b. Complete the representation found under provision FAR 52.204-24(d), Representation Regarding
Certain Telecommunications and Video Surveillance Services or Equipment, found in Section E.
c. Complete the representations and certifications as directed under provision FAR 52.212-3, Offeror
Representations and Certifications – Commercial Items, found in Section E.
Guidance on Section (6) Representations & Certifications
This section of Amendment 1 provides detailed guidance regarding submission of the
Representations & Certifications required in paragraph (6), above.
The first certification to be completed, VAAR 852.219-77, is found in Section C under this heading:
C.10 VAAR 852.219-77 VA NOTICE OF LIMITATIONS ON
SUBCONTRACTING – CERTIFICATE OF COMPLIANCE FOR SERVICES
AND CONSTRUCTION (SEP 2021) (DEVIATION)
The certification it requires is found at the end of the clause:
Certification:
I hereby certify that if awarded the contract, [insert name of offeror___________________________] will comply with the limitations on subcontracting specified in this clause and in the resultant contract. I further certify that I am authorized to execute this certification on behalf of [insert name of offeror
Printed Name of Signee: _________________________________
Printed Title of Signee: ________________________________
Signature: ______________________________________________
Date: ___________________________________________________
Company Name and Address: _______________________________
By way of example, this certification may be submitted as follows:
Certification:
I hereby certify that if awarded the contract, ABC Corporation will comply with the limitations on subcontracting specified in this clause and in the resultant contract. I further certify that I am authorized to execute this certification on behalf of ABC Corporation.
Printed Name of Signee: John Doe
Printed Title of Signee: President, ABC Corporation
Signature: Digitally Signed /John Doe/
Date: December 8, 2021
Company Name and Address: ABC Corporation
123 Main Street, Anytown, Illinois 54321
The next required certification is in Section E, FAR 52.204-24(d):
E.3 52.204-24 REPRESENTATION REGARDING CERTAIN
TELECOMMUNICATIONS AND VIDEO SURVEILLANCE SERVICES OR
EQUIPMENT (OCT 2020)
The first paragraph of FAR 52.204-24 states:
The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it ‘‘does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument’’ in paragraph
(c)(1) in the provision at 52.204–26, Covered Telecommunications Equipment or
Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212–3, Offeror
Representations and Certifications–Commercial Items. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it
‘‘does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services’’ in paragraph (c)(2) of the provision at 52.204–26, or in paragraph (v)(2)(ii) of the provision at 52.212–3. (Underlining added to paragraph.)
What this paragraph means is that you do not complete the representations set forth in subparagraph
52.204-24(d) if your company has already made those representations with its SAM registration. You can check your company’s SAM registration via https://sam.gov under Entity Information on the homepage https://sam.gov/ of that website. Under your company’s entity information page, there will be a menu on the left side where you can check the current Representations and Certifications made with your SAM registration:
Under that list of Reps and Certs, you should find the representation made for FAR 52.204–26, as referenced in the first paragraph of FAR 52.204-24, above. Click on the hyperlink for 52.204-26, and it will provide the representation made for your company. Here is an example:
In this case, the quote does not require the FAR 52.204-24(d) representations be completed. Instead, the quote should reference the company’s SAM registration and the representations already made under FAR
52.204-26.
The final representation required is also found under Section E, FAR 52.212-3:
E.7 52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS—
COMMERCIAL ITEMS (FEB 2021) (JUL 2020) (DEVIATION)
The first paragraph on FAR 52.212-3 states:
The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for
Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.
Current SAM registration is a requirement for contract award; this requirement cannot be waived.
Accordingly, assuming that your company’s SAM registration is current, you will reference FAR 52.212-
3(b), which states:
(b)(1) Annual Representations and Certifications. Any changes provided by the Offeror in paragraph (b)(2) of this provision do not automatically change the representations and certifications in SAM.
