SECTION C – DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

Sexual Offender Assessment and Treatment Services for Justice Involved Offenders

C.1 Agency Background. The mission of the Court Services and Offender Supervision Agency (CSOSA) is to increase public safety, prevent crime, reduce recidivism, and support the fair administration of justice in close collaboration with the community. CSOSA is responsible for the supervision of all probationers and parolees held under the authority of any United States or District of Columbia statute, or any other lawful authority and entrusted to the District. CSOSA has been mandated to provide comprehensive sex offender treatment services to offenders (hereinafter referred to as Offenders) who have been ordered to undergo such treatment by the courts, either as part of a sentence or pre-sentence, or as a condition of probation or parole.

C.2 Objective. The objective of this purchase order is to obtain sexual offender assessment and treatment services for Offenders with an order from a releasing authority for sex offense-related assessment and treatment which includes comprehensive, outpatient sex offender screening, assessment, and treatment services.

C.3 Scope of Work. Treatment services may include assessment, individual counseling, group counseling, relapse prevention, maintenance and monitoring polygraph testing, discharge/aftercare planning, and other essential services as required. Sex offender treatment is intended to assist the Offender in managing his/her sexually offensive behavior, and to decrease the risk of re-offending.

Specifically, the Contractor shall:

a. Develop therapeutic interventions specific to the Offender, such as approaches to increase prospect of Offender successfully completing treatment, addressing criminal involvement, and cooperation with criminal justice requirements. This requires establishment of a close working relationship with the Community Service Officer (CSO) responsible for supervising each Offender.

b. Coordinate, cooperate and work with CSOs, utilizing a team approach for case planning, treatment intervention, and case monitoring.

c. Hold monthly case meetings with CSO as well as other meetings and interventions as deemed necessary by the Contracting Officer’s Representative (COR), to include a minimum of one (1) team meeting with all of the Contractor's direct service staff and the CSO, Supervisory Community Supervision Officer (SCSO), and Sex Offender Treatment Specialist (SOTS).

d. Provide treatment services in accordance with recommended practices of the

Association for the Treatment of Sexual Abuser (ATSA) and the Center for Sexual Offender Management (CSOM). Assessment and treatment services should be evidence-based and specific to meet the unique needs of the Offender.

e. Develop and implement written guidelines and procedures for assessment and treatment services, available for review by CSOSA, including:

1. Referral criteria (including any exclusionary factors such as medical or mental health conditions).

2. The objectives of the program.

3. The criteria used to measure Offender’s progress towards attainment of objectives.

4. A description of the diagnostic and treatment modalities utilized by the program.

5. A description of all therapeutic activities provided, including individual and group counseling sessions.

6. Safety precautions and procedures.

7. Crisis intervention procedures.

8. Medical emergency procedures.

9. Patient's rights and rules of conduct.

10. Personnel policies.

11. Methods for addressing Offender non-compliance.

12. Methods for investigating and handling Offender grievances.

13. Methods for investigating unusual incidents.

14. Polygraph methods and testing procedures.

C.4 Referral Authorization

C.4.1 The COR shall provide a referral authorization to the Contractor for each Offender to be assessed and/or treated. The referral authorization shall contain a billing authorization document; referral date; Notice of Action (NOA) or Judgment and Commitment (J&C) order;

Special Conditions; Offender identification information, and supervision contact information.

Existing documents used in the assessment and treatment process, such as pre-sentence investigation reports, will be provided to the Contractor electronically via secure encrypted email.

C.4.2 The referral authorization is the only document that makes CSOSA financially responsible for Offender services provided by the Contractor. No verbal or other authorization are recognized or allowed. CSOSA is not responsible for Offender services provided without a referral authorization, or for any Offender services provided that exceed the treatment duration, or the maximum dollar amount authorized for the treatment duration.

C.5 Specific Tasks

C.5.1 Psychosexual risk/treatment needs assessment sessions for treatment and aftercare.

C.5.1.1 Treatment assessment sessions are up to 50 minutes in length and defined as all appointments and meetings directly with the Offender necessary to complete a psychosexual risk/treatment needs assessment, individual treatment, or aftercare session.

C.5.1.2 The Contractor shall be allotted up to four (4) individual treatment sessions with each Offender in order to complete the psychosexual risk/treatment needs assessment.

The Contractor shall schedule the individual treatment sessions to occur at least weekly.

Psychosexual risk/treatment needs assessment sessions shall take place in an individual session modality only. The Contractor shall utilize the individual treatment assessment sessions to engage the Offender in a dialogue so as to formulate supervision strategies and treatment options that will address the Offender’s risk and needs.

C.5.1.3 The Contractor shall hold an initial meeting with each Offender. The purpose of the meeting is to acquire the Offender’s signature on all appropriate paperwork, review the Offender’s rights and responsibilities, and begin conducting the assessment. The Offender will be held accountable for meeting with the Contractor within ten (10) business days of the authorization being received; however, the Contractor must ensure contact is made.

