• Schedule. The schedule of work is estimated to take 120 days.

• Coordination. The Contracting Officer Representative (COR) will serve as the focal point for the abatement.

a. The Contractor must pre–coordinate work. All abatement work will be coordinated between the COR, the Project Monitor, and the Contractor. The Contractor shall ensure sufficient staff to meet the time constraints.

b. The COR will be immediately notified whenever work associated with this project, or related activities interfere with normal VAMC operations.

• Specific Requirements. The Contractors work shall include:

a. Contractor shall construct full containment with -0.02 inches of water pressure differential. The room shall remain under negative pressure until clearance has been achieved. The negative air machine (NAM) must be vented outside of the building or into additional filters.

b. Contractor will vacuum HEPA or wipe down all surfaces inside the contained work area (studs, concrete masonry units, pipes, ductwork, etc.).

c. Abatement Contractor shall submit evidence of current applicable training, current medical clearance for respiratory protection, current fit test records, and current licensure for all personnel working on this project. Contractor shall submit current company licensure for all work being performed.

d. Material submittals shall be submitted for the chemicals to be used on this project within 5 days of the award of the project.

e. An abatement notification may be necessary for the insulation abatement. If so, an emergency waiver request will be provided by the Facility for the Contractor to submit with their abatement notification.

f. Personnel working on this project shall have current OSHA 10-hour Construction Industry Training.

g. Conduct all work in accordance with applicable Federal and State regulations and the Infection Control Risk Assessment (ICRA).

h. Post “Construction Area – Do Not Enter” signs and the appropriate asbestos warning signs, as well as the ICRA, on the entrance to the containment.

i. Seal off HVAC supply and returns in the work area. Seal off any penetrations in the work area.

j. Contractor will check-in and coordinate work areas and times with the COR located in Building 74, Room 125J.

k. Vendor will provide cleanup and debris removal (via a covered cart), return the key, and check out with the COR when job is completed. Dumpster(s) to be provided at Contractor’s expense and shall be placed in a location indicated by COR. Any damages from dumpster placement shall be repaired to pre-existing or better at the Contractor’s expense.

l. When clearance has been achieved, notify the Safety Service to inspect and accept all work.

m. Provide the COR with the hazardous materials waste manifest within 45 days of completion.

n. Provide the COR all documentation and warranty information concerning installed components and work accomplished.

o. Ensure all invoicing documents are submitted in-accordance with the instructions provided in the formal contract.

Other Station Rules and Guidelines. The Contractor will adhere to the following station rules.

a. All work will be accomplished to industry standards and compliant with all current CODE requirements (Life Safety, NFPA, Electrical, and Building). All Department of Veteran Affairs, Federal regulations, and codes will be complied with.

b. This is a hospital environment. The Contractor and his personnel are expected to be appropriately dressed (preferably uniformed) and to conduct themselves professionally, with a minimum amount of noise.

c. This is a federal facility as well as a medical center. As such, there is NO tobacco usage allowed inside any federal building or on the grounds. Failure to follow these regulations can result in removal of the worker or Contractor from the facility and/or a US Magistrate’s ticket and fine.

d. The Contractor will be responsible for ensuring that all the employees and other personnel visiting the work site have and are using the appropriate Personal Protective Equipment (PPE) that addresses the hazards found at the site. The Contractor will be responsible for the upkeep, issue, and training for the PPE used and maintaining all required documentation. Full compliance with OSHA regulations regarding PPE is expected.

INFORMATION REGARDING BIDDING MATERIAL, BID GUARANTEE

a) If the bid/offer exceeds $150,000, an offer guarantee is required in an amount not less than twenty (20) percent of the bid/offer price or $3M, whichever is less.

INSTRUCTIONS TO OFFERORS FOR BID PREPARATION

THIS SECTION IS FOR SOLICITATION PURPOSES ONLY. THIS SECTION WILL BE

PHYSICALLY REMOVED FROM ANY RESULTANT AWARD BUT WILL BE DEEMED

INCORPORATED BY REFERENCE.

SUBMISSION OF PROPOSAL: The offeror shall submit the following in this order:

C. NAICS: The NAICS Code for this procurement is 562910 – Remediation Services; Size Standard: $25 Million.

D. SDVOSB SET-ASIDE: Effective June 20, 2007, Public Law 109-461, the Veterans Benefits, Health Care, and Information Technology Act of 2006 allow procurements to be set-aside for SDVOSBs and VOSBs. This procurement is 100% set-aside for Service-Disabled, Veteran- Owned Small Business (SDVOSB). Bids are solicited only from SDVOSB concerns and bids received from concerns that are not SDVOSB concerns shall be rejected. In order to be considered, the firm must be shown on the Veteran Small Business Certification (sba.gov) website as verified at the time of submission of their bid. No award can be made unless the vendor is registered.

E. Plans/Drawings/Specifications: Contractors are responsible for ensuring that any construction document package used for Proposals or construction is complete and up to date.

F. RESIDENT PROJECT ENGINEER: All references to "Resident Project Engineer" in the Solicitation shall be intended for the Contracting Officer’s Representative or “COR.”

G. GENDER: Wherever masculine gender is used in the Solicitation and contract documents; it shall be considered to include both masculine and feminine.

