1.0 PERFORMANCE WORK STATEMENT

1.1 Scope of Contract. Award of this solicitation will result in Firm-fixed Price contract. The Government is in need of road maintenance services and minor repair that will result in the proper mix of aggregates and fines to maintain aggregates on the road way, the elimination of ruts and potholes, maintenance and functionality of ditch-lines and water diversion structures, and removal of rocks, limbs and other debris from the road prism. The services covered in this contract include the furnishing of all labor, equipment, supervision, transportation, operating supplies, and incidentals necessary to perform in compliance with the terms, specifications, conditions, and provisions of this solicitation. This work will include road grading, scarification, clearing ditches, minor road repair, spot surfacing, watering and compaction, cleaning culvert catch basins and inlet/outlets, and any other related work necessary to meet the objectives.

Standard industry practice indicates use of an excavator or backhoe, vibratory roller, and motor grader with a 12 to 14 foot moldboard blade and scarifier to effectively perform this type of work.

The equipment used to perform this work shall meet safety standards and shall be in good mechanical condition.

1.2 Work Objective. Successful, quality performance will result in a travel way free of washboards, potholes, or other irregularities. The surface shall be smooth, compact, crowned or sloped to drain, and without segregation of the surfacing materials. Suitable materials have been recovered and incorporated. Unsuitable materials have been removed. Ditches and road surface drainage structures function efficiently. Shoulders are shaped to provide a smooth transition from the road surface and drain efficiently

1.3 Location and Description.

1.31 Work will be performed on approximately 10 miles of FSR 432, Ball Creek located on the Bonners Ferry Ranger District of the Idaho Panhandle National Forests. The Work Site is approximately 10 miles North East of the town of Bonners Ferry. The Work Site is Located in Township 63N Range 1W Sections 19, 20, 21, 22, 23, 24 and Township 63N Range 2W Sections 24, 25, 26, and 27, Boise Meridian. East Start of Project is the Start of FSR 432 at Boundary County Road 10 Westside Road in Section 24. West End of Project is FSR 432 at FSR 2489 Junction in Section 27.

2. CONTRACTOR WORK REQUIREMENTS

2.1 Moving of Equipment and Supplies. The moving of equipment and supplies to the job site shall be the contractor's responsibility and is incidental to Pay Item and no separate payment shall be made.

2.2 Replacement of Equipment. Contractor shall provide quality equipment capable of safely performing the work under the terms of the contract. All repairs are the total responsibility of the Contractor.

2.3 Equipment Performance Standards. Contractor shall make equipment available for inspection and approval before use.

The Contractor must satisfy all applicable OSHA and DOT requirements or certifications for the operation of offered equipment.

2.4 Pollution and Erosion Control. During all operations under this contract, the Contractor shall exercise reasonable measures to direct surface runoff water to stabilized waterways and to keep the drainage systems functioning effectively to prevent or minimize soil erosion and pollution of water and other resources. All refuse, including garbage, rubbish, and solid or liquid wastes from the Contractor's operations, including camps, parking areas, and equipment maintenance areas shall be stored and collected in a sanitary manner and disposed of in a State-approved sanitary landfill.

Oil from crankcases or gear boxes, equipment waste or spilled or excess fuel shall be placed in containers and removed from the work site and disposed of as approved and required by Federal, State and Local laws.

Equipment uses for operations in close proximity to streams or bodies of water will be required to meet more stringent requirements regarding seals and fittings that prevent the leaking of hydraulic fluids, lubricants and fuels. Failure to comply will result in immediate rejection of equipment.

2.5 Grading and Shaping. Performance of Road Maintenance includes grading and shaping the roadbed, including shoulders and turnouts and removing ruts, washes, slough, and other irregularities that prevent normal runoff from the road surface. Where equipment is used to remove excessive, large, or deleterious (damaging) material from the shaped road templet, material to be wasted shall not be placed in a drainage or within 300 feet of a live stream. The end result shall be the restoration and maintenance of the original cross section, grade and drainage of the road.

2.5.1 – Grading to restore surface without loss of aggregate/gravel surfacing or disturbance or loss of road base material. Performance on gravel surfaced road shall be accomplished so the base is not disturbed and no surface material is lost in ditches or over the road shoulders.

Grading of unsurfaced roads shall be performed so no base material is lost. Surface material shall be bladed from one edge of the road to the other in a berm in order to eliminate any segregation prior to spreading. Sections having segregated materials after spreading shall be reprocessed and spread.

Oversized material exceeding 6 inches in size removed by equipment shall be disposed of by side casting over the fill slope except within 100 feet each side of culverts, other stream crossings or within 300’ of a perennial stream that is inhabited by fish, 150’ from a perennial steam not inhabited by fish and 100’ from any intermittent stream.

No berm or ridge of any material shall be left along either shoulder of the roadbed unless directed by the Contracting Office or designated representative.

2.5.2 – Elimination of ruts, potholes, and washes. These defects shall be repaired by scarifying or cutting to the bottom of such defects to provide for uniform compaction of roadbed material.

