This is a combined synopsis/solicitation for commercial products and commercial services prepared in accordance with the format in Federal Acquisition Regulation (FAR) 12.6 and (FAR)

13 as supplemented with additional information included in this notice. The incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2024-05.

THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION AND A SEPARATE

SOLICITATION WILL NOT BE ISSUED. The solicitation number for this acquisition is

75F40124Q00498 for FDA Project CFSAN-2024-124161/CFSN-ORS-24-C-1843. This combined solicitation is being issued as a Request for Quotation (RFQ). The NAICS for this solicitation is 334516 – Analytical Laboratory Instrument Manufacturing. The business size standard is 1000. This requirement is being solicited as 100% small business set aside.

Prospective quoters are responsible for downloading the solicitation and any amendments from

SAM.gov. The Government reserves the right to award the resultant firm fixed price purchase order without discussions if the Contracting Officer determines that the initial offer provides the

Best Value to the Government and discussions are not necessary.

The objective is to acquires benchtop microwave digestion system for the analysis of contaminants and adulterants in cosmetics, dietary supplements, and foods. The requested

UltraWave 3 ECR automatic simultaneous digestion system will provide the necessary requirements that are critical for the development, testing, and validation of new methods for

FDA laboratories dedicated to food safety, including FDA’s Closer to Zero approach to lower toxic elements in baby foods.

3. Quotation Submission Instructions:

a) The Contractor shall submit a firm-fixed price quote, including details of all cost to support the price for the required deliverables.

b) The Contractor shall include and complete the pricing table below to be considered responsive. Pricing shall include all applicable fees; any charges presented after award shall not be considered/accepted.

c) Quotes shall be in two volumes: Volume I shall be Technical and Volume II shall be

Price. The volumes shall be separate and complete, so the evaluation of one may be accomplished independently of, and concurrently with, the evaluation of the other. No pricing information shall be provided in Volume I.

Volume I: Technical Volume shall provide the technical specifications for the product proposed and a clear table which shows where the proposed item meets or exceeds the salient characteristics. It shall address the qualification of the technicians responsible for the installation and training of the equipment. *Domestic end product is preferred and sought, where available. The country of origin for all manufactured items must be disclosed in FAR 52.212-3(f) as applicable.**

d) Quotes shall clearly reference on company letterhead the solicitation, quotation number, date of quotation, company quoting, Unique Entity Identifier (UEI), and point of contact.

f) Volume II: Price shall include a quote for all requested deliverables, with applicable discounts. Partial quotes will not be accepted.

g) Quotes shall be valid for at least sixty (60) days after close of solicitation.

h) The solicitation does not commit the Government to pay any cost for the preparation and submission of a quote. It is also advised that the Contracting Officer (CO) is the only individual who can legally commit and obligate the Government to the expenditure of public funds in connection with the proposed acquisition.

4. Award Criteria:

Quotations that do not respond to all requirements in the solicitation may be considered non-responsive without further evaluation, deliberation, or discussion. The Government reserves the right to award without discussions. The Government contemplates award of a Firm-Fixed-Price Purchase Order resulting from this solicitation to the responsible quoter whose quote confirming to the solicitation will be most advantageous to the

Government and whose quote is the Lowest Priced Technically Acceptable (LPTA).

I. Purpose

The Office of Regulatory Science (ORS), Division of Bioanalytical Chemistry (DBC), Chemical Contaminants Branch (CHCB) requires the purchase of a microwave digestion system to effectively decompose/digest samples of foods, cosmetics, and dietary supplements for accurate determination of toxic and nutrient elements.

II. Background

The Chemical Contaminants Branch within the Office of Regulatory Science (ORS), Division of Bioanalytical Chemistry (DBC) requires the purchase of a benchtop microwave digestion system for the analysis of contaminants and adulterants in cosmetics, dietary supplements, and foods. The requested benchtop microwave digestion system will provide the necessary requirements that are critical for the development, testing, and validation of new methods for FDA laboratories dedicated to food safety, including FDA’s Closer to Zero approach to lower toxic elements in baby foods.

ORS, DBC, and CHCB requires that the proposed equipment meet or out-perform the specifications as described below. The proposed equipment is required to continue and expand the efforts of the US FDA to protect the US food supply and respond to emergencies in a timely manner.

III. Objectives

The purchase of this benchtop microwave digestion system is critical to support the

Agency’s mission to protect the food supply. This microwave digestion system will efficiently decompose food, dietary supplements, and cosmetics as part of the sample preparation steps required before analysis with a mass spectrometer.

