HMGP Supplemental Conditions Summary
This document presents supplemental conditions applicable to Hazard Mitigation Grant Program (HMGP) projects issued by the City of Fort Myers, Florida, in conjunction with CDBG-DR funding requirements. The supplemental conditions establish mandatory compliance frameworks for contractors performing work on the Legacy Island Phase II project, a recreational construction initiative involving a five-slip mooring dock, overwater observation pier, two gazebos, and interpretive signage. The procurement requires responses by March 24, 2026, at 2:00 p.m., with a non-mandatory pre-submittal meeting scheduled for March 2, 2026, at 10:00 a.m. City Council award approval is anticipated for April 6, 2026, with substantial completion required within 180 calendar days and final completion within 210 calendar days after Notice to Proceed.
The HMGP supplemental conditions impose four primary requirements on contractors: adherence to Buy Clean standards encouraging low-carbon materials and environmentally friendly construction practices; compliance with all Federal Provisions outlined in 200 CFR Appendix II; compliance with the Vietnam Era Veterans' Readjustment Assistance Act (VEVRAA) at 41 CFR Part 60-300 for contracts valued at $150,000 or more, requiring non-discrimination and affirmative employment of protected veterans; and compliance with Section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act. The project is subject to multiple federal and state funding sources, including FEMA Public Assistance, Florida Fish and Wildlife Conservation Commission funding, CDBG-DR, and HMGP provisions, with the FWC providing cost reimbursement of $330,241.00 (83.24 percent) and the City contributing a minimum of $66,515.00 (16.76 percent) of the estimated $396,756.00 total project cost.
