2. EXTENT OF OBLIGATION.
The U.S. Government is obligated only to the extent of authorized Calls actually made under this BPA.
3. PURCHASE LIMITATION.
No individual Call under this BPA shall exceed $250,000.00. Pricing shall be in accordance with the approved Micronesia CR - Life Support Area Blanket Purchase Agreement (BPA) Price List established upon award of a BPA and approved by a warranted Contracting Officer.
4. INDIVIDUALS AUTHORIZED TO PURCHASE UNDER THIS BPA.
A warranted Contracting Officer from all Department of Defense Agencies within PACAF/INDOPACOM are authorized to place Calls against this Blanket Purchase Agreement (BPA).
5. DELIVERY TICKETS.
All work under this Agreement shall be accompanied by delivery tickets or sales slips that shall contain the following information:
(i) Name of Supplier.
(ii) BPA Number.
(iii) Date of Purchase (Call).
(iv) Purchase (Call) Number.
(v) Itemized List of Services Furnished.
(vi) Quantity, Unit Price, and extension of each item, less applicable discounts (unit prices and extensions need not be shown when incompatible with the use of automated systems, provided that the invoice is itemized to show this information).
6. INVOICES.
A summary invoice shall be submitted at least monthly or upon expiration of this BPA, whichever occurs first, for all services rendered during a billing period, identifying the delivery tickets covered therein, stating their total dollar value, and supported by receipt copies of the delivery tickets. Submit invoices in accordance with DFARS 252.232- 7006 or as otherwise specified in each Call.
7. PAYMENT.
The Government Purchase Card Electronic Funds Transfer or Wide Area Work Flow (WAWF) may be used as the method of payment for each authorized Call. It’s paramount that each contractor specify if they can accept GPC as a form of payment. The payment office listed in block 15 of this agreement may change depending on the payment method and funding for each Call. Each Call will specify form of payment and payment terms and conditions.
8. PRICE LIST.

Price Lists shall be furnished to the Contracting Office as requested by the Contracting Officer. Price List must include all items or services requested to be covered under the BPA. Beginning and expiration dates of the Price List must be included. If at any time during the period of performance there is a price change, or a new item added, a new Price List must be submitted. Upon approval from the Contracting Officer, the new submitted Price List shall replace the existing approved Price List and be valid for the remainder of the BPA period of performance. Allow up to fourteen (14) calendar days grace period between submission of the new Price List to allow for sufficient time to review and obtain approval.
9. EVALUATION AND AWARD OF CALLS/ORDERS UNDER MULTIPLE AWARD BLANKET
PURCHASE AGREEMENTS.
***(Section 9 Applies To After establishment Of BPA Only; See Addendum to FAR Clause 52.212-1 Instructions to Offerors, FAR 52.212-2 Evaluation, and Addendum to 52.212-2 Basis for Contract Award for information pertaining to this solicitation for proposal package preparation and how proposals will be evaluated for award of a Micronesia Commercial Requirements LSA BPA)***
(a) Only those contractors awarded a Blanket Purchase Agreement (BPA) for performing Micronesia Commercial Requirements – Life Support Area (LSA) for Guam, CNMI, and Palau will compete for subsequent Calls/Orders to be placed under those BPAs. These contractors are encouraged to submit proposals for each Call/Order request for proposal. Contractors shall notify the Contracting Officer within two business days after request of Call/Order proposal requests, if the contractor will not submit a proposal on a Call/Order. Failure by the contractor to participate responsibly and consistently in submission of proposals may result in the U.S. Government canceling the BPA with that contractor and exclusion of the contractor from further competition.
(b) A minimum of two proposals on Call/Order proposal requests will satisfy competition requirements and preclude the necessity of soliciting for a replacement contractor if for any reason one of the BPAs is cancelled or one of the contractors is excluded from participation in the process.
(c) Unless the Contracting Officer applies the exceptions below, subsequent calls/orders will be placed (as a result of competition) with the contractor who offers the best value to the U.S. Government in considering the criteria specified in the Call/Order Proposal Request. Call/Order proposal requests to be evaluated and awarded based on the lowest priced offeror may be placed by any warranted DoD Contracting Officer stated in paragraph 4. Call/Order proposal requests to be evaluated and awarded based on any other factors in addition to price, may only be issued and awarded by the Contracting Officer.
(1) The agency need for the supplies and services are so urgent that providing fair opportunity would result in unacceptable delays;
(2) Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services being ordered are unique or highly specialized;
(3) The order must be issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to a Call/Order already issued under the BPA, provided that all awardees were given a fair opportunity to be considered for the original Call/Order.
(e) This clause does not guarantee the contractor issuance of any Call/Order above the micro-purchase threshold.
(End of Clause)
10. CALL/ORDER ISSUANCE PROCEDURES.
(a) Services under this Blanket Purchase Agreement (BPA) will be ordered by Calls/Orders issued on a Call/Order Form (BPA Call) to the contractor by a warranted Contracting Officer from the DoD.
(b) Each Call/Order as a result of this BPA will be assigned an individual Call/Order number.
(c) The U.S. Government will not be obligated to reimburse the contractor for work performed, items delivered, or any costs incurred, nor shall the contractor be obligated to perform, deliver, or otherwise incur costs except as authorized by duly executed Calls/Orders. The U.S. Government may request proposals with no assurance that a Call/Order will be issued.
(d) Calls/Orders will clearly identify the period of performance, define the specific work to be performed or the performance desired. Each Call/Order may contain additional, service specific, provisions. Any such additional provisions shall be a part of the specific performance of work description.
(e) Calls/Orders may be modified by the Contracting Officer. Modifications to Calls/Orders will be issued on the Call/Order Form (BPA Call) and cite the Call/Order Number.
(f) The contractor will have two (2) business days to take acceptance of any Call/Order issued to the contractor. If the contractor fails to take acceptance of the call/order, then the Government reserves the right to offer the Call/Order to the next eligible contractor for acceptance. This process will continue until an offeror has taken acceptance of the Call/Order.
11. CALL/ORDER PERFORMANCE SCHEDULE/Delivery Schedule.
The period of performance or delivery schedule for services to be provided shall be identified in each Call/Order.
12. SUBCONTRACTING RESPONSIBILITIES.
The contractor shall be responsible for the management and performance of all subcontractors. The contractor shall ensure Call/Orders are completed within the stated requirements.

