PERFORMANCE WORK STATEMENT
Overview:
Marine Air Ground Task Force Training Command (MAGTFTC)/ Marine Corps Air Ground Combat Center
(MCAGCC) located in Twentynine Palms, California has a requirement for fire extinguisher inspection, maintenance, and repair. MAGTFTC/MCAGCC intends to award a firm fixed price Indefinite Delivery Indefinite
Quantity contract to a single vendor for a base year and four optional option periods, that can be exercised unilaterally solely at the discretion of the Government.
Background:
MAGTFTC/MCAGCC requires that we comply with the requirements for fire extinguisher inspections and maintenance in accordance with California State Fire Marshal’s Office, National Fire Protection Associate (NFPA)
10: Standard for Portable Fire Extinguishers (current editions), and CCR title 19 Section 575.4 (a)(1).
Scope:
Inspections as well as fire extinguisher repair and maintenance will be ordered via a service call initiated by the
Contracting Officer’s Representative (COR). The contractor shall provide all tools, materials, equipment, transportation, personnel, supervision and all other items necessary to perform all operations in connection with the maintenance, recharging, hydrostatic testing, transportation, labeling and repairing the equipment. Services will be provided utilizing “Service Records” for maintenance activities on all fire extinguishers. Contractor will provide comprehensive reporting of the inspection results and verifications of compliance with NFPA 10 requirements for inspections and maintenance. All used and replaced parts shall be returned to the Government.
1. Maintenance returns a fire extinguisher to full operating capacity as prescribed by the manufacturer's specifications, NFPA Standards, and as described below.
1.1 Fire Extinguisher Recharge. Recharge is to be accomplished by the contractor in accordance with NFPA 10, other current NFPA standards and manufacturer’s specifications. The replacement of extinguisher agent also includes the agent expellant for certain types of extinguishers.
1.2 Labeling. The contractor shall replace fire extinguisher identification labels, classification symbols, product inspection stickers/plates/decals and/or other required information labeling if the originals are damaged or missing. Labeling shall be in accordance with the manufacturer’s specifications, NFPA 10 and other current NFPA standards.
2. Replacement/Repair Parts. The contractor shall furnish all parts and materials necessary to complete the requested service. The cost of parts and materials will be included in the award price at manufacturer’s published list price or contractor’s invoice cost, whichever is less, and when approved by the COR. The contractor is required to furnish COR an itemized list showing parts and material needed for any repair(s) after inspection of fire extinguishers and prior to starting any repairs. The contractor shall provide parts that are new, or reconditioned parts that are equal to, or exceed the original manufacturer’s parts. Parts replaced remain the property of the Government. Replaced parts shall be presented to the COR for validation prior to the submission of invoices.
3. Reports. The contractor shall submit a complete report of all maintenance and servicing accomplished when fire extinguishers are returned to the government. The reports shall be submitted to the COR at the time of extinguisher completion/delivery. The reports shall include a record of conditions found, repairs, recharges, all replacement parts used, and the serial number of the extinguisher(s) that was re-charged.
Report shall be provided within 3 business days of the start of the following month. All records, documents and associated papers provided by the contractor, or generated during the period of this contract, become government property and will be returned to the government upon contract termination or completion.
During the contract period, all records, documents and associated papers will be available for Government review at any time.
The maximum number of extinguishers to be serviced per service call will be between twenty-five (25) and two hundred (200). A single service call may require performance on multiple days and/or multiple locations aboard

If a fire extinguisher needs to be removed for service (i.e. a high pressure refill, etc.) The contractor shall inform the COR to approve or disapprove which units are being removed and taken to the contractors facility for recharge or repair. Units will be returned within 10 business days with written certification of operational condition.
The Government makes no representations or guarantees as to the condition of the fire extinguishers on the start date of the contract. No prior inspection or service reports or contract information will be made available. If during initial inspection extinguishers are found to be beyond economic repair, those extinguishers shall be identified to the COR immediately.
