Belle Fourche Road Maintenance South Dakota

FOREWORD

The Belle Fourche Reservoir is approximately 8 miles east of the City of Belle Fourche in Butte County, South Dakota. The Bureau of Reclamation has approximately 38 miles of road around Belle Fourche Reservoir. The work consists of watering, scarifying, blading, shaping, compacting, cleaning, and mowing on roads owned and managed by the Bureau of Reclamation.

The work shall also include delivering and dressing government furnished gravel to Susie Peak Road.

TYPE OF CONTRACT:

This requirement is solicited as a/an Request for Proposal (RFP) using the Federal Acquisition Regulation Part 15 - Contracting by Negotiation. The Bureau of Reclamation anticipates the award of a Firm Fixed Price contract consisting of a base period plus four option periods.

MAGNITUDE OF PROJECT:

Between $250,000 and $500,000

METHOD OF SUBMISSION OF PROPOSALS:

BUSINESS SIZE COMPETITION REQUIREMENTS:

This acquisition is solicited as Total Small Business Set-Aside.

The applicable North American Industry Classification System (NAICS) Code is 237310- Highway, Street, and Bridge Construction. The Product Service code (PSC) is Z1LB- Maintenance of Highways, Roads, and Streets.

PRE-PROPOSAL SITE VISIT:

An organized virtual site visit has been scheduled for January 11, 2023 at 10:00am MDT via Teams. This is approximately 4 weeks after the Solicitation has been posted; December 19, 2022. RSVP to Micki at mfernandez@usbr.gov or Linda at lmelnick@usbr.gov.

NOTICE TO PROCEED: For planning purposes, the anticipated Notice to Proceed date will be on or about March 2023

SYSTEM FOR AWARD MANAGEMENT (SAM):

Effective October 2018 all contractors interested in doing business with the Federal Government must be registered in the System for Award Management (SAM) database when submitting an offer or quotation. Note: Registering in “SAM” does not constitute an automatic award of any contract or agreement to the registering contractor. SAM is a centralized database for consolidating the Central Contractor Registration (CCR), the online Representation and Certifications Application (ORCA), and the Excluded Parties List System (EPLS).

Additionally, the contractors “DUNS and BRADSTREET” and banking information are required for the SAM registration and annual confirmation requirements must be accomplished through the SAM website at https://www.sam.gov. For assistance with registering in SAM, contact the Federal Services Desk at 1-866-606-8220.

INVOICE PROCESSING PLATFORM (IPP):

Payment requests for the anticipated contract or agreement must be submitted electronically through the U.S. Department of Treasury’s “Invoice Processing Platform” (IPP) System via the IPP website at https://www.ipp.gov. Contractors are required to use the IPP website to access and use IPP for submitting request for payment. Registration assistance can be obtained by contacting the “IPP Production Helpdesk” via email ippgroup@bos.fbr.org or phone 1-866-973- 3131. If the contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the contractor can submit a waiver request in writing to the Contractor Officer with its proposal. Note: Waivers will be on a case by case basis and not automatically granted as determined by the Contract Officer.

B.1 PRICE SCHEDULE

A. Offers will be considered for award on the following schedule(s), but no offer will be considered for award on only a part of the schedule(s).

a. Offerors shall complete Price Schedule base period which will be good for this year as well as each option period. Offers for less than all schedules solicited will be considered nonresponsive and will not be evaluated for award.

b. Offers will be evaluated based on the total price of government chosen schedules based on funding availability and need each year. Award will be made to the responsible offeror submitting a proposal which conforms to the solicitation and is most advantageous to the Government considering the factors.

c. This is a multi-year contract consisting of five project years. Contract award will be made on the Schedule Base Period year, however 4 optional periods, following the original contract base year, may be further awarded at the option of the Government, based on quality of work, available funds, and need for each schedule.

B. All offers are subject to the terms and conditions of this solicitation.

C. The quantities in the schedule are estimated quantities for comparison of offers only, and except as provided in the contract clause at FAR 52.211-18, Variation in Estimated Quantity, no claim shall be made against the Government for overruns or underruns.

1.01 LOCATION

The location of the work is at the Belle Fourche Reservoir located 8.5 miles northeast of Belle Fourche, South Dakota in Butte County. The Bureau of Reclamation has approximately 38 miles of road around Belle Fourche Reservoir. Maintenance shall be performed on the roads and parking areas shown in Table 01 11 00A. The location of the Roads and Jeremiason Fishing Access Parking to be worked on under this contract is provided in Appendix A on the map titled “Belle Fourche Reservoir Road Maintenance Butte County, South Dakota”.

1.02 PRINCIPAL COMPONENTS OF WORK

A. Watering, scarifying and blading approximately 15.5 miles of Belle Fourche Reservoir roads as well as two gravel parking areas.

B. Mowing approximately 31 miles of roadside shoulders.

C. Load, transport, deliver, and dress government supplied gravel as needed.

D. Onsite work is to commence three weeks before each of the scheduled completion dates specified in the bid schedule. In the event of severe or wet weather, the Contracting Officer and/or COR will have authority to suspend work until such time that, in their opinion work may resume, in order to minimize damage or rutting of the travel routes.

E. Contractor will be responsible to repair or restore any damage caused by their work to the surrounding property to the satisfaction of the Contracting Officer and/or COR.

Contractor’s work that causes damage to adjacent roads such as the paved portion of Fisherman Road or adjacent county roads will be the responsibility of the Contractor to repair or restore any damage.

C. Where specifications are written in streamlined form, the words “shall be” are included by inference where a colon (:) is used within the sentence or phrase.