14. CANCELLATION.
The U.S. Government reserves the right to cancel this Blanket Purchase Agreement (BPA) at any time and is bound only to the extent that the Contractor must be given 30 days written notification prior to exercising this right.

52.212-2 COMMERCIAL ITEMS (NOV 2021)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
PRICE
TECHNICAL
Award will be made to no more than five (5) of the lowest priced technically acceptable offerors.
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer will result in a binding contract once the supplier accepts the offer.
(End of provision)
Addendum to FAR Clause 52.212-2: BASIS FOR CONTRACT AWARD
This is a Lowest Price Technically Acceptable (LPTA) source selection. The U.S. Government will select the proposal with the lowest evaluated price from among those meeting the acceptability standards for non-price factors.
Contract will be awarded to a minimum of three (3) offerors and/or up to a maximum of five (5) offerors deemed responsible; offeror who’s proposal conforms to the solicitation’s requirements (to include all stated terms, conditions, representations, certifications, and all other information required by this solicitation); and offeror who has the lowest price technically acceptable proposal. By submission of its offer in accordance with the instructions provided in clause FAR 52.212-1, Instructions to Offerors, and Addendum to FAR 52.212-1 the offeror accedes to the terms of this RFQ and all such proposals shall be treated equally except for their prices and technical documentation. Offerors must clearly identify any exception to the RFQ terms and conditions and provide complete accompanying rationale. The evaluation process shall proceed as follows:
A. PRICE.
Initially, the total proposed price for each offeror will be calculated. The total proposed price will be calculated as follows:
1. Each offeror’s stated rates identified on the Blanket Purchase Agreement Price List will be used to calculate the total proposed price. (i.e. Price List Item Latrine Rental monthly rate of $4,000 will be multiplied by 60 to come to extended total of $240,000 for that item and then all subsequent items for items 7 through 13 be added to together to come to the total proposed price.) The total price is based on a 5-year coverage. The same total price can be identified by taking the yearly grand total multiplied by 5.
Once total proposed price has been calculated for all offers received the proposals will be ranked according to the total proposed price from lowest to highest. For the purpose of efficiency, offers will be logically grouped into increments, from lowest to highest according to total price and the price analysis will begin with the lowest priced group of offers. Once price analysis is completed then the technical evaluation of the lowest priced group of offers will be evaluated.
B. TECHNICAL.
The U.S. Government’s technical evaluation team shall evaluate the technical proposals on an Acceptable or Unacceptable basis, assigning one of the ratings described below for each subfactor. Any subfactor evaluated as “Unacceptable” will render the entire proposal unacceptable and, therefore, the offeror will be ineligible for award.
Only those proposals determined to be technically acceptable will be considered for award.
TABLE 1 – TECHNICAL RATINGS
Rating Description
ACCEPTABLE
Proposal clearly meets the minimum requirements of the solicitation.
UNACCEPTABLE
Proposal does not clearly meet the minimum requirements of the solicitation.
C. Evaluations will begin with the lowest priced group of offers. At the conclusion of the evaluations for this group, if the overall lowest priced offeror is judged to have an “Acceptable” technical rating, that offer represents the best value for the Government. The evaluation process will stop with that initial group of offers should a minimum of three (3) offerors and/or a maximum of five (5) offerors are judged to have an “Acceptable” technical rating. Award shall be made to a minimum of the three (3) lowest priced technically acceptable offerors without further consideration of any other proposals. It is at the Contracting Officer’s discretion should award be made up to five (5) of the lowest priced technically acceptable offerors.
D. In the event that the Government does not make an award and no offerors or there is not a minimum of three (3) offerors within that group that receive an “Acceptable” technical rating, then the next logical grouping of offerors will be evaluated. The process will continue (in order of price ranking) until a minimum of three (3) offerors are evaluated as having “Acceptable” technical ratings and are determined responsible, or all offers have been evaluated.
E. Offerors are cautioned to submit sufficient information and in the format specified in the RFP preparation instructions. Offerors may be asked to clarify certain aspects of their proposal. Communication conducted to resolve minor or clerical errors will not constitute discussions and the Contracting Officer reserves the right to award a contract without the opportunity for proposal revision.
F. The Government intends to award to a maximum of five (5) offerors without discussions with other respective offerors. The Government reserves the right to award without discussions. Based on the ratings of each proposal against all evaluation criteria, the Contracting Officer shall establish a competitive range comprised of all of the most highly rated proposals, unless the range is further reduced for purposes of efficiency pursuant to FAR 15.306(c)(2). After discussions, each offeror still within the competitive range will be afforded an opportunity to submit a Final Proposal Revision that will be used for evaluation, eligibility determination, and source selection decision.
