MAD MAX MASTICATION PROJECT, BUREAU OF LAND MANAGEMENT, FREEMONT
COUNTY, WYOMING
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement and attachments constitute the only solicitation; quotes are being requested and a written solicitation will not be issued. Consider this solicitation (140L3724Q0070) as a Request for Quotes (RFQ). This solicitation documents incorporate provisions and clauses in effect through Federal acquisition Circular 2019-03. This solicitation is set-aside for small business. NAICS 115310 – Support Activities for Forestry
– Fuels Management Services. The small business size standard is $34.0 million. Product Service Code F014 – Natural Resources / Conservation – Tree Thinning. The resulting purchase order will be a firm-fixed price type contract. (SEE ATTACHMENTS FOR COMPLETE PERFORMANCE WORK

In accordance with the procedures in FAR Part 12 and 13, RFQ 140L3724Q0070 is available for viewing through electronic commerce via Bureau of Land Management's website at https://sam.gov.
The Government will award a purchase order resulting from this solicitation to the responsible offeror whose offer is conforming to the solicitation and provides the best value to the Government on a Lowest Price Technically Acceptable. To be considered for award, please review and comply with provision 52.212-1(a) Evaluation Factors, SF1449, and the Price Bid Schedule by the due date of this solicitation.
Quotes are due Monday, April 15, 2024, by 3:00 p.m. Mountain Time. Contractors shall submit quotes by email to lneely@blm.gov.

Mad Max Mastication Precommercial Thinning
PERFORMANCE WORK STATEMENT
I. Introduction and Background
The Contractor shall implement precommercial mastication thinning using a masticating head on equipment with rubber tracks that produce not more than five (5) pounds of ground pressure per square inch, on seven (7) regenerated timber sale units totaling 100 acres. All seven (7) units are located on Green Mountain, Wyoming.
These units were clearcut harvested in the late 1980’s and early 1990’s and have regenerated with even aged lodgepole pine that is now approximately 25 – 35 feet tall with average diameter at root collar 2 – 10 inches. The current stocking per acre varies greatly, from just a few stems per acre to thousands per acre.
Slopes range from 20% – 45%. Prospective contractors should be aware that Unit 3 was previously attempted, and the equipment operator was unable to work in the unit due to slopes up to 45%. Units 5, 6, and 7 also have slopes up to 45%. On-site visits to the project areas are strongly recommended prior to bidding on this solicitation.
Access roads are gravel and dirt. Some may be impassable during periods of wet weather. Units 4, 6, and 7 are inaccessible to access by pickup trucks.
Unit acreage is as follows:

