About this file
The HMGP Supplemental Conditions document outlines federal and state compliance requirements applicable to the Hazard Mitigation Grant Program (HMGP) funded project for Legacy Island Phase II in Fort Myers, Florida. These conditions supplement the CDBG-DR requirements and establish mandatory federal provisions governing contractor performance and employment practices for this construction project involving the development of recreational facilities on the Caloosahatchee River.
The document establishes four primary compliance frameworks for project execution. First, contractors are encouraged to employ environmentally friendly construction practices, specifically the use of low-carbon materials with reduced embodied greenhouse-gas emissions as demonstrated through environmental product declarations. Second, all contractors must comply with 200 CFR Appendix II Federal Provisions, which contractors certify upon submission. Third, the Vietnam Era Veterans' Readjustment Assistance Act (VEVRAA) requirements apply to contracts valued at $150,000 or more, requiring non-discriminatory treatment and advancement of protected veterans including disabled veterans, recently separated veterans, active duty wartime or campaign badge veterans, and Armed Forces service medal veterans, with implementing regulations found at 41 CFR Part 60-300. Fourth, Section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act applies to the solicitation, requiring contractor certification of compliance upon submission. These conditions collectively ensure federal disaster relief funding compliance and protection of veteran employment rights throughout project execution.
