INSTRUCTIONS TO QUOTERS

ACKNOWLEDGEMENT OF AMENDMENTS: The Quoter acknowledges receipt of the following

Solicitation Amendments:

Amendment Number Date Received

The purpose of this Solicitation is to obtain a high-performing contractor that can provide exemplary service for the requirements set forth in Section B.3 during the Period(s) of

Performance set forth in Section B.2 with minimal supervision.

ACQUISITION OF COMMERCIAL ITEMS: This Request for Quote (RFQ) solicitation is issued under the authority of FAR Part 12 Acquisition of Commercial Items and FAR Part 13 Simplified

Acquisition Procedures. FAR Parts 14 and 15 will not be used. The procedures in Part 12 used in conjunction with Part 13 allow the Government to procure services resembling those in the commercial marketplace and streamline the procurement process. From this RFQ, the Government intends to award a firm-fixed-price contract where the contractor provides a price that is not subject to any adjustment on the basis of the contractor’s cost experience in performing the contract. (Note: The terms “offeror” and

“quoter” are both used in this Solicitation. For the purposes of this Solicitation, these terms are interchangeable; there is no difference in meaning between the two.)

The Government, in its sole discretion, may award a contract from the quotes received in response to this Solicitation, issue a new Solicitation, or cancel this Solicitation without reissue.

SDVOSB SET-ASIDE: This requirement has been set aside for Service-Disabled Veteran-Owned Small

Businesses (SDVOSBs), under the Veterans First Contracting Program (VFCP), pursuant to VAAR

819.7001 – 819.7011, available at VA Acquisition Regulation VAAR Part 819 - Small Business

Programs. SDVOSB joint ventures are eligible for consideration so long as the requirements of VAAR

819.7003(c) are met.

The VA may not consider late responses due to undelivered e-mails that exceed 7 megabytes.

CONTENTS OF QUOTE: The Government, in its sole discretion, will award a contract to the responsible contractor whose quotation, conforming to the solicitation, is most advantageous to the

Government, considering all of the following factors (Note: The order of the factors listed does not imply the relative importance of each factor.): (1) Price; (2) Technical Capability; (3) Prior Experience; (4)

Administrative Information; and (5) Representations & Certifications.

Quotes shall include the following information to be evaluated for contract award. Incomplete quotes will be considered non-conforming and may not be considered, pursuant to FAR 13.106-2(b)(3).

(1) Price: Complete the highlighted blanks in SECTION B.2 PRICE SCHEDULE.

(2) Technical Capability: The quotation should specifically detail how the Contractor will provide the services required in the Performance Work Statement, specifically including:

a. A copy of the quoter/business’s current Illinois Elevator Contractor License, or an equivalent license from another state;

b. For each elevator mechanic that will be providing services under this Contract:

o A current copy of their Illinois Elevator Mechanic License, or an equivalent license from another state;

o A résumé detailing type and years of elevator maintenance experience, specifically referencing the manufacturer and age of equipment serviced; and o A copy of all training certificates.

mailto:Robert.Knight1@va.gov https://sam.gov/content/opportunities mailto:Robert.Knight1@va.gov

c. The name(s), training, and experience for each person serving in a supervisory capacity for performance of this Contract.

d. A detailed plan as to how it will meet the following emergency response times, i.e., distance from the facility for at least two qualified elevator mechanics:

o 30 minutes for all emergency calls during Business Hours;

o 1 hour for an emergency entrapment call outside of Business Hours; and o 2 hours for all other emergencies outside of Business Hours.

e. A detailed plan as to how it will provide the parts, equipment, software, and tools required for performance of the Contract. For replacement parts and equipment, the Contractor shall identify what it keeps stocked, its sources for what is not stocked, and the delivery times for both stocked and non-stocked parts and equipment.

f. A detailed plan as to how it will provide the labor, equipment, and materials for larger service jobs, e.g., ropes replacement.

(3) Prior Experience: Submit information, if any, of contracts providing services similar to the requirements of this Contract, particularly if that experience is at a VA facility. Information should include the contract number, scope/size of the contract, dates of service, and a point-of-contact at the facility with a telephone number or e-mail address. For evaluation purposes, a lack of prior experience will not disqualify a company.

(4) Administrative Information:

a. Complete SF1449 blocks 17a, 30a, 30b, and 30c on Page 1;

b. Complete Acknowledgment of Amendments (if any), on Page 2; and

c. Complete subsection 1a, Contractor information, under Section B.1, below.

(5) Representations & Certifications (Note: The Government will not consider quotes that do not provide the following information, and any incomplete responses shall be deemed ineligible for evaluation and award.):

a. Complete the certification found under clause VAAR 852.219-75(d), VA Notice of Limitations on

Subcontracting—Certificate of Compliance for Services and Construction, found in Section C.

b. Complete the representation found under provision FAR 52.204-24(d), Representation Regarding

Certain Telecommunications and Video Surveillance Services or Equipment, found in Section E.

c. Complete the representations and certifications as directed under provision FAR 52.212-3, Offeror

Representations and Certifications – Commercial Items, found in Section E.

