GENERAL INFORMATION

INTRODUCTION

The Oregon State Marine Board, as a steward of federal American Rescue Plan Act (ARPA) State Fiscal Recovery Fund funding, is soliciting bids for the removal of 15 derelict vessels and their associated contents, trash, and rubble located in the Willamette River in Portland, OR.

The State of Oregon, acting by and through the Oregon State Marine Board, (“Agency”), is issuing this Request for Proposal for the removal and disposal of the selected vessels described in the SCOPE OF SERVICES and ATTACHMENT B LOCATION AND VESSEL DESCRIPTIONS.

Agency anticipates the award of one Contract from this solicitation.

SCOPE OF SERVICES

Note: The date of project commencement shall fall on or between 10/03/22 and 10/14/22.

There are 14 vessels in question which are currently located in the Willamette River, primarily in the vicinity of Ross Island and Swan Island. Under the authority described in ORS 830.908-948, the Agency identified the vessels for seizure by reason of the vessels meeting the statutory definition of derelict. The vessels and their associated contents, trash, and rubble, whether present in the attached photographs or not, shall be considered one and the same at the time of removal and disposal.

A photograph of each vessel and associated location and notable details are provided (See ATTACHMENT B). It is not known how much, if any, oils, fuels, sewage or other pollutants may be on board.

The project involves removing each vessel from the water and then recycling and/or disposing of the vessels and waste materials at approved locations. The Offeror will provide photographs of each vessel in every phase of the contract to the AGENCY.

Work shall be completed in the manner specified in the Offeror’s approved Proposal.

Offeror will provide all labor, equipment, safety equipment, training and transportation necessary to complete the work specified. Any suspension of work for more than 48 hours must be approved in writing by AGENCY.

Vessels in the water shall be removed from the water in a manner that reduces or minimizes impacts to the environment and recreational and commercial boating. Offeror will contain and remove all debris and materials associated with the vessels. It is the Offeror’s responsibility to comply with all state, federal and local laws, rules, guidelines and policies for removal of vessels that may contain pollutants or hazardous materials that can impact the environment. Offeror may keep, salvage or sell any parts from the vessels; however, the value of any parts kept or the proceeds from any parts sold must be itemized and will be subtracted from the amount paid by AGENCY to the Offeror. The removal, demolition, and disposal are to be completed by October 31, 2022 unless extended by AGENCY in writing. Offeror will notify Agency of project completion. Agency or the contracted law enforcement agency in the county where the vessels are located may perform a site inspection within 10 calendar days of notification to complete a visual reconnaissance that the vessels have been properly demolished. Agency will use the visual inspection and documentation provided by Offeror to determine that the requirements of the Contract have been completed and that final payment can be made.

Offeror’s failure to deliver the deliverables in accordance with the requirements of the Contract is a material breach of the Contract.

OFFER CONTENT REQUIREMENTS

Offer must address each of the items listed in this section and all other requirements set forth in this solicitation. Offeror shall describe the Services to be performed. An Offer that merely offers to provide the goods or services as stated in this solicitation will be considered non-Responsive to this solicitation and will not be considered further.

Project Plan Offeror shall thoroughly address the following items:

1. How each vessel will be removed from the water, including method of salvage and flotation, tow route, haul-out method, haul-out location, and major equipment. It is the responsibility of the Offeror to coordinate with owner or manager of haul-out location or facility and, if it is publicly owned, provide proof of permission to the Agency.

1. Where watercraft dismantling will occur and how waste, fuel, oil, and any other hazardous waste will be handled;

1. The names and locations of all waste facilities to be used for the disposal of all waste products (including oils, fuels, hazardous waste);

1. The names of any companies which may perform work on behalf of the Offeror;

1. A proposed timeline (project commencement date shall fall on or between 10/03/22 and 10/14/22 and must be completed by 10/28/22) Costs The Agency anticipates that all 14 vessels will remain in place and be available for removal on the date of commencement. However, understanding the variability of the river environment, it is imperative that the Offeror provide a per-vessel price in addition to a total price for the entire project.

Offeror shall provide a breakdown of costs by:

For each vessel (identified by the number assigned in Attachment B: Vessel Descriptions):

· Mobilization or set-up costs with clear description

· Removal costs (sum of all activities related to floating, stabilizing, towing, and removing vessel from the water)

· Disposal costs (including demolition, materials testing/handling, tipping fees, etc. This includes the disposal of any and all associated contents, trash, and rubble within the boats at the time of removal) For all 14 vessels as a group:

· Total cost

If the scope of the Project or the Services described in the accepted Offer are changed materially due to variability of the river environment, Agency may, at its discretion, amend the resulting Contract to include and/or remove Services and adjust compensation accordingly. At Agency’s request, Offeror shall submit an updated quote and project plan for any additional services that may be required after Offer acceptance or execution of the resulting contract.

Compliance with Specifications, Requirements, and Terms and Conditions Offeror shall provide a statement accepting all Contract terms and Conditions that are specified in the RFP, including Attachments and Exhibits, as amended by any Addenda.

Public Record/Confidential or Proprietary Information All Offers are public record and are subject to public inspection after Agency issues the Notice of the Intent to Award. Offeror shall indicate in its Offer any portion that Offer believes contains any information that is a trade secret under ORS Chapter 192.345(2) or otherwise is exempt from disclosure under the Oregon Public Records Law (ORS 192.311 through 192.478), and submit a fully redacted version of its Offer.

Offeror is cautioned that cost information generally is not considered a trade secret under Oregon Public Records Law (ORS 192.311 through 192.478) and identifying the Offer, in whole, as exempt from disclosure is not acceptable. Agency advises each Offeror to consult with its own legal counsel regarding disclosure issues.

If Offeror fails to identify the portions of the Offer that Offeror claims are exempt from disclosure, Offeror has waived any future claim of non-disclosure of that information.
