Amendment 0002 to SeaPort-NxG Task Order Solicitation N6449826R3107

This document is Amendment 0002 (effective June 11, 2026) to a competitive Naval Surface Warfare Center Philadelphia Division (NSWCPD) task order solicitation for engineering and technical support services under the SeaPort-NxG indefinite delivery indefinite quantity (IDIQ) contract vehicle. The task order is restricted to SeaPort MAC holders only and is not a small business set-aside. The requirement supports NSWCPD Code 71 Land Based Engineering Sites (LBES) and Land Based Test Sites (LBTS) programs with an estimated 305,900 total labor hours across five years (base year plus four option years) if all options are exercised. The estimated award date is October 30, 2026, with performance commencing the same date.

The solicitation requires comprehensive engineering, technical, programmatic, logistical, and systems support across multiple disciplines including electrical power systems, propulsion motors, machinery shafting, HVAC systems, piping systems, and control networks. Key deliverables include engineering/technical reports, test procedures, vibration analysis per MIL-STD-167, configuration control documentation, Integrated Master Schedules using Oracle Primavera P6, risk management reporting, life cycle support documentation, training curricula, and financial/program management support. The base year labor requirement is 61,180 hours (with 2,100 government-site overtime hours and 1,000 contractor-site overtime hours); estimated Other Direct Costs (ODCs) are $83,556.68 for the base year. Proposals are valid for 180 calendar days and must demonstrate 40 percent small business participation. Key personnel include a Program/Project Manager II and Integrated Master Scheduler II. A Confidential security clearance and Facility Security Clearance are required; Cybersecurity Maturity Model Certification (CMMC) Level 2 Self-assessment is required for awards on or before November 9, 2026, with CMMC Level 2 C3PAO required for awards after that date. Amendment 0002 clarified conflicting information regarding small business participation (40 percent), proposal validity (180 days), fee table labor hours (61,180), ODC amounts ($83,556.68), education requirements for Analyst Operations III positions, Management and Support labor category qualifications, and installation analyst qualifications.

SUMMARY OF CHANGES

Section A - Solicitation/Contract Form

The following changes have been made:

Miscellaneous text in this section has been modified to:

This requirement is being solicited only to Seaport MAC Holders. Any proposals submitted from Non-Seaport MAC Holders will not be considered for award.

Specify any location requiremetns upfront, in the first two (2) sentences, to enable offerors to isolate opportunities fitting both their corporate experience and their physical location.

This is a competitive procurement. If the solicitation should result in a single offer the Government reserves the right to re-solicit this procurement in order to enhance competition.

Based on the results of the sources sought notice published on 14 April 2025 in Seaport, in concurrence the NSWCPD Deputy of Small Business this procurement is not a small business set-aside.

Q&A as of 10 June 2026:

1. In what volume and section should offerors present Attachment_03__List_of_Key_Personnel?

Answer: Attachment 03 should be provided in Volume I.

2. Page 112 of 117 - L-216-H001 (d) says the small business participation requirement is 40%. However, page 113 of 117 duplicates this Clause and states the small business participation requirement is 30%-40%. Would the Government please confirm the minimum small business requirement is 30%?

Answer: See Amendment 0002. The small business participation requirement is 40%. The duplicative clause has been deleted.

3. Page 112 of 117 - L-216-H001 (f) says proposals shall be valid for a period of 180 days. However, page 113 of 117 duplicates this Clause and states proposals shall be valid for 60 calendar days. Which one prevails?

Answer: See Amendment 0002. Proposals shall be valid for a period of 180 days. Conflicting information has been corrected and the duplicative clause has been deleted.

4. RFP Page 106 of 117, states: "(b)(1) Cybersecurity Maturity Model Certification (CMMC) level. The CMMC level required by this solicitation is:

____ [Contracting Officer insert: CMMC Level 1 (Self); CMMC Level 2 (Self); CMMC Level 2 (C3PAO); or CMMC Level 3 (DIBCAC)]. This CMMC level, or higher (see 32 CFR part 170), is required prior to award for each contractor information system that will process, store, or transmit Federal contract information (FCI) or controlled unclassified information (CUI) during performance of the contract." This fill-in has not been completed by the Contracting Officer. Would the Government please confirm that CMMC Level 2 (Self) is required at the time of award?