C.5.1.4 During the initial meeting with the Offender, the Contractor shall:

a. Notify the referring Sex Offender Treatment Assistant (SOTA) and the CSO via email, within two (2) business days of the initial meeting, to verify that contact was made.

b. In accordance with the Privacy Act, and other applicable laws, the express written consent of the Offender must be obtained in order to release his/her treatment information. If the Offender refuses to sign any forms, either CSOSA or Contractor provided, the initial meeting must be stopped and the Contractor must notify the CSO, SCSO, and SOTA immediately.

c. A notification of all no shows will include the date and time for a rescheduled appointment. The Contractor shall schedule only one (1) rescheduled initial meeting appointment. If the Offender misses the rescheduled appointment, the Contractor shall effectively close the case and send written confirmation of such to the SOTA and the CSO. The written confirmation shall contain the Offender’s name and the dates of the two missed appointments (the initial and rescheduled appointments).

d. Obtain the COR’s authorization if the Contractor believes that additional individual sessions are required in order to complete the Offender’s treatment needs assessment.

C.5.1.5 Any Offender who arrives more than 10 minutes late for a scheduled session shall not be permitted to participate, and the Contractor shall notify the CSO in writing within 24 hours of such incidents.

C.5.1.6 The Contractor shall notify the CSO in writing within 24 hours of any missed appointments.

C.5.2 Individual treatment/aftercare/booster sessions. An individual counseling session, an aftercare counseling session, and a booster counseling session must last a minimum of 50 minutes and will be deemed a single session, inclusive of all reporting requirements. Longer sessions will be deemed a single session regardless of length. The Contractor shall provide flexible hours, evenings and weekends as necessary, to accommodate employed Offenders.

C.5.3 Sexual History Polygraph, Offense Specific Polygraph, or Alternative Physiological testing (plethysmograph) measures. The COR will determine at time of authorization which polygraph, or alternative physiological testing, will be authorized for use. The polygraph, or alternative physiological testing, examination shall be completed within 30 calendar days of the authorization. Results of each of the examinations used shall be documented in the Psychosexual Risk/Treatment Needs Assessment Report. The use of additional physiological testing tools may be necessary to further distinguish arousal patterns and sexual deviancy.

Authorization for such additional testing must be obtained from the COR.

C.5.4 Psychosexual Risk/Treatment Needs Assessment Report. The Contractor shall provide the completed Psychosexual Risk/Treatment Needs Assessment Report to the COR within 14 calendar days of completion of the last assessment session. The COR shall review the Treatment Needs Assessment Report within five (5) business days, and if necessary, confer with the Contractor regarding the number and type of therapeutic interventions appropriate for the Offender. The Psychosexual Risk/Treatment Needs Assessment Report must be in narrative form. Each assessment report shall include:

C.5.6 Individualized Treatment Plan. The Contractor shall develop an individualized treatment plan for each Offender based on the results of the treatment assessment sessions, the level of risk (criminogenic risk/needs and protective factors), the polygraphs used, and referral information provided by COR. A treatment plan must:

a. Be individualized and meet the unique needs of the Offender.

b. Be formalized as a written performance contract to be signed by the Offender, the

CSO, the SCSO, and the Contractor.

c. Define the specific responsibilities of the Contractor, the Offender, and the CSO.

d. Provide for the protection of victims and potential victims and not cause the victim(s) to have unsafe and/or unwanted contact with the Offender.

e. Identify the problems to be addressed targeting criminogenic risk and needs.

i. Be reviewed and updated monthly.

j. Define the number of individual sessions and group sessions recommended to complete the Offender's individualized treatment plan. (Follow the format of the referral authorization form).

C.6 Sex Offender Treatment Counseling.

C.6.1 Treatment Counseling Authorization. The COR will provide a treatment counseling authorization package to the Contractor prior to each Offender referral for treatment counseling. The treatment counseling authorization package shall contain a billing authorization document; the Offender's identification information and CSO; referral date; the treatment duration; and the dollar amount authorized for treatment. The treatment counseling authorization will also provide guidelines for the number of counseling sessions and types of services the Offender should receive from the Contractor. Counseling sessions should begin after the initial assessment is completed and the Contractor receives proper authorization.

The Contractor may recommend changes in the authorized services and/or frequency of treatment. The COR must authorize any changes to the treatment plan in advance, including stopping treatment. CSOSA will not reimburse the Contractor for services that were not authorized in advance of the services being provided.

C.6.2 Offender Treatment File. An Offender Treatment File shall contain all documentation pertaining to the Offender’s assessment and treatment regimen, to include, but not be limited to, correspondence, deliverables, status reports, progress notes, incident reports, progress reports, polygraph reports, psychosexual reports, and homework. (See Section C.9 for further details).

C.6.3 Treatment Plans. Treatment plans must be updated and modified when major clinical changes occur, or when major life, family, or social circumstances may complicate treatment.

