Finley/Benson Boundary fence – four wire

Repair four-wire fence to Forest Service Specifications

1.07

SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

C.1 SCOPE OF CONTRACT

Carlton Complex Burned Fence Repair project consists of the repair of approximately 1 mile of four-strand barbwire fence. The fenceline is in a mix of grasslands and burned forest (mostly all pine) in mostly genital topography but with two relatively deep and steep draws. There are no live trees anywhere along the fenceline.

The fence will need to be repaired to Forest Service specifications that are designed to make the damaged fence functional to stop cattle and to upgrade some old nonconventional steel posts on one section of fence. Fence materials will be provided by the Forest Service and will be made available at the Winthrop District office. There is no direct road access to the fenceline, but ATV/UTV access will likely be possible.

Fenceline clearing will be primarily the felling and bucking of dead standing trees and down trees. There is approximately 0.22 miles of a relatively high density burned snags, 0.35 miles of a light density burned snags and 0.46 miles of grassland with no snags. There are virtually no shrubs. All trees within falling distance of the fence will be felled but most are 4 to 8 inches in diameter with a mix of larger snags but few over 20 inches. Repair work consists of splicing, retightening, and refastening the wire; replacing severely burned, rusted, or missing barb wire (~0.15 miles), replacing unconventional steel posts (a 0.33 mile section), and replacing inline brace trees with posts or braces.

Steel EasyFence® brace panels will be used instead of wood braces in most all cases at stretch points to replace braces/inline trees and where more structure is needed in the fencline. There will also be some replacing of burned wood posts, bent or damaged steel posts, and replacing burned braces but there are very few spots that need these repairs. Approximately 0.2 miles of fence will need new wood stays – most of the fence does not have stays.

Contractor will furnish the necessary personnel, equipment, services, and facilities. The Forest Service will furnish all materials. Work should start as soon as possible to avoid any fire closures.

C.2 LOCATION AND DESCRIPTION

The fence location is T33N, T23E, Section 31, in a roadless area between lower Benson Creek and the mouth of Finley Canyon. The North half of the fencline can be accessed from the Lower Beaver Creek road off of Highway 20 and then onto the Finley Canyon road. Follow the Finely Canyon road (300) in about 2 miles to the prominent switchback in the SW corner of Section 29.

The 300 junctions to the south up the hill off the road that goes on up Finely Canyon, which is about 1/3 mile past the pond in the bottom of Finely Canyon (Wenner Lake).

As there are no roads directly to the fenceline, UTV access is limited. There is a steep draw between most of the fenceline and the switchback on the 300 road. We are hopeful that a suitable off road access route can be found from the Benson Creek side and a route can also be found down into the steep draw to access the north 1/3 mile of the fence. There is a private road up the bottom of the canyon to the west of the fence (Wenner Lakes). It may be possible to gain access from this road but permission from private land owners would be needed. (See project map).

C.3 TECHNICAL SPECIFICATIONS

Specifications for BURNED FENCE Repair

C.3.1 Fence Repair Steps:

1. Clear right-of-way of dead standing trees and down wood.

2. Remove any burned wood stays, wood posts, wood scabs, and trees from wire.

3. Replace all burned wood posts/braces with steel posts, wood posts, EasyFence braces, or rock jacks.

4. Replace all burned inline trees with either steel posts, wood posts, EasyFence braces, or rock jacks. Stretch points would require braces or rock jacks.

5. Replace all damaged steel posts with new ones (broken or severely bent, and unconventional).

6. Splice all broken wire and replace any missing wire or severely burned or rusted wire.

7. Tighten wire uniformly by sections between stretch points or where needed.

8. Add stays to fence to identify sections.

9. Clip to steel posts and staple wire to wood posts.

C.3.2 Clearing:

1. The fence line corridor shall be cleared to an approximate width of 12 feet, measuring 6 feet on each side of fence centerline. There is no live trees to remove. Stumps shall be cut no higher than 12 inches above the ground. Small diameter brush such as snowberry/current/willow can be cleared to facilitate construction but not required. Large shrubs containing stems greater than 1 inch basal diameter shall be cleared.