IV. Scope

The Contractor shall furnish the necessary personnel, tools and equipment needed to deliver and install the benchtop microwave digestion system with the following specifications:

The major components of the system shall include:

• Benchtop Microwave Digestion System with the following characteristics:

o Benchtop system o Single reaction cell system o Equipped for operating temperatures up to 300⁰C and operating pressure up to 199 bar o The system will have the capabilities of performing HCl/Aqua regia digestions.

o Capable of digesting 40 samples at once o Include a recirculating chiller o Include TFM vials and caps

• The system shall be:

o warranted for parts and labor for at least 1 year from date of installation o The system must be newly manufactured unit, not used or refurbished, or previously used for demonstration.

o The system must meet all the technical specifications specified below

• The vendor shall:

o Vendor is responsible for delivery and installation of the instrument.

The FDA project officer will perform inspection and acceptance of the microwave o The vendor will demonstrate upon installation that the item will be all performance specifications by the manufacturer o Provide an instrument familiarization for FDA users will be provided by the installation specialist

Accessories:

• 40 positions rack with GLASS vials and caps.

• 20 positions rack with TFM vials and caps (x4).

• 27 positions rack with TFM vials and caps (x1).

• TFM vessel 97,5x156 (x1).

• Sample rack 40 positions Ø 10mm (x3).

• PTFE cap for vial Ø 16 mm (x100).

• TFM vial 16/115 (Ø 16 mm/13 mm x 115 mm) ca. 15 ml (x100).

• PTFE cap for Glass & TFM inserts - 12-13mm. For use in 19/22-position UW rack and SK-15micro-inserts (x40).

• PTFE vial 12/100 (12mm O/D x 100mm) ca 7 mL capacity. For use in 22 position rack. (x40).

• 12-month Original Manufacture Warranty. Valid for 12-months from the date of installation but no longer than 13 months from ship date (included in price).

• Buck-boost transformer to step up 208VAC to 230VAC. Supplied with NEMA 6-

15 plug. (x1).

• Recirculating Chiller with temperature control, Digital readout, Pressure gauge and Liquid level indicator, 220V, 50/60Hz.

• 1 day installation and operator training for four (4) end-users including instrument operation and routine maintenance (includes travel and expenses)(x1).

V. Requirements

The instrument purchased shall meet the following technical requirements:

• 1L stainless steel single reaction chamber (SRC) reaction chamber with

PTFE/TFM liner.

• Ability to run any acid chemistry, including aqua regia and & large volumes of

HCl, using vials with loose-fitting caps.

• Noiseless water-cooled magnetron providing superior heating efficiency.

• Contactless temperature control providing high precision and responsiveness.

• Automated pre-pressurization of SRC chamber and flushing of nitrogen lines postdigestion.

• Software-controlled pneumatic lift of PTFE/TFM liner.

• Dedicated lift motor to lower and raise cover and rack fully controlled by the software.

• Automatic opening/closing of the SRC chamber with auto lift.

• Safety interlocks on front door viewing window, chamber & clamp position, chamber temperature & pressure.

• Separated inlet and outlet high-pressure lines to minimize risk of contamination

• Quartz bottom to avoid acid diffusion.

• Power up to 1,500W. Microprocessor controlled. Power 220V, 60Hz.

• Microwave frequency 2.45 GHz, Max temp. 300°C. Max. pressure 199 bar.

• Twin exhaust ducts for removal of acid vapors.

• Magnetic stirring.

• H150-1000 LabTech Recirculating Chiller with PID temperature control, Digital readout, Pressure gauge and Liquid level indicator, 220V, 50/60Hz.

• Capable of digesting 40 samples in a single batch.

VI. Deliverables

The vendor is responsible for delivery and installation of the instrument and all components specified above to the FDA/CFSAN laboratory facility located at 5001

Campus Drive, College Park, MD 20740. If the vendor is not installing on the day of delivery, the delivery should be made to the loading dock and moved into location on the date of installation. The vendor is responsible for installation of the instrument. The vendor will demonstrate upon installation that the item will meet all performance specifications by the manufacturer. The instrument will not be accepted until those performance specifications have been met. The FDA project officer will perform inspection and acceptance of the imaging system. The entire system will be warranted for parts and labor for 12-months from date of installation. Service and installation shall be provided by service engineers who are trained and certified by the original manufacturer of the instrument. Engineers should have access to the manufacturer’s latest technical developments, repair procedures, application updates, diagnostic software, and planned maintenance procedures.

VII. Place of Performance

FDA/CFSAN, 5001 Campus Drive, College Park, Maryland, 20740.

Delivery and installation should be coordinated through the CFSAN Technical Point of

Contact (TPOC). Work shall be conducted Monday through Friday, excluding federal holidays.

VIII. Period of Performance

The entire system will be warranted for parts and labor for 12-months from date of installation.

IX. Holidays and Government Closures

The Contractor is not permitted to provide on-site services on the following days that are

Federal Holidays or on any other day designated as a Federal holiday for the Washington, DC area:

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the

Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor

Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the

Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
