About this file
This document contains supplemental conditions for the Hazard Mitigation Grant Program (HMGP) applicable to the City of Fort Myers' Legacy Island Phase II park construction project in Florida. The project involves construction of Phase II improvements to Legacy Island Park located on an island in the Caloosahatchee River upstream of the Business 41 bridge. The scope of work includes a five-slip docking facility, an overwater observation pier, two 16' x 16' gazebos, and associated signage. The supplemental conditions outlined in this document apply in addition to existing CDBG-DR supplemental conditions and establish the regulatory framework governing contractor performance and eligibility.
The HMGP supplemental conditions require contractors to incorporate environmentally friendly construction practices and consider low-carbon materials with reduced embodied greenhouse-gas emissions compared to industry averages, as documented through environmental product declarations. All contractors must comply with 2 CFR Appendix II federal provisions and Section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act. Additionally, contractors with federal contracts or subcontracts valued at $150,000 or more must comply with the Vietnam Era Veterans' Readjustment Assistance Act (VEVRAA) under 41 CFR Part 60-300, which prohibits discrimination against protected veterans and requires affirmative steps to employ and advance qualified protected veterans. Exceptions to VEVRAA coverage apply to contracts valued below $150,000, work performed outside the U.S., and certain state and local government contracts.