(2) The offeror has completed the annual representations and certifications electronically in SAM accessed through http://www.sam.gov. After reviewing SAM information, the
Offeror verifies by submission of this offer that the representations and certifications currently posted electronically at FAR 52.212–3, Offeror Representations and
Certifications—Commercial Items, have been entered or updated in the last 12 months, are current, accurate, complete, and applicable to this solicitation (including the business size standard(s) applicable to the NAICS code(s) referenced for this solicitation), at the time this offer is submitted and are incorporated in this offer by reference (see FAR 4.1201), except for paragraphs _______________.
In other words, if no representations and certifications made for your company’s annual SAM registration have changed, you do not need to submit anything more for this paragraph. If, however, a representation or certification needs to be updated, you need to update it here, as well as in SAM.
In summary, section (6) Representations & Certifications requires the following:
(1) A completed VAAR 852.219-77 certification;
(2) A statement that the representation made for FAR 52.204-26 of your company’s SAM registration is current, and therefore no FAR 52.204-24 representation is required; and
(3) A statement that the representations and certifications made for your company’s SAM registration are current, unless there is a representation or certification that needs to be updated.

Questions & Answers
(1) Question: Is there an incumbent contractor?
Answer: No there is not; this is a new requirement.
(2) Question: Will a new contract be solicitated after this initial requirement?
Answer: JBVAMC does not anticipate another contract after fulfilling the current requirement, but the final decision will be dictated by circumstances at the ending of the proposed contract.
(3) Question: Is free parking available to the Contractor and its employees?
Answer: No. The best options are either parking on the street or in the Juvenile Center parking lot about one block away, currently costing $2.00 per day. JBVAMC parking currently costs $15.00 per day, and there are no validations or discounts available under the proposed contract.
(4) Question: Is the Contractor providing “Labor ONLY”?
Answer: Yes.
(5) Question: Is the Government responsible for providing Personal Protective Equipment to the
Contractor and its employees?
Answer: Yes.
(6) Question: Paragraph F. Staffing: Sub Paragraph 1 States: The Day Shift shall be comprised of no less than five (5) employees. Does this number include the Supervisor?
Answer: No.
(7) Question: Paragraph F. Staffing: Sub Paragraph 2 Sates; The Evening Shift shall be comprised of no less than fifteen (15) employees. Does this number include the Supervisor?
Answer: No.
(8) Question: Section B.1, Paragraph 8 SECURITY & PRIVACY CONTROL, Subparagraph (a) states:
“All contractor employees are subject to the same level of investigation as VA employees who have access to VA Sensitive Information. The level of background investigation commensurate with the level of access needed to perform in accordance with the Performance Work Statement is the
Special Agreement Check (SAC).” Are Contractor employees able to work while awaiting results of the background investigation?
Answer: This question is still being considered by JBVAMC police/security. The awardee will not be held liable for any delays in performance caused by the background investigation/badging process, so long as the Contractor and its employees cooperate fully and in good faith with
JBVAMC police/security personnel in moving the process forward as expeditiously as possible.
(9) Question: Can you verify if the Jesse Brown VA Medical Center will provide the material under
Section B.3, Paragraph G? (For reference, Paragraph G states: “Provided by JBVAMC: JBVAMC will provide: lotion soap, hand lotion, plastic trash can liners, paper towel rolls for dispensers, coreless JRT toilet paper rolls, tampons, feminine napkins, and feminine napkin bins. All
FDA/EPA-approved disinfectants used in cleaning the facility. All equipment used in cleaning / disinfecting to include: disposable microfiber mops and rags, no cotton materials will be used for cleaning, housekeeping carts set-up per JBVAMC standard SOP. Gloves and masks will be provided.”)
Answer: No outside equipment or products necessary; everything under Paragraph G will be provided.
(10) Question: I do not see union language in the contract; is this a union job?
Answer: This is not a per se union job, but there is potential for government unions to become involved if a conflict arises between JBVAMC staff and the Contractor.