1.04 DEFINITIONS

A. When the specifications use a word or term defined in the Federal Acquisition Regulations (FAR), the definition of the word or term shall be in accordance with FAR sections in effect at the time the solicitation was issued.

B. Quality Assurance: Inspection and tests performed by Government to ensure compliance with the terms of the contract.

C. Quality Control: Activities performed by Contractor to ensure work conforms to contract requirements.

D. Contractor Quality Testing: Specified tests to be performed by the Contractor.

1. The Government may use the test results for Quality Assurance.

2. The Contractor may use the test results as part of Contractor quality control.

USE OF SITE

PART 1 GENERAL

1.01 MEASUREMENT AND PAYMENT

A. Cost:

1. Include in prices offered in the schedule for other items of work.

1.02 PROJECT CONDITIONS

A. Government land available for Contractor use as a staging area for contractor will be permitted as approved by the Contracting Officer.

B. When private land is used for construction facilities, or other construction purposes, make necessary arrangements associated with use of private land.

C. Location, construction, operation, maintenance, and removal of construction facilities on Government land will be subject to approval of the COR.

D. Do not interfere with work of other contractors or the Government in vicinity, or with reservations made by the Government for use of such land.

E. Housing for construction personnel will not be permitted on Government land, except housing for guards or watchmen as may be approved by the COR.

3.01 CLEANING

A. Construction equipment: Before bringing on site, clean construction equipment to remove dirt, vegetation, and other organic material to prevent introduction of noxious weeds, and invasive plant and animal species.

3.02 RESTORATION

A. Restore temporary construction roads to original contours and make impassable to vehicular traffic when no longer required.

B. After completion of work, scarify and blade Government land used for construction purposes and not required for completed installation so that surfaces blend with natural terrain and are in a condition that will facilitate natural revegetation, provide proper drainage, and prevent erosion.

SECTION 01 33 00

SUBMITTALS

PART 1 GENERAL

1.01 MEASUREMENT AND PAYMENT

A. Cost:

1. Include in prices offered in the schedule for other items of work requiring submittals.

1.02 DEFINITIONS

A. Days: Calendar days.

B. Required Submittal Number (RSN): Identifies items to be submitted together as a complete submittal.

1.03 SUBMITTAL REQUIREMENTS

A. In case of conflict between requirements of this section and requirements included elsewhere in these specifications, requirements included elsewhere take precedence.

B. General:

1. Prepare in English.

2. Label with contract number and title, and RSN.

3. Measurement units: US Customary Units.

4. Provide a unique transmittal number for each submittal.

C. Samples Submittals:

1. Label with complete manufacturer’s product and color identification.

2. Include type and quantity of materials specified in the referenced section in each “set” of samples.

D. Certifications:

1. Sign and seal submittals by registered professional.

2. Manufacturer’s certifications: Signed by authorized representative of manufacturer.

1.04 SUBMITTALS PROCEDURES

A. Submit only checked submittals. Submittals without evidence of Contractor's approval will be returned for resubmission.

B. Submit complete sets of required materials for each RSN as specified in “Submittals Required” column in Table 01 33 00A - List of Submittals. A complete set includes all listed items for RSNs with multiple parts.

C. Submit number of sets specified in “No. of sets to be sent to:” columns in Table 01 33 00A - List of Submittals.

D. Include the following information in transmittal letters:

1. Contract number and title.

2. RSN for each attached submittal.

3. Responsible code.

4. Number of sets for each RSN.

5. Identify submittal as initial or resubmittal.

E. Electronic submittals:

a. In Portable Document Format (PDF).

1) Optical Character Recognition (OCR).

2) 508 compliant.

3) RSNs having more than one requirement shall be bookmarked.

4) RSNs with requirements for files other than PDF (e.g. XER,.PLF, .DWGs, etc.) shall be combined using WINZip.

b. Personally Identifiable Information (PII) shall be encrypted using WINZip before transmitting electronically.

F. More than one RSN may be submitted under a transmittal letter.

G. All submittals shall be submitted for approval in accordance with Table 01 33 00A – List of Submittals.

H. Test results for Acceptance Testing submittals should be submitted no later than 3 calendar days after the test was performed. If the test(s) fail, then the results should be submitted within 4 hours.

1.05 REVIEW OF SUBMITTALS

A. Time Required:

01 33 00 - 3

1. Submittal review will require 21 days for review of each submittal or re-submittal, unless otherwise specified.

2. Time required for review of each submittal or re-submittal begins when complete sets of materials required for a particular RSN are received and extends through return mailing postmark date.

B. Time in Excess of Specified:

1. The CO may extend the contract completion date to allow additional time for completing work affected by excess review time.

a. The time extension will be to the extent that excess review time caused delay to the contract completion date.

b. The time extension will not exceed the time used in excess of the specified number of days for review of submittals or re-submittals.

c. Concurrent days of excess review time resulting from review of two or more separate submittals or re-submittals will be counted only once in extending the contract completion date.

2. No time extension will be allowed if the Contractor fails to make complete approval submittals in sequence and within time periods specified.

3. Adjustment for delay will be made only to the extent that:

a. Approval was required under the contract, and

b. Requests for approval were properly and timely submitted and were approved.

4. Adjustment will be subject to terms of paragraphs (b) and (c) of the clause at FAR 52.242-14, Suspension of Work, however, no such delay shall be deemed to be a “suspension order” as the term is used in that clause.

C. Return of Submittals:

1. One set of submittals required for approval will be returned either approved, approved subject to identified changes, or not approved.

a. Revise and resubmit for approval.

b. Show changes and revisions with revision date.

c. Describe reasons for significant changes in transmittal letter.