Performance Monitoring:
Contractor work will be evaluated by reviewing the comprehensive report “Servicing record for Fire Extinguisher” that details the services provided.
Permits and Responsibilities:

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the
Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation.
Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the
Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent
Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.
Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
(i) technical capability of the item offered to meet the Government requirement;
(ii) price;
(iii) past performance
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
52.212-2 ADDENDUM
52.212-2 EVALUATION--COMMERCIAL ITEMS--ADDENDUM
Basis for contract award - This acquisition is being conducted under FAR Parts 12 and 13. Offers will be evaluated using the factors identified in FAR 52.212-2, Evaluation – Commercial items. Noncompliance may be grounds to eliminate the proposal from consideration for contract award. Award will be made utilizing a Lowest Price
Technically Acceptable (LPTA) source selection method. By submission of its offer in accordance with the instructions provided in clause FAR 52.212-1, Instructions To Offerors, the offeror agrees to the terms of this solicitation.
First, the quotes will be ranked in order from lowest to highest based on the price. The lowest priced quotation will then be evaluated and receive a rating of Acceptable or Unacceptable based on the criteria below. In order to be rated as Acceptable, the Technical quote must meet the government's minimum requirements as described in the schedule. Quotes deemed Unacceptable are those that fail to meet the Government's minimum requirements.
If the lowest priced offeror’s Technical quote and technical approch are rated acceptable, the government will then evaluate pricing to determine fair and reasonableness per FAR 13.106-3.
If the lowest priced quotation is evaluated to have an acceptable technical quote, and fair and reasonable prices, per
FAR 13.106-3, the Government will complete a responsibility determination IAW the criteria specified in FAR
9.104-1. If found responsible, the Government may stop the evaluation process at this point as that quote represents the best value to the Government. Award shall be made to that offeror without further consideration of any other offers.
If the lowest priced quotation is assigned an unacceptable rating, or if the price is determined not fair and reasonable or if the Quoter is found to be non-responsible, the next lowest priced quote will be evaluated. This process will continue (in ascending order) until an offeror is evaluated to have an acceptable technical rating, fair and reasonable prices and the offeror is deemed responsible or until all offers have been evaluated.
The Government reserves the right to evaluate all quotes. The award will be made to the offeror whose proposal represents the best value to the government on a LPTA basis, factoring in price and non-price factors – Technical
Capability.
Factor 1: Technical
Each offeror’s technical proposal will be evaluated by their presented ability to execute the performance work statement and will be defined as Acceptable or Unacceptable as defined below:
Technical Acceptable/Unacceptable Ratings Rating Description Acceptable Proposal meets the minimum requirements of the solicitation.
Unacceptable Proposal does not meet the minimum requirements of the solicitation.
Factor 2: Price
In order to be considered for award, price must be determined fair and reasonable and balanced (or if unbalanced pricing exists that it does not pose an unacceptable risk to the government) using one or more techniques set forth in
FAR 13.106-3.
Options. IAW the provision at FAR 52.217-5, the government will evaluate offers for award purposes by adding the total price for all options including the option under FAR 52.217-8, to the total price for the basic requirement.
Evaluation of options will not obligate the government to exercise options. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.
Offerors are advised that the Option to Extend Services Clause at 52.217-8 is included in the solicitation and will be included in the awarded contract. When proposing prices for base and option years, Offerors should consider that
The Government may choose to exercise the option to extend services at the end of any period of performance (base or option periods), utilizing the rates in effect during the period of performance in which the option is exercised. For purposes of evaluation, The Government assumes that any price proposed for base and option periods reflects the possibility that a period of performance may be extended. For the purpose of evaluation the government will take the final option price, divide it by two and add it to determine the overall proposed/quoted price.
The Government reserves the right to award no contract at all depending on the quality of the quotes submitted and availability of funds for the requirement. The Government intends to evaluate proposals and award a single contract without requesting or accepting revised proposals. Therefore, the offerors will be advised that their initial offer should contain the most favorable terms and reflect its best possible performance potential. The Government does reserve the right to clarify aspects of the proposals and hold discussions.