Large rock or organic material removed from drainage facilities during cleaning process shall not be used as fill. High grading, or any method which merely fills depressions with loose material, does not eliminate the defect or provide for uniform compaction and is therefore not acceptable.

2.5.3 – Repair of Settlement sections shall be performed where possible by cutting from the roadbed on each end of the settled area and filling into the settled area to provide smooth transitions to adjacent road grades. If this will not accomplish the objective, the COR shall be informed.

2.5.4 - Grading and shaping operations shall not undercut road back slopes.

2.5.5 - Sections of roads constructed without roadside ditch shall be uniformly insloped or outsloped the entire width of the roadbed, unless otherwise specified on each individual task order (i.e. crowning). The inslope or outslope grade shall be a minimum of 2 percent and a maximum of 4 percent unless staked otherwise on the ground.

2.5.6 - Existing drainage dips shall be cleaned and the outslope grade restored to equal or exceed the gradient of the road.

2.5.7 - Sections of roads constructed with a roadside ditch shall be bladed and reshaped to maintain crown at centerline of the roadbed, or insloped except on curves where crown is omitted. Road cross section shall slope uniformly both ways from crown apex to shoulders at a minimum blade of 2 percent and a maximum blade of 4 percent.

2.5.8 - At the conclusion of the grading and shaping operations the roadbed shall be smoothed and dressed to produce a uniform grade and cross section and a surface free of hollows, depressions, and projections above the adjacent roadbed surface. No berm or ridge or any material shall be left along either shoulder of the roadbed unless directed by the COR.

2.6 Roller Compaction of Roadway, turnouts, and intersections. Adjust moisture content of roadway material to a moisture content suitable for compaction. Operate vibratory steel wheeled rollers with a minimum dynamic force of 30,000 pounds (130 kilonewtons) impact per vibration over the full width of each layer until there is no visible evidence for further consolidation.

2.7 Drainage Facilities - Cleaning and Repair

2.7.1 - Wood, rocks, and other debris shall be removed from roadside drainage ditches to provide unobstructed flow of water and disposed of on the jobsite as directed by the Contracting Officer's Representative. The back slope of the ditch shall not be undercut by ditch cleaning operations;

and the slope to road shoulder shall be maintained at an approximate ratio of 3:1 from the bottom of the ditch to the edge of the roadbed. Roadside ditches shall not be excavated to a depth of greater than 2 feet below roadbed grade. Typical depth of roadside drainage ditches below roadbed is one foot. Existing ditch dikes shall be restored, reshaped, and compacted as needed for effective drainage through culverts.

Slope, grade, and shape all drainage features. Remove projecting roots, stumps, rock, or similar obstructions which have the potential to block water from entering the structure or divert water outside the defined channel.

2.7.2 - On aggregate-surfaced roads, material may be bladed across the road provided it is not deposited in ruts, washes, or chuckholes in the road surface. Such material shall be side cast on stable fill slopes or natural ground out of streambeds, streams, or other waterways. No side casting will be permitted on roads paralleling streams where the ground slope from the outside road shoulder to the stream edge is steeper than 2:1. On roads without aggregate surfacing, surface soil with rocks less than 3 inches in greatest dimension may be spread evenly over the adjacent roadbed.

2.7.3 - Remove from bridge decks all rock and other material that would create a hazard to traffic or is otherwise detrimental to the traveled surface.

2.8 Spot Surfacing

Load, haul, and place surface material to repair or stabilize road surfaces.

Spot surfacing is complete when the material has been placed, spread, and compacted.

300 cubic yards shall be delivered, placed, spread, and compacted. (include in Item 1 LS price)

Note: The Option Item is for additional aggregate that may be ordered as needed.

2.9 Roadside Clearing and Grubbing. This work consists of clearing and grubbing vegetation and the removal of logs and windfall within the traveled way, shoulders, turnouts, intersections, ditches, drainage dips, catch basins, surface water deflectors and minor drainage structures.

Remove vegetation and obstructions from the work area which interfere with road surface maintenance, drainage feature maintenance, and drainage features.

Vegetation greater than 3’ in length and 2” diameter shall be scattered outside of the work area and water courses.

2.10 Maintenance of Traffic and Use of Warning Devices. The Contractor shall provide, erect, and maintain all necessary traffic control and devices for the protection of the work and public safety. The traffic control includes areas where operations may interfere with the use of the road or trail by traffic and at all intermediate points where the new work crosses or coincides with an existing road or trail. All traffic control methods and devices shall conform with the current edition of the Manual Uniform Traffic Control

Devices for Streets and Highways (MUTCD), published by the Federal Highway Administration and applicable safety codes.

2.11 Removal of Obstructions. All fallen trees, limbs, brush, small slides or debris in the travel-way or road ditch line shall be removed and scattered outside the travel-way and ditch line.

2.12 Damage to Structures. The Contractor shall be held liable and is responsible for any damage caused by his/her personnel or equipment to any existing traffic loops, cattle guards, culverts, signs, and riprap protecting culvert inlets or fill slopes. Repair to these structures shall be at the Contractor's expense. Traffic loops will be marked on the ground with lath and fluorescent pink ribbon.