Evidence of monthly reviews must be documented and maintained in the Offender Treatment File. This evidence shall be in the form of a signed and dated entry in the progress notes indicating a treatment plan review, or in the form of a signed and dated revised treatment plan. Any changes in programming must be reflected via an amended performance contract bearing the dated signatures of the required parties referenced in C.5.6.b above.

C.6.4 Group/Aftercare/Booster Sessions. A group counseling session, a group aftercare counseling session, and a group booster counseling session must last a minimum of 90 minutes and will be deemed a single session; inclusive of all reporting requirements. The Contractor will invoice by each Offender who attended the session.

C.6.5 The Contractor shall provide flexible hours, evenings and weekends as necessary, to accommodate employed Offenders. A diverse range of group types (e.g. pedophilia, antisocial, psychoeducational, limited cognitive/intellectual functioning, psychopathy, etc.)

shall be facilitated in order to meet the unique and individual needs of the Offenders as recommended in the sex offender assessment. Frequency, course, and duration of treatment shall be provided based on the level of risk of the Offender, and subsequent recommendations in the assessment and treatment plan.

C.6.6 Group Session Orientation. Each Offender referred for treatment counseling shall participate in an orientation within seven (7) business days of authorization for group sessions. Once the orientation is complete, the Offender shall be assigned to a clinician and begin treatment within seven (7) calendar days. Denial, in and of itself, shall not be an exclusion factor for treatment so long as other relevant risk factors identified during the treatment assessment are capable of being meaningfully addressed and mitigated.

C.6.7 Maintenance Polygraph or Alternative Physiological testing (plethysmograph) measures. The use of maintenance polygraph, or alternative physiological testing tools, may be necessary to monitor Offender compliance, adjustment to treatment, and further distinguish arousal patterns and sexual deviancy. Authorization of such must be made by the COR. The Contractor shall submit a request to the CSO within 24 hours (or on the next business day) for a staffing to occur as a result of a deceptive polygraph examination, new sexual offense disclosure, or other high-risk related behaviors, so that behavioral monitoring activities may be increased and a modified risk mitigation plan can be developed. Results of each of the polygraphs used shall be documented in an accompanying report.

C.6.8 Treatment Team Staffing. Monthly treatment team staffings between the treatment staff and CSO’s shall occur to ensure that frequent and regular communication is occurring in accordance with the containment model approach to sex offender supervision. These staffings shall address each Offender currently enrolled in treatment, their treatment progress, and any barriers to treatment/supervision compliance, or any other relevant risk-related activities. Additionally, the treatment team staffing will provide guidance recommendations to the CSOs in the effective use of engagement strategies, such as Cognitive Behavioral Intervention (CBI) and/or Motivational Interviewing (MI), to engage and encourage an Offender towards substantial supervision and treatment compliance.

C.6.9 Individual Treatment Staffing. In accordance with direction or authorization from the COR, an additional Individual Treatment Staffing may be requested to support an Offender unsuccessfully adhering to the special conditions of her/his community supervision. Staffing issues may arise due to emergent disclosures, non-compliant behaviors, or other treatment-related issues (substance use, frequent absences, lack of participation etc.). The Individual Treatment Staffing will be invoiced as an Individual Treatment Session.

C.6.10 Weekly Progress Notes. The Contractor shall maintain weekly progress notes for each Offender. The notes shall be maintained in the SOAP (Subjective, Objective, Assessment, and Plan/Prognosis) or DAP (Data, Assessment, and Plan) format and must contain an entry for each of the areas. Each weekly progress note must be signed and dated by the Contractor and must be maintained in the Offender Treatment File with the most recent note on top.

C.6.11 Representation at Court or United State Parole Commission Hearing. The Contractor shall attend all hearings that may arise concerning the results of the comprehensive psychosexual risk assessment. These hearings can be initiated from the D.C. Superior Court, the U.S. District Court, or the United States Parole Commission. CSOSA will provide as much advance notice as possible. CSOSA anticipates up to 20 requests to appear before the court or appropriate releasing authority during each period of performance. Any invoices for hearing appearances must include substantiation of the appearance, either by a copy of a subpoena or by written consultation from the COR.

The Contractor shall coordinate this staffing with the CSO and the Offender. The discharge staffing shall include a review of the Offender's progress on the treatment plan and recommendations for the next phase of treatment. Discharge staffings with the SCSO and SOTS shall also occur prior to an Offender’s unsuccessful discharge, or any other type of discharge other than consecutive no-show noncompliance, in an attempt to motivate and encourage the Offender into full compliance, and to ensure that all reasonable treatment considerations have been exhausted.

Discharge staffing documentation shall be filed in the Offender Treatment File.

C.7.2 Aftercare/Relapse Prevention Plan. No later than thirty (30) business days prior to completion of the program, the Contractor must develop a written comprehensive aftercare plan for each Offender that summarizes the results of the discharge planning staffing and outlines the strategies the Offender must utilize to minimize the risk of re-offending, and any further treatment services recommended. A copy of the plan shall be provided to the CSO, SOTS, and filed in the Offender Treatment File.