Answer: See Amendment 0002. CMMC requirements have been clarified. CMMC Level 2 (Self) is required for awards and options awarded on or before 09 November 2026; CMMC Level 2 (C3PAO) is required for awards and options awarded on or after 10 November 2026.

5. RFP page 99 of 117, Section L, 3.1.1, states: "Offeror shall describe its specific understanding, capability, experience, and technical approach with regards to the following requirements: Section C, Paragraphs 3.1 (specific) and how it relates to Land Based Test Sites." Can the Government please clarify what "3.1 (specific)" means/entails? Are offerors being asked to write to all of SOW 3.1 (including all 26 sub-tasks/sections)? If so, why does Section L call out "3.1.2.6" as the next SOW paragraph that offerors are to address in their technical response, as that would already be covered under 3.1.?

Answer: Section 3.1 specifically refers to the language contained in SOW paragraph 3.1; "The contractor shall provide engineering and technical support to ensure the LBES/LBTS Programs are able to maintain the overall schedule and meet testing requirements." Additionally, the Offeror should provide a response specific to SOW paragraph 3.1.2.6.

6. Page 100 of 117: RFP Section L, 3.2 instructs offerors to present past performance "that demonstrates experience relevant to the solicitation's PWS /SOW." Should offeror past performance address/cover the full PWS/SOW? Or should offeror past performance only address/cover the sampling of SOW tasks called out in L.3.1.1? In other words, will offeror past performance references be evaluated based on coverage of the full SOW, or just the sampling of SOW tasks called out in L.3.1.1?

Answer: Past Performance should demonstrate experience relevant to the full SOW. The tasks identified in L.3.1.1 are specific to Element A - Technical Approach.

N6449826R31070002

7. Attachment 04 - Staffing Plan: With regard to Column L, "% of Total Time Dedicated to the Contract," please confirm this value should be calculated based on the Base Year hours proposed (Column G)?

Answer: Column L shall indicate the percentage of each employee's overall time dedicated to the Contract. For some requirements, certain Contractor personnel may split time across multiple unrelated contracts.

8. Attachment 04 - Staffing Plan: How should offerors factor OT hours into the formula for Column L, "% of Total Time Dedicated to the Contract"?

Will percentages of greater than 100% be acceptable for labor categories that include OT?

Answer: The column should be calculated based on the employee's total time. The percentage cannot exceed 100%.

9. Attachment 04 - Staffing Plan: How should offerors present OT hours in the Excel spreadsheet? Should we add/combine OT hours with the straight hours? Or should offerors present OT hours in a separate row or column?

Answer: Hours should be broken out in separate rows for Straight Time (ST) and Overtime (OT).

10. Attachment 04 - Staffing Plan: The "NOTES" section at the bottom of the Staffing Plan template instructs offerors to sort first by "Task Area" (Column E) and then by "Labor Category" (Column C). Is this a mandatory instruction? Would it be easier for evaluators to review the staffing plan if sorted first by "Labor Category" (Column C)?

Answer: All offerors should follow the instructions provided within Attachment 04 - Staffing Plan.

11. On page 21 of 117, the Labor Table lists a total of 61,180 hours per year. However, the Fee Table on page 5 of 117, states the hours per year are as 61,800. Can the Government please clarify which number reflects the correct labor hours?

Answer: See Amendment 0002. The table in clause B-216-H006 has been updated to reflect 61,180 hours for all years.

12. Request clarification regarding the total ODCs in support of CLIN 7000 listed in the RFP. On page 4, the total is stated as $83,556.68, while the ODC table on page 102 of 117 lists $83,557.68. Could the Government please clarify which total is correct?

Answer: See Amendment 0002. The ODC Not-to-Exceed (NTE) amounts have been updated to $83,556.68.