QUOTE EVALUATION: The Government will evaluate quotations using the comparative evaluation process outlined in FAR 13.106-2(b)(3), where quotations will be compared to one another to determine which provides the best benefit to the Government based on the factors listed above. The Government reserves the right to consider a quote that is other than the lowest price that provides additional benefit(s).

Quotations may exceed minimum requirements of the solicitation. The Government reserves the right to select a quotation that provides benefit to the Government that exceeds the minimum requirements of the solicitation, even if that quote is not the lowest priced quote submitted, but is not required to do so. Each response must meet the minimum requirements of the solicitation. The comparative evaluation process for this Solicitation works as follows:

(1) Check that Quotes are Complete: All quotes received by the deadline will be reviewed by the

Contracting Officer to ensure that each quote addresses all of the five factors listed above and that

Administrative Information and Representations & Certifications are complete. Any quotes found to be incomplete will not receive any further consideration.

(2) Verification of Business: The Contracting Officer will verify that each business submitting a complete quote is: active in the System for Award Management without exclusions, as reported on

SAM.gov | Entity Information; is a small business for the NAICS code of this requirement, as reported under FAR 52.219-1 Small Business Program Representations, also at SAM.gov | Entity Information; and is verified as a Service-Disabled Veteran-Owned Small Business, as reported on the Small Business

Administration’s Veteran Small Business Certification (VetCert) website, at Veteran Small Business

Certification (sba.gov). Any business that fails to meet any of these verification requirements at the time SAM and VetCert are checked will not have its quote considered.

(3) Facility Evaluation: Complete quotes submitted by verified businesses will next have the Price

Schedule removed by the Contracting Officer before sending the remainder of the quote to the facility for evaluation of Technical Capability and Prior Experience. The reason for removing the Price Schedule is to have the facility focus solely on the Technical Capability and Prior Experience factors of each quote without regard to price in order to determine which business(es) is/are best able to provide the required services. Quotes are typically evaluated by the Contracting Officer’s Representative (COR), as well as other technical experts at the facility. The evaluators will determine the strengths and weaknesses of each quote and assign each quote an overall score, as follows:

• Superior: This quoter can meet all contract requirements and includes benefits advantageous to the government. We see no risk with this quoter.

• Good: This quoter can meet all contract requirements. We see little performance risk with this quoter.

• Borderline: This quoter may not be able to meet all contract requirements. We see performance risk with this quoter.

• Unacceptable: This quoter cannot meet all contract requirements. We see high performance risk with this quoter.

Quotes rated Superior and Good are acceptable and will receive further consideration. Quotes rated

Borderline and Unacceptable are not acceptable and will not receive any further consideration; the distinction between Borderline and Unacceptable is to provide constructive feedback to the business submitting the quote.

https://sam.gov/content/entity-information https://sam.gov/content/entity-information https://veterans.certify.sba.gov/ https://veterans.certify.sba.gov/

(4) Price Determination: Once the facility’s evaluation is complete, the Contracting Officer will reinsert the Price Schedule into each acceptable quote, including options as follows: The Government will evaluate offers for award purposes by adding the total price for all options (including optional Contract

Line Items, if applicable) to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. For the purposes of the award of this Contract, the Government intends to evaluate the option to extend services, provided under FAR

52.217-8, as follows: The evaluation will consider the possibility that the option can be exercised at any time, and can be exercised in increments of one to six months, but for no more than a total of six months during the life of the contract. The evaluation will assume that the prices for any option exercised under

FAR 52.217-8 will be at the same rates as those in effect under the contract. The evaluation will therefore assume that the addition of the price or prices of any possible extension or extensions under FAR 52.217-

8 to the total price for the basic requirement and the total price for the priced options has the same effect on the total price of all quotes relative to each other, and will not affect the ranking of quotes based on price, unless, after reviewing the quotes, the Government determines that there is a basis for finding otherwise. Evaluation of options shall not obligate the Government to exercise the option(s).

(5) Price Evaluation: Once the overall quote price has been determined (including options as set forth above), the facility in conjunction with the Contracting Officer will review the top-rated quotes against the overall price for each quote to determine which quote provides the overall best value to the

Government. A quote rated Superior does not automatically provide best value to the Government if the price is too high; there is often a trade-off between technical capability and price. Conversely, the lowest priced quote will not necessarily provide the best value to the Government if another quote provides better technical capability at a reasonably higher price.