II. Project Location and Scope
Project is in central Wyoming, on Green Mountain in Fremont County, approximately 10 miles south of Jeffrey City, and approximately halfway between Riverton and Rawlins. Access to the site is by secondary gravel and dirt roads open to public travel from June 15 – November 30 each year. From Jeffrey City, proceed approximately 6 miles east along Highway 287. Turn south at Green Mountain Road (BLM Road 2411), an improved gravel road, and use the provided maps to locate the secondary dirt roads leading to inventory units. Contractor shall not drive off existing roads or outside of unit boundaries.
III. Performance Work Statement
The contractor shall furnish all tools, labor, supervision, equipment, materials, supplies, transportation, and incidentals necessary to precommercial thin in accordance with these specifications. The BLM reserves the right to expand or reduce the proposed project area depending upon budget and other constraints as well as establishing priority areas for treatment.
All communications with the Contracting Officer and the Contracting Officer’s Representative shall be done using the English language.
Unit boundaries are unmarked. Contractor shall use Avenza Maps or a similar mapping app to create geo-referenced unit maps and determine unit boundaries while working.
1. Selection of Residual Leave Trees within the Treatment Area Boundaries
a. The prescribed number of acceptable leave trees is not less than 109 to not more than 194 per acre, which will result in an average spacing ranging from fifteen (15) feet to twenty (20) feet. Spacing is a guide only and may be adjusted to leave the best trees. Trees less than 24 inches in height are not included in the spacing. Where brush, grass, or rock create non-stocked openings greater than 25 feet in diameter, leave trees will be spaced ten (10) feet apart on the perimeter of the non-stocked area. The residual leave tree species selection shall favor limber pine over lodgepole pine (all units are likely 100% lodgepole pine but if a limber pine is present, retain it for diversity.) Selection of residual leave trees shall include consideration of the combination of species, dominance, form, and spacing. If aspen is present, it shall not be cut or included in the spacing.
2. Selection and Treatment of Trees to be Cut within the Treatment Area Boundaries All trees within the treatment area boundaries > two (2) feet tall that are not selected as residual leave trees shall be masticated using a masticating head on equipment with rubber tracks that produce not more than five (5) pounds of ground pressure per square inch. All trees to be masticated shall be completely severed from the stump. Stump height shall not exceed six inches measured on the uphill side. No live limbs shall be left attached to the stump of masticated trees.
Leave trees shall be protected from damage during operations.
Slash shall be immediately removed from existing roads, watercourses, existing slash-free fuel breaks, power line and telephone rights-of-way, private land, and from within 10 feet of property corners. The slash requirements only include slash created by the cutting activity.
3. Contractor-furnished property and services: The contractor shall provide all labor, equipment, supervision, transportation, operating supplies and incidentals to perform the cutting and slashing services in accordance with the specifications, terms and conditions contained herein.
4. Security of equipment and property: The Contractor may leave equipment at the work site. The Contractor shall be responsible for equipment if it should be lost, stolen or damaged.
5. Protection of Improvements: The contractor shall not operate vehicles or equipment outside the unit boundaries or off existing roads and trails shown on the project location maps without prior written authorization from the Contracting Officer. Vehicles or equipment shall not be operated when ground or weather conditions cause or lead to rutting of soil. Such conditions usually develop where frozen ground is thawing, when snow is melting, and during or immediately following rain.
IV. Government Supplied Property
The following are supplied with this solicitation:
1. Large-scale vicinity map of the Jeffrey City/Green Mountain area
2. Maps of precommercial thinning unit boundaries.
3. Shapefiles of precommercial thinning unit boundaries.
V. Funding/Schedule
The period of performance shall be from September 1, 2024 – November 30, 2024.
VI. Evaluation Factors
Lowest Price Technically Acceptable
1. Past Performance: Include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information.
2. Technical Proposal: Technical Capability and Experience: The quote shall include a description of your technical approach and expected timeframe to complete the project, equipment, supervision, and personnel. Include a commitment to keep the project manager/crew foremen on site for the duration of the project and communicate to the COR/PI the technical aspects of the project. In addition, please explain how the contractor and manager are qualified to successfully complete the tasks illustrated in the Performance Work Statement (PWS). Describe the equipment that will be used for the job, that is suitable for the job and capable of working on slopes up to 45%, and in good mechanical condition to prevent any long delays in completing the work.
3. Price: Provide price per acre as well as total cost of the project using the attached Price Bid Schedule. Award will be made to the responsible offeror whose proposal meets all the technical requirements of the PWS, has acceptable past performance, and is lowest priced. By submission of its quote an offeror certifies that it will meet all the requirements and perform all the services listed in the PWS unless the quote clearly states otherwise. The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described as described in FAR 15.306(a)). Therefore, the offeror's initial proposal should contain the offeror's best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.

DIAR 1452.201-70 AUTHORITIES AND DELEGATIONS (SEP 2011)
(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.
(c) The COR is not authorized to perform, formally or informally, any of the following actions:
(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;
(2) Waive or agree to modification of the delivery schedule;
(3) Make any final decision on any contract matter subject to the Disputes Clause;
(4) Terminate, for any reason, the Contractor's right to proceed;
(5) Obligate in any way, the payment of money by the Government.
(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence.
Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.
(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.
(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.
(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

(a) Definitions. As used in this clause– Covered contractor information system means an information system that is owned or operated by a contractor that processes, stores, or transmits Federal contract information.
Federal contract information means information, not intended for public release, that http://www.ipp.gov/ mailto:IPPCustomerSupport@fiscal.treasury.gov is provided by or generated for the Government under a contract to develop or deliver a product or service to the Government, but not including information provided by the Government to the public (such as on public websites) or simple transactional information, such as necessary to process payments.

Requirements and procedures for basic safeguarding of covered contractor information systems shall include, at a minimum, the following security controls:
(i) Limit information system access to authorized users, processes acting on behalf of authorized users, or devices (including other information systems).
(ii) Limit information system access to the types of transactions and functions that authorized users are permitted to execute.
(iii) Verify and control/limit connections to and use of external information systems.
(iv) Control information posted or processed on publicly accessible information systems.

The Contractor shall include the substance of this clause, including this paragraph (c), in subcontracts under this contract (including subcontracts for the acquisition of commercial items, other than commercially available off-the-shelf items), in which the subcontractor may have Federal contract information residing in or transiting through its information system.

(d) Comptroller General Examination of Record.
