COMPLEMENTARY TECHNICAL STANDARD NTC: 002- 2016

REVISION 001

SUBJECT: REQUIREMENTS FOR THE INFORMATION SUBMITTED THROUGH THE PASSENGER
ADVANCE INFORMATION SYSTEM (APIS)
1. BACKGROUND
In recent years the number of passengers transported by air from, to or in transit through Peru has increased steadily and significantly, which fact has led to an increase in border control tasks.
An increase in the number of passengers also entails an increase of the threats posed by criminals or criminal organizations involved in national or international terrorism, trafficking of immigrants or trafficking in persons, international traffic of goods, contraband, customs fraud and other crimes and customs offenses. These criminals use air transport to achieve their illegal objectives.
In order to meet the increased requirement for control tasks, it is necessary to put in place an information system that provides passenger biographical data in advance, in order to determine if the person in question requires a particular treatment for entry to or exit from the country, through a comparison of their personal data against the government’s data bases.
This solution, already successfully implemented in various nations around the world, will allow the National
Superintendence of Migrations and the National Superintendence of Customs and Tax Administration to have information that allows them to anticipate threats, manage risk indicators and target their resources so that, when appropriate, coordinated pertinent actions will be taken in order to improve border controls.
To successfully implement this system, and in order to ensure its standardization, information must be sent that complies with industry standards, for which it is necessary to enforce the rules and recommendations made by the
International Civil Aviation Organization (ICAO) included in the provisions under Annex 09 - Facilitation of the
International Civil Aviation Convention, as well as the ICAO / IATA / OMA API Guide.
Annex 9 establishes in standard 3.48 that each Contracting State that introduces an Advanced Passenger
Information System (APIS) in its national legislation will enforce recognized international standards for the anticipated transmission of passenger information.
Bearing this in mind, it is necessary to ensure that the advance information on the persons on board and the means of transport shall be transmitted electronically by the carrier pursuant to the requirements of the Passenger
Information System.
Annex 9 in standard 3.48.1 also states that in specifying the passengers’ identification information to be transmitted, the Contracting States will only require the elements of data that are available in the machine-readable travel documents, pursuant to the specifications included in Document 9303 (series), Machine Readable Travel
Documents. All the information required will be in accordance with the specifications contained in the Guidelines on Advance Passenger Information prepared jointly by the World Customs Organization (WCO), the International
Airline Association (IATA) and the International Civil Aviation Organization (ICAO).
United Nations’ Security Council Resolution 2178 requires, inter alia, Member States to prevent persons suspected of being terrorists from entering or passing through their territory. It urges Member States to require air carriers operating in their territories to provide advance information about passengers to competent national authorities in order to detect departures from their territory, or attempted entries or transit through it using civilian aircraft, and of the persons designated by the Security Council Committee, as prescribed in Resolutions 1267
(1999) and 1989 (2011) relating to Al-Qaeda and their associated persons and entities.