2. All dead down trees that are within the fence line corridor shall be removed. Down trees greater than 20 inches may be left on the outside of the center of the fenceline (west or north side).

3. All dead standing trees that are within 6 feet of the fence centerline (fence line corridor) shall be removed. Stumps shall be cut no higher than 12 inches above the ground.

4. All dead trees less than 20 inches DBH that are within falling distance of the fence line shall be felled. No limit on stump height.

5. Trees that have wire imbedded can be high-stumped above the wire.

6. Slash created by clearing fence line will be scattered outside of the fence line corridor.

C.3.3 Spacing:

1. Wood posts, steel posts, and braces will be replaced at the same spacing as the existing fence.

2. In the event posts cannot be set in the ground to meet required post spacing, the contractor may build wooden rock jacks (see C.8 below)

3. EasyFence braces shall be installed to replace burned trees that were used as stretch points.

C.3.4 Additional Requirements:

1. Wood material shall be placed in the fence with the larger end down.

2. Repair wire tie-downs where damaged. Rock hangers or steel post deadmans will be used.

Rock hangers shall be constructed of barbed wire and placed around the rock in two directions to form a cradle (exhibit 10). Tie downs shall not be substituted for other structures.

C.3.5 Post Holes and setting:

1. Corner, gate, angle and brace postholes – and all EasyFence brace posts – shall be set/driven at least 30 inches deep (2 ft. 6 in.). (Exhibits 1, 2, 3)

2. Posts (metal and wood) shall be set as nearly vertical as possible with the straight side of the posts in line on the wire side.

3. Back fill shall consist of loose dry soil or rock wherever possible and must be well tamped around each post to secure a firm post.

4. Steel posts must be driven until the tops of the anchor plates are well imbedded beneath the ground. Steel posts used for EasyFence braces shall be 7 ft. and driven into the ground a minimum of 30 in. No more than 6 inches of post should be showing above the 4 ft. panel.

(Exhibit 3, 4) All 7 foot posts that FS provides will be painted red on the top.

C.3.6 Replacing burned wood posts, stays and braces

1. Wood stay material shall only be provided by FS. There is no native live trees for stay material.

2. Burned inline corner trees with fenceline at a 90 degree angle will be replaced with an

EasyFence corner brace.

3. Burned inline corner trees or posts supporting fencelines greater than 90 degrees will be replaced with a single wood post with 2 steel post wire anchors (deadmans). Using steel posts to replace burned inline trees or wood posts will not be accepted. (Exhibit 9)

4. All wood material used for braces shall be treated wood material as provided by FS.

C.3.7 Wire:

A. Spacing

1. Repair fence to original wire spacing. The spacing will usually be obvious, if not, follow the spacing in exhibit 2 for four strand fence.

B. Wire stretching:

1. All wires shall be tightened with wire stretchers prior to placement of stays. Each wire shall have ALL of the slack removed. Wire shall not be overtightened.

2. Staples shall be used in all wooden posts and stays. Staples shall be driven at a slant to prevent the wood from splitting. Staples shall be driven snug to the wire, but loose enough to allow the wire to slip through the staple when expanding and contracting.

Galvanizing on the wire shall not be nicked or broken due to excessive driving of the staples. (Exhibit 5)

3. When splicing, wire ends shall be wrapped tightly back around wire at least 4 times.

4. Wire clips shall not be twisted completely around the wire. Insure that the clips hold the wire securely to the post but can easily be removed to re-stretch wire with future maintenance.

C. Wire type:

1. Use barbless 12.5 gauge wire for splicing and brace construction.

2. Use barbed 12.5 gauge wire for replacing missing or damaged barb wire.

C.3.8 Rock Jacks:

In the event posts cannot be set in the ground to meet required post spacing, the contractor may build wooden rock jacks or the contractor may anchor the wire into a rock outcrop. Rock jack design must not deviate from the specification in the exhibits 7a, 7b and 8 other than the size of the wood material, which can be longer and larger in diameter. Reasonably sized rocks shall be placed on rock jacks such that the jack adequately supports the fenceline. If wood material is splitting, larger diameter wood shall be used; or pre-drill holes; or smaller nails can be used. The inspector will ensure adequate size materials are available.