2.13 Soil Moisture – Retention of Fines. Contractor is responsible to ensure that performance does not reduce the level of fines in the road surface. Therefore, operations may be suspended when soil moisture conditions are not favorable for obtaining a satisfactory result. Suitable moisture conditions are determined to be in excess of 12 percent and less than 25 percent by weight unless otherwise authorized by the COR.

3. ACCEPTANCE REQUIREMENTS

3.1 Contractor Quality Control Plan. The Contractor shall submit a Quality Control Plan (QCP) before any work begins that demonstrates how the Contractor will assure that quality of performance meets the objectives and requirements of the contract. The QCP shall be submitted and approved before work begins. The QCP shall specify such as:

• How quality will be monitored to assure performance standards are met and rate of progress (See Contractor Work Requirements and Standards)

• How the work will be supervised and by whom.

• Identify the personnel responsible for performing quality control.

• Provide a copy of checklist used for inspections

Failure of the Contractor to maintain satisfactory inspection results will be grounds for deduction in payment or termination for cause. Contractor shall submit complete written copies of Quality Control Inspections. The Contractor may supplement the QCP. The Contractor’s QCP must provide the Government with sufficient information to indicate and verify the contractor is conducting work in accordance with this agreement.

3.2 Contractor Quality Control Inspection.

The Contractor, is responsible for management and quality control actions to meet the terms of this contract. The role of the Government is quality assurance to ensure contract standards are met and the contractor follows QCP. The Contractor shall not rely on the Government for their

QC.

The Contractor shall assure performance meets contract specifications, in accordance with FAR 52.212-4 Contract Terms and Conditions-Commercial prior to requesting the Government to inspect for payment or acceptance.

(a) Definitions. As used in this clause–

“Covered contractor information system” means an information system that is owned or operated by a contractor that processes, stores, or transmits Federal contract information.

“Federal contract information” means information, not intended for public release, that is provided by or generated for the Government under a contract to develop or deliver a product or service to the Government, but not including information provided by the Government to the public (such as on public websites) or simple transactional information, such as necessary to process payments.

(b) Safeguarding requirements and procedures.

(1) The Contractor shall apply the following basic safeguarding requirements and procedures to protect covered contractor information systems. Requirements and procedures for basic safeguarding of covered contractor information systems shall include, at a minimum, the following security controls:

(i) Limit information system access to authorized users, processes acting on behalf of authorized users, or devices (including other information systems).

(ii) Limit information system access to the types of transactions and functions that authorized users are permitted to execute.

(iii) Verify and control/limit connections to and use of external information systems.

(iv) Control information posted or processed on publicly accessible information systems.

(v) Identify information system users, processes acting on behalf of users, or devices.

(vi) Authenticate (or verify) the identities of those users, processes, or devices, as a prerequisite to allowing access to organizational information systems.

(vii) Sanitize or destroy information system media containing Federal Contract

Information before disposal or release for reuse.

(viii) Limit physical access to organizational information systems, equipment, and the respective operating environments to authorized individuals.

This clause does not relieve the Contractor of any other specific safeguarding requirements specified by Federal agencies and departments relating to covered http://uscode.house.gov/ contractor information systems generally or other Federal safeguarding requirements for controlled unclassified information (CUI) as established by Executive Order 13556.

(c) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (c), in subcontracts under this contract (including subcontracts for the acquisition of commercial items, other than commercially available off-the-shelf items), in which the subcontractor may have Federal contract information residing in or transiting through its information system.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(a) The contractor shall comply with the personal identity verification (PIV) policies and procedures established by the Department of Agriculture (USDA) Directives 4620-002 series.

(b) Should the results of the PIV process require the exclusion of a contractor's employee; the

Contracting Officer will notify the contractor in writing.

(c) The contractor must appoint a representative to manage compliance with the PIV policies established by the USDA Directives 4620-002 series and to maintain a list of employees eligible for a USDA LincPass required for performance of the work.

If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 shall be required, except in

States with exclusive or monopolistic funds that do not permit worker's compensation to be written by private carriers.

(b) General Liability. The Contractor shall have bodily injury liability insurance coverage written on a comprehensive form of policy of at least $500,000 per occurrence

(c) Automobile Liability. The Contractor shall have automobile liability insurance written on a comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and 500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage or loss.

(d) Aircraft Public and Passenger Liability. When aircraft are used in connection with performing the contract, the Contractor shall have aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger injury. Coverage for passenger injury shall be at least

$200,000 multiplied by the number of seats or passengers, whichever is greater.

EVALUATION FACTORS FOR AWARD

The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors listed in no particular order of importance shall be used to evaluate offers:

1. List of references for relevant past performance.

2. Key personnel/operators job experience

3. Price.

AWARD DETERMINATION

One award will be made to that quoter (1) whose quote is technically acceptable and (2) whose technical/cost relationship is the most advantageous to the Government. Award may not necessarily be made for technical capabilities that would appear to exceed those needed for fulfilling the requirements of this contract.

Award may be made without further discussions. Quotes shall be submitted initially on the most favorable terms, from a price and technical standpoint, which the quoter can submit to the Government.