13. On Page 23 of 117 under Analyst, Operations III - Minimum Education requires a Bachelor's level degree in an Engineering discipline, Physics or Mathematics and a Master's level degree in Operations Research or Mathematics. Would the Government also accept a Master's level degree in an Engineering discipline?

Answer: See Amendment 0002 for revised Minimum Education requirement.

14. Whether this requirement is new or if there is an incumbent contractor currently supporting it?

Answer: This is a new requirement.

15. Could you please provide guidance to offerors on the proper procedure for submitting questions? According to the RFP, it mentions that questions should be submitted via the SeaPort portal.

Answer: Amendment 0001, issued 20 May 2026, incorporated clause L-216-H001 which provides instructions for the submission of questions.

16. The contract language states that CMMC Level 2 self-assessment is acceptable through November 9, 2026. However, the contract also requires CMMC Level 2 (C3PAO) for Options under CLINs 6000-7400. Given that the C3PAO assessment phase of the CMMC rollout is not scheduled to take effect until after the self-assessment period expires on November 9, 2026, can you please clarify how CLINs that fall within the current period of performance -- where self-assessment is the accepted standard -- can be subject to the C3PAO requirement? Specifically:

a) If the contract is awarded prior to the C3PAO rollout date, how does the C3PAO requirement apply?

b) Are the option CLINs (6000-7400) anticipated to be exercised after November 9, 2026, and is that the basis for the C3PAO requirement?

c) If options are not exercised or fall within the self-assessment window, is the Level 2 self-assessment sufficient for compliance?

We want to ensure we are flowing down the correct CMMC requirements to our subcontractors and need clarification on the applicable standard for the current and anticipated periods of performance.

Answer: See question and answer 4.

17. Section B CLINs 6000AA through 6400AA each specify 61,180 labor hours per year, while the Fee Table in Clause B-216-H006 lists 61,800 hours per CLIN -- a difference of 620 hours per year (3,100 hours over 5 years). Additionally, Section L (L-216-H001) states the total requirement is 305,900 hours, which is consistent with 61,180 5 years, but the Fee Table yields 309,000 hours. Will the government please confirm the 61,180 labor hours per year are correct based on the level of effort table in Section C 11.3 and revise the Fee Table in Clause B-216-H006?

Answer: See question and answer 11.

18. There is a $1.00 discrepancy in the Base Year ODC NTE amount: Section B (CLIN 7000AA) states $83,556.68, while the Section L cost proposal instructions ODC table states $83,557.68. Will the government please confirm which total is correct and validate the breakout between travel and materials in Section B is accurate?

Answer: See question and answer 12.

19. For CLIN 7300AA (Option Year 3), the sum of the Travel estimate ($53,067.68) and Materials estimate ($16,567.61) equals $69,635.29, which is $0.01 more than the stated NTE of $69,635.28. This rounding discrepancy also propagates to the 5-year ODC total ($359,315.04 calculated vs.

$359,315.03 stated). Will the government please confirm which total is correct and validate the breakout between travel and materials in Section B is accurate?

Answer: See Amendment 0002. The ODC NTE amounts have been updated. The Government confirms there is a $0.01 discrepancy in Option Year 3.

The corrected breakout for CLIN 7300AA (Option Year 3) will be:

Travel Estimate: $53,067.68

Materials Estimate: $16,567.60 (Adjusted down by $0.01)

Total CLIN 7300AA NTE: $69,635.28

This adjustment maintains the stated 5-year ODC total of $359,315.03. Offerors shall use these corrected figures in their cost proposals.

20. The Base Year materials estimate ($34,173.68) is approximately double the option year estimates (approximately $16,315-$16,748), representing a 52% decrease from Base Year to Option Year 1. Will the government please confirm the elevated Base Year materials estimate is correct?

Answer: The Base Year materials estimate is correct.

21. The solicitation contains two versions of Clause L-216-H001 with conflicting small business participation requirements: one version states the requirement is 40%, while the other states 30-40%. Will the Government please confirm the minimum small business participation should read as 30%, given this exceeds DoD and Seaport small business participation goals?