H. DEPARTMENT OF VETERANS AFFAIRS: All references to "Veteran's Administration" or "VA" in the Solicitation are intended for Department of Veterans Affairs.

I. METRIC PRODUCTS: Products manufactured to metric dimensions will be considered on an equal basis with those manufactured using inch-pound units, providing they fall within the tolerances specified using conversion tables and contained in the latest revision of Federal Standard No. 376, and all other requirements of this document are met. If a product is manufactured to metric dimensions and those dimensions exceed the tolerances specified in inch-pound units, a request should be made to the Contracting Officer, in writing, to determine if the product is acceptable. The Contracting Officer, in contact with the Contracting Officer’s Representative (COR), will accept or reject the product.

J. CONTRACTOR RESPONSIBILITY: Contractor shall be required to complete all contract work and schedule a final inspection within the specified contract performance period.

Should the Contractor fail to complete the contract work (including scheduling of the final inspection), and it is determined by the Government to be a Contractor-caused delay, the Contractor shall be in default status. If the Government determines it to be in the best interest of the Government to allow the Contractor to continue to perform contract work, the Contractor shall provide equitable consideration to the Government for additional time granted for completion of contract work. Such agreement shall not be deemed a waiver of the Government’s right to terminate this contract in the event the Contractor fails to complete the contract work (including scheduling of the final inspection) on or before the completion date.

K. TRAINING: Effective July 1, 2005, all employees of the general contractor and subcontractors shall have the 10-hour OSHA certified construction safety course and/or other relevant competency training, as determined by the COR with input from the ICRA https://veterans.certify.sba.gov/#search

(Infection Control Risk Assessment) team. The General Contractor’s competent person shall have completed the 30-hour OSHA certified construction safety course.

Documentation of training shall be submitted to the Contracting Officer for review and approval prior to any work being performed. No ID badge will be issued to an employee who does not provide this documentation. There shall be no exceptions to this requirement.

L. TB TESTING: It is the responsibility of the contractor to provide TB training annually and a PPD test annually for any employee providing services at the Salem VAMC. The Government reserves the right to review the contractor’s records.

M. KEYS: All keys provided by the Contractor for use during the project shall be returned to the Contracting Officer's Representative (COR) at completion of the work or upon request. No keys shall be reproduced by the Contractor. There shall be a charge of $25.00 for each key that is lost or not returned to the COR. Payment shall be made to the Salem VA Medical Center, Salem, VA upon receipt of a Bill of Collection.

N. PREPARATION OF BIDS/OFFERS/PROPOSALS: Neither the VAMC nor the VISN 6 NCO will pay for any costs incurred in preparation and submission of bids or Proposals.

O. PRIVACY AND CONFIDENTIALITY: Contractors to the Department of Veteran Affairs may be unintentionally exposed to sensitive information. Information may be overheard, seen on documents or electronic devices, or observed that could potentially violate the privacy and confidentiality of our veterans, employees, volunteers, and their families. Regulations such as but not limited to the Health Insurance Portability and Accountability Act of 1996 (HIPAA), Freedom of Information Act (FOIA) and Privacy Act of 1974 have been enacted to protect sensitive information from being improperly disclosed. Information should not be divulged or released to anyone unless specifically authorized by this contract or its’ attached documents in accordance with the contracted services. Failure to comply with applicable statutes and regulations can result in the termination of this contract and civil and criminal penalties, including fines and imprisonment. All suspected or actual breeches of privacy and confidentiality should be reported immediately to the Contracting Officer, Contracting Officer’s Representative (COR) or the Facility Privacy Officer. The C&A requirements do not apply, and a Security Accreditation Package is not required. If the contractor opts to use a computer or computer system for processing contract documents, the requirements of FIPS 140-2 for encryption of contract documents must be met.

P. VETS 4212: Title 38, USC Section 4212(d) and Public Law 105-339, requires that federal contractors report, at least annually, the number and category of veterans who are within their workforce. Submission of the VETS 100 reporting information can be done electronically at: VETS 4212

Q. SYSTEM FOR AWARD MANAGEMENT (SAM): Federal Acquisition Regulations require that federal contractors register in the System for Award Management (SAM) database at http://www.sam.gov and enter all mandatory information into the system. (a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

A.6 52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT—

CONSTRUCTION MATERIALS (MAY 2014)

(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material,"

"domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials"

(Federal Acquisition Regulation (FAR) clause 52.225-9).

(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the

Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.

(c) Evaluation of offers.

(1) The Government will evaluate an offer requesting exception to the requirements of the

Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers.

(1) When an offer includes foreign solicitation in paragraph (b)(2) of the clause at FAR

52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.

(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—

(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the

Offeror has represented that it ‘‘does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument’’ in paragraph (c)(1) in the provision at

52.204–26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v)(2)(i) of the provision at 52.212–3, Offeror Representations and Certifications–

Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it ‘‘does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services’’ in paragraph (c)(2) of the provision at 52.204–26, or in paragraph (v)(2)(ii) of the provision at 52.212–3.

(b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization

Act for Fiscal Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after

August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal

Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.

Nothing in the prohibition shall be construed to—

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award

Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services.”

(d) Representations. The Offeror represents that—

(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or

(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