(6) Contract Award: The business that submitted the quote that provides the best overall value to the

Government, even if that quote is not the lowest-priced quote within competitive and budgetary constraints, will be awarded the Contract. Conversely, if no quotes are found to meet the Government’s requirements, in the sole judgment of the facility and Contracting Officer, no award will be made from the quotes received. If no award is made, the Government, in its sole discretion, may issue a new

Solicitation or cancel this Solicitation without reissue.

Guidance on Section (5) Representations & Certifications

This section of Amendment 1 provides detailed guidance regarding submission of the

Representations & Certifications required in paragraph (5), above.

a. The certification required under VAAR 852.219-75 is found in Section C under this heading:

VAAR 852.219-75 VA NOTICE OF LIMITATIONS ON SUBCONTRACTING –

CERTIFICATE OF COMPLIANCE FOR SERVICES AND CONSTRUCTION

The certification it requires is found at the end of the clause:

Certification:

I hereby certify that if awarded the contract, [insert name of offeror___________________________] will comply with the limitations on subcontracting specified in this clause and in the resultant contract. I further certify that I am authorized to execute this certification on behalf of [insert name of offeror

Printed Name of Signee: _________________________________

Printed Title of Signee: ________________________________

Signature: ______________________________________________

Date: ___________________________________________________

Company Name and Address: _______________________________

By way of example, this certification may be submitted as follows:

Certification:

I hereby certify that if awarded the contract, ABC Corporation will comply with the limitations on subcontracting specified in this clause and in the resultant contract. I further certify that I am authorized to execute this certification on behalf of ABC Corporation.

Printed Name of Signee: John Doe

Printed Title of Signee: President, ABC Corporation

Signature: Digitally Signed /John Doe/

Date: December 8, 2021

Company Name and Address: ABC Corporation

123 Main Street, Anytown, Illinois 54321

b. The next requirement is a representation found in Section E, FAR 52.204-24(d):

52.204-24 REPRESENTATION REGARDING CERTAIN

TELECOMMUNICATIONS AND VIDEO SURVEILLANCE SERVICES OR

EQUIPMENT

The first paragraph of FAR 52.204-24 states:

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it ‘‘does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument’’ in paragraph

(c)(1) in the provision at 52.204–26, Covered Telecommunications Equipment or

Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212–3, Offeror

Representations and Certifications–Commercial Items. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it

‘‘does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services’’ in paragraph (c)(2) of the provision at 52.204–26, or in paragraph (v)(2)(ii) of the provision at 52.212–3.

What this paragraph means is that you do not complete the representations set forth in subparagraph

52.204-24(d) if your company has already made those representations with its SAM registration. You can check your company’s SAM registration via SAM.gov | Entity Information. Under your company’s entity information page, there will be a menu on the left side where you can check the current Representations and Certifications made with your SAM registration:

Under that list of Reps and Certs, you should find the representation made for FAR 52.204–26, as referenced in the first paragraph of FAR 52.204-24, above. Click on the hyperlink for 52.204-26, and it will provide the representation made for your company. Here is an example:

https://sam.gov/content/entity-information

In this case, the quote does not require the FAR 52.204-24(d) representations be completed. Instead, the quote should reference the company’s SAM registration and the representations already made under FAR

52.204-26.

c. The final requirement is also found under Section E, FAR 52.212-3:

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS—

COMMERCIAL ITEMS

The first paragraph on FAR 52.212-3 states:

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for

Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.

Current SAM registration is a requirement for contract award; this requirement cannot be waived.

Accordingly, assuming that your company’s SAM registration is current, you will reference FAR 52.212-

3(b), which states:

(b)(1) Annual Representations and Certifications. Any changes provided by the Offeror in paragraph (b)(2) of this provision do not automatically change the representations and certifications in SAM.

(2) The offeror has completed the annual representations and certifications electronically in SAM accessed through http://www.sam.gov. After reviewing SAM information, the

Offeror verifies by submission of this offer that the representations and certifications currently posted electronically at FAR 52.212–3, Offeror Representations and

Certifications—Commercial Items, have been entered or updated in the last 12 months, are current, accurate, complete, and applicable to this solicitation (including the business size standard(s) applicable to the NAICS code(s) referenced for this solicitation), at the time this offer is submitted and are incorporated in this offer by reference (see FAR 4.1201), except for paragraphs _______________.

In other words, if no representations and certifications made for your company’s annual SAM registration have changed, you do not need to submit anything more for this paragraph. If, however, a representation or certification needs to be updated, you need to update it here, as well as in SAM.

In summary, section (5) Representations & Certifications requires the following:

(1) a completed VAAR 852.219-75 certification;

(2) a statement that the representation made for FAR 52.204-26 of your company’s SAM registration is current, and therefore a FAR 52.204-24 representation is not required; and

(3) a statement that the representations and certifications made for your company’s SAM registration are current, unless there is a representation or certification that needs to be updated.