Answer: See question and answer 2.

22. The solicitation contains conflicting proposal validity periods: one instance of Clause L-216-H001 states 180 calendar days, while another states 60 calendar days. Section L, Paragraph 3.4.1 independently states 180 days. Will the government please confirm the required proposal validity period?

Answer: See question and answer 3.

23. FAR Clause 52.222-42 (Statement of Equivalent Rates for Federal Hires) identifies the Installation Analyst II as being a class of service employee to be employed under the contract and states the minimum wages payable at $33.73. However, Installation Analyst II is identified as a Professional Category under eCRAFT category (INS2) without an SCA Occupational Code and should be proposed as a professional exempt labor category in support of this opportunity. Would the Government please remove this category from the FAR Clause 52.222-42 table found within Section I on page 58-59 of the RFP?

Answer: See Amendment 0002. Installation Analyst II has been removed from the clause. Note: Clause 52.222-42 does not set minimum wages payable. It expressly states, "This Statement is for Information Only: It is not a Wage Determination."

24. The Engineering Technician V labor category is the only proposed labor category that has an SCA Occupational Code, 30085. This labor category represents only 6.9% of the total annual level of effort. All other categories are performing similar technical and engineering support tasks under the same SOW paragraphs and are deemed professional exempt personnel. Given that the Engineering Technician V labor category constitutes such a minor portion of the total LOE and performs substantive technical work alongside categories performing within the same SOW tasks, will the government please remove the WD table and confirm that the SCA is not applicable to this task order?

Answer: SCLS (Service Contract Labor Standards) is applicable. The Wage Determination will not be removed.

25. Section L estimates a contract award date of 12 July 2026, yet the Section F period of performance start date is 30 October 2026 -- approximately

3.5 months after the estimated award date. Will the government please clarify the correct start date offerors should assume for proposal purposes?

Answer: See Amendment 0002. The estimated award date has been updated to 30 October 2026.

26. The level of effort table in Section C, Paragraph 11.3 illustrates 480 annual hours for Management and Support, however, Section C, Paragraph

11.5 does not provide requisite education and experience qualification minimums. Will the government please provide specific qualifications for this labor category?

Answer: See Amendment 0002. The education and experience minimum requirements have been added.

27. Section C, Paragraph 11.5.15 states that the minimum education requirement for Analyst, Operations III (ANP3) is a Bachelor's level degree in an Engineering discipline, Physics, or Mathematics and a Master's level degree in Operations Research or Mathematics. Will the government please expand the acceptable degree areas of a Master's to allow for Engineering, Physics, Mathematics or Operations Research to align with the acceptable degree areas of a Bachelor's degree, as the Attachment 04 Staffing Plan template would not allow offerors to show both a Bachelor's degree and Master's degree without altering the spreadsheet?

Answer: See Amendment 0002 for revised Minimum Education requirement.

28. Will the government please clarify the basis for the calculation of the small business participation to include only total labor costs and exclude non-labor costs from the denominator in the calculation of the small business participation requirement?

Answer: Section L, paragraph 3.4.3 states "Offeror shall demonstrate how it will provide at least 40% of the proposed total estimated amount of the task order to small business concerns. Offeror shall provide sufficient information to demonstrate that the tasks assigned to the selected small business subcontractors are meaningful in the overall success of the program. The approach shall address use of Small Business Concerns, Small Disadvantaged Business Concerns, Women- Owned Small Business Concerns, Hub Zone Small Business Concerns, Veteran-Owned Small Business Concerns, and Service-Disabled Veteran- Owned Small Business Concerns." No additional information will be provided.

29. We do not have a DCAA or DCMA approved accounting system. However, our accounting system has been audited by a third-party CPA, who certified that it is DCAA compatible. Will this certification be sufficient, or will the lack of a DCAA/DCMA audited system prevent us from being eligible for this opportunity?

Answer: If an offeror is planning to submit a proposal in response to this Solicitation without having a DCAA or DCMA approved accounting system, that they shall submit a completed SF1408 Pre-Award Survey as soon as possible at the attention of David Torres (david.torres22.civ@us.navy.mil) prior to and separate from their proposal submission.

