About this file

This is a Solicitation Checklist Summary document that outlines the procurement procedures for the City of Fort Myers, Florida, for competitive bidding processes including Invitations to Bid (ITB) and Requests for Proposals/Qualifications (RFP/RSQ). The document provides comprehensive guidance for managing grant-funded construction projects, such as the Legacy Island Phase II project. The solicitation process requires submission of bids through the OpenGov electronic portal by March 24, 2026, at 2:00 p.m., with a non-mandatory pre-submittal meeting scheduled for March 2, 2026, at 10:00 a.m. at City Hall. Contractor questions must be submitted by March 12, 2026, at 2:00 p.m. City Council approval is anticipated on April 6, 2026. The project scope encompasses construction of a five-slip timber mooring dock, an overwater observation pier, two 16' x 16' gazebos, and interpretive signage. Substantial completion is required within 180 calendar days after Notice to Proceed, with final completion within 210 calendar days. Liquidated damages range from $904 to $1,685 per day depending on contract value.

The procurement is subject to multiple federal and state funding sources including FDOT Local Agency Program, FEMA Public Assistance, Florida Fish and Wildlife Conservation Commission Boating Improvement Program, HUD Community Development Block Grant-Disaster Recovery, and Hazard Mitigation Grant Program provisions. The FWC provides cost reimbursement not to exceed $330,241.00 (83.24 percent of the estimated $396,756.00 project cost), with the City providing a minimum cost share of $66,515.00 (16.76 percent). A 15 percent Minority Business Enterprise participation goal applies to the project. Contractors must submit a bid bond equal to five percent of the total bid price and provide Performance and Payment Bonds each equal to 100 percent of the contract price within ten calendar days of award. Contractors must maintain comprehensive insurance coverage with minimum limits of $1,000,000, perform at least 40 percent of total contract work with their own organization, and comply with Davis-Bacon Act prevailing wage requirements, E-Verify employment verification, debarment certifications, and Iron and Steel product requirements under Florida Statutes Section 255.0993.
