguously demonstrate this will result in an “unacceptable” rating.

FACTOR 1: TECHNICAL APPROACH

FACTOR 2: PRICE

FACTOR 1 - TECHNICAL APPROACH (capabilities) is defined as the vendor’s proposed solution(s) to successfully fulfill the contract requirements.

1. SUBMITTAL REQUIREMENTS.

The vendor shall submit technical approach and capability documentation which may include a narrative, charts, graphs, tables, drawings, product / service literature, and demonstrated authority to provide the necessary items and perform the required services identified in the specification / statement of work. The documentation shall clearly describe, in sufficient detail, the vendor's authority, proposed items, resources and methods to successfully fulfill the requirements including specifications, performance capability requirements, delivery schedules, warranties and all service requirements per the Request for Quotations.

2. BASIS OF EVALUATION

The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government based on price and technical acceptability of supplies

FACTOR 2 - PRICE QUOTATION

1. SUBMITTAL REQUIREMENTS

Contractors shall submit a quotation which will be evaluated for price reasonableness. The offeror shall submit an electronic copy of the completed price quotation to the Contracting Officer. The offeror shall propose a separate firm-fixed-price, FOB Destination, for each CLIN and options. Price quotations shall remain valid for a period of 90 calendar days from the date quotations are due.

2. BASIS OF EVALUATION

The quoted price will be evaluated for reasonableness in relation to the solicitation requirements.

Prices must be entirely compatible with the technical portion of the quotation.

Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:

a) Comparison of proposed prices received in response to the RFQ.

b) Comparison of proposed prices with the IGCE.

c) Comparison of proposed prices with available historical information.

d) Comparison of market survey results

Inspection and acceptance is expected to take place randomly by the Government.