30. CPFF-LOE & 50-Percent Rule Enforcement, N6449826R3107, Solicitation, Page 20

This is a Level of Effort (LOE) contract estimated at ~61,180 direct labor hours annually. Under SeaPort-NxG and CPFF-LOE rules, managing the exact delivery of hours could be a contractual compliance risk.

"Will the Government clarify the contractual variance threshold for the Level of Effort? If the contractor falls short of the exact 61,180 hours due to unforeseen delays or slow onboarding, will the Fixed Fee be pro-rated strictly under the FAR 52.216-10 LOE clause, or is there a permissible variance percentage (e.g., +/- 5%) before fee adjustment occurs?"

Answer: See B-232-H005. Fee is paid on an hourly basis.

31. Flow-Downs & Subcontracting Privity, N6449826R3107, Solicitation, 3.3.3, page 101

"Does the Government require separate, fully unredacted cost proposals and cost realism data for all proposed subcontractors to be uploaded directly into PIEE, or are subcontractors permitted to submit their proprietary cost data directly to the Contracting Officer to maintain confidentiality?"

"Will the Government require signed Teaming Agreements or Letters of Intent (LOIs) for all key personnel/subcontractors at the time of proposal submission?"

Answer: (a) Section L, paragraph 3.3.3 provides instructions for the information required in Subcontractors' proposals. Section L paragraph 1.0 provides instructions for the submission of proposals.

(b) The solicitation does not include an express requirement for Teaming Agreements. Providing such signed agreements is at the Offeror's discretion.

Section L paragraph 3.1.3 provides requirements for Letters of Intent.

32. Period of Performance & Transition Mechanics, N6449826R3107, Solicitation, 3.1.2, page 99

"Is there a designated, contractually recognized 'Transition-In' period (e.g., 30 days) built into the Base Year, or is the awardee expected to provide the full 61,180 hour run-rate on Day 1 of the POP?"

Answer: Section L, paragraph 3.1.2, provides instructions for the Offerors to propose a transition plan and provide a POAM to support the proposed plan.

33. FARS 252.225-7048 "Export-Controlled Items", N6449826R3107, Solicitation, page 51 is included in Section I (Contract Clauses). This clause requires the contractor to comply with all U.S. export control laws and regulations, including ITAR and EAR (Export Administration Regulations).

Section I of Solicitation N6449826R3107 includes DFARS 252.225-7048, "Export-Controlled Items," which requires compliance with all applicable U.S. export control laws and regulations, including the International Traffic in Arms Regulations (ITAR) and the Export Administration Regulations (EAR). However, the solicitation and Statement of Work do not explicitly state whether any of the work, deliverables, or technical data to be provided under this contract are subject to ITAR controls.

Request:

Can the Government please clarify whether any aspect of the work, deliverables, or technical data required by this solicitation is subject to ITAR (International Traffic in Arms Regulations) controls? If so, please specify which portions of the requirement are ITAR-controlled and whether the contractor is required to be registered with the Directorate of Defense Trade Controls (DDTC) for performance of this contract.

Answer: Per DFARS 252.225-7048(c), the Contractor's responsibility to identify and comply with all applicable export control laws (including ITAR and EAR) exists independently of any information provided by the Government.

It is the Contractor's sole responsibility to self-classify its deliverables, determine the applicability of ITAR, and maintain any necessary registration with the Directorate of Defense Trade Controls (DDTC). Questions regarding export eligibility must be directed to the Department of State or Department of Commerce.

34. G-216-H001 FIXED FEE WITHHOLD--FAR 52.216-8 CLARIFICATION (NAVSEA) (OCT 2018) (Oct 2018), N6449826R3107, Solicitation, page 41The Government will withhold 15% of each fixed fee payment starting with the first invoice submitted until a total of $100,000 of fixed fee has been withheld. Withheld amounts will be released in accordance with FAR 52.216-8, Fixed Fee.

How long can and does the government withhold the fee for before it is returned to the prime?

Answer: The duration of the fee withhold is not tied to a specific calendar timeframe, but rather to contract completion and closeout milestones as defined in FAR 52.216-8(b). Please see FAR 52.216-8 for additional information.

35. Scope of Work, N6449826R3107, Solicitation, page 8. Are there any anticipated changes to the Statement of Work or deliverables prior to award?

Answer: No.

36. Deliverables, N6449826R3107, Solicitation, page 99: Can the Government clarify which deliverables, if any, are considered critical path for schedule purposes?

Answer: As priorities change throughout performance, the Government cannot identify critical path deliveries at this time.

37. Government Furnished Property, N6449826R3107, Solicitation, page 103: Are there any Government Furnished Property (GFP) items that may not be available at contract start?

Answer: No.

38. Performance Metrics: Are there any specific performance metrics or KPIs that will be used to evaluate contractor performance?

Answer: There are no specific performance metrics or KPIs identified in the solicitation.

39. Flowdowns: Are there any additional flow-down clauses or agency-specific requirements not listed in the solicitation?

Answer: No.

40. Revolutionary FAR Overhaul: Will any of the Revolutionary FAR overhaul changes be implemented for this solicitation.

Answer: The clauses in the solicitation are the clauses that will be included in the award.

41. Overtime premium is undefined while the LOE table requires OT hours, N6449826R3107, Solicitation, page 20. Clause 52.222-2 (Section I) sets the approved overtime premium cap at "*TBD," yet the LOE table (Section C, para 11.3, p.20) bakes in 2,100 Gov-site OT hours + 1,000 Ktr-site OT hours per year (3,100 OT hrs/yr).

Question: Will the Government specify the approved overtime premium dollar amount? Should offerors price the LOE's OT hours at straight time only, or include an OT premium -- and if premium is not approved (zero), should it be excluded from proposed cost?

Answer: The overtime premium amount in Clause 52.222-2 will be populated based on the overtime premium proposed by the awardee.

42. Escalation table lists only four rates for five years, N6449826R3107, Solicitation, page 102. Section L, para 3.3.3 (Escalation, p.101) shows columns for Base Year + OY1-OY4 but only four percentages (2.55%, 2.14%, 2.25%, 2.35%).

Question: Which performance years do these four rates map to? Is the Base Year assumed at 0% (rates apply to OY1-OY4), or do they apply to Base- OY3 with the OY4 rate omitted? Please provide the missing rate or confirm the mapping.

Answer: The minimum escalation for the base year is 0%. Minimum escalation rates are provided for OY1-OY4.

43. ODC travel/material breakout, N6449826R3107, Solicitation, page 3. Section B's ODC CLINs give separate travel and material estimates inside each year's NTE, but Attachment 06 has a single ODC line plus burden adders.

Question: Must offerors constrain travel and material to their individual sub-estimates, or only to the total annual ODC NTE? Should the cost spreadsheet show travel and material separately to match Section B?

Answer: The separate travel and material estimates are provided within the ODC CLINs to accommodate differing indirect rate structures among Offerors. Offerors must use the individual sub-estimates provided in Section B as the baseline values for their cost proposals. If an Offeror applies distinct indirect rates to travel versus material, they may edit Attachment 06 to break out these categories separately, ensuring the appropriate burdens are applied accurately to the respective Section B values.

44. Small Business participation basis and template placeholder, N6449826R3107, Solicitation, Section L, para 3.4.3 (p.102) requires 40% of "the proposed total estimated amount of the task order" to small business, but Attachment 07 (SBPCD) computes the percentage against a fixed TCV of $50,000,000 and is pre-filled with example figures ($5M/$2M/$10M rows). Question: Is the 40% MQR measured against the offeror's proposed total task-order value or the $50M shown in Attachment 07? Are the TCV and example dollar rows placeholders to be replaced? Also, given this is not a set-aside (Section A, p.2) and Attachment 07 still references "SeaPort-e," please confirm Attachment 07 is the required SB participation template for this SeaPort-NxG order.