C.3.9 Barbed Wire Gate repair:

1. Repair gates to original width (if known) and to specifications in (Exhibit 6, 1, 3, 4).

There will likely be two gates, both 10-12 ft.

2. Wire gate stay requirements:

Gate size Total number of stays including end stays

** UNIFORM ALLOWANCE **

If employees are required to wear uniforms in the performance of this contract (either by the terms of the Government contract by the employer by the state or local law etc.) the cost of furnishing such uniforms and maintaining (by laundering or dry cleaning) such uniforms is an expense that may not be borne by an employee where such cost reduces the hourly rate below that required by the wage determination. The Department of Labor will accept payment in accordance with the following standards as compliance:

The contractor or subcontractor is required to furnish all employees with an https://beta.sam.gov/wage-determination/1977-0209/63?index=wd&is_active=true&date_filter_index=0&date_rad_selection=date&wdType=sca&state… 3/4 adequate number of uniforms without cost or to reimburse employees for the actual cost of the uniforms. In addition where uniform cleaning and maintenance is made the responsibility of the employee all contractors and subcontractors subject to this wage determination shall (in the absence of a bona fide collective bargaining agreement providing for a different amount or the furnishing of contrary affirmative proof as to the actual cost) reimburse all employees for such cleaning and maintenance at a rate of $3.35 per week (or $.67 cents per day). However in those instances where the uniforms furnished are made of ""wash and wear"" materials may be routinely washed and dried with other personal garments and do not require any special treatment such as dry cleaning daily washing or commercial laundering in order to meet the cleanliness or appearance standards set by the terms of the Government contract by the contractor by law or by the nature of the work there is no requirement that employees be reimbursed for uniform maintenance costs.

** NOTES APPLYING TO THIS WAGE DETERMINATION **

Under the policy and guidance contained in All Agency Memorandum No. 159 the Wage and Hour Division does not recognize for section 4(c) purposes prospective wage rates and fringe benefit provisions that are effective only upon such contingencies as ""approval of Wage and Hour issuance of a wage determination incorporation of the wage determination in the contract adjusting the contract price etc."" (The relevant CBA section) in the collective bargaining agreement between (the parties) contains contingency language that Wage and Hour does not recognize as reflecting ""arm's length negotiation"" under section 4(c) of the Act and 29 C.F.R. 5.11(a) of the regulations. This wage determination therefore reflects the actual CBA wage rates and fringe benefits paid under the predecessor contract.

** SERVICE CONTRACT ACT DIRECTORY OF OCCUPATIONS **

The duties of employees under job titles listed are those described in the ""Service Contract Act Directory of Occupations"" Fifth Edition (Revision 1) dated September 2015 unless otherwise indicated.

REQUEST FOR AUTHORIZATION OF ADDITIONAL CLASSIFICATION AND WAGE RATE

Standard Form 1444 (SF-1444)

Conformance Process:

The contracting officer shall require that any class of service employee which is not listed herein and which is to be employed under the contract (i.e. the work to be performed is not performed by any classification listed in the wage determination) be classified by the contractor so as to provide a reasonable relationship (i.e. appropriate level of skill comparison) between such unlisted classifications and the classifications listed in the wage determination. Such conformed classes of employees shall be paid the monetary wages and furnished the fringe benefits as are determined (See 29 CFR 4.6(b)(2)(i)). Such conforming procedures shall be initiated by the contractor prior to the performance of contract work by such unlisted class(es) of employees (See 29 CFR 4.6(b)(2)(ii)). The Wage https://beta.sam.gov/wage-determination/1977-0209/63?index=wd&is_active=true&date_filter_index=0&date_rad_selection=date&wdType=sca&state… 4/4 and Hour Division shall make a final determination of conformed classification wage rate and/or fringe benefits which shall be retroactive to the commencement date of the contract (See 29 CFR 4.6(b)(2)(iv)(C)(vi)). When multiple wage determinations are included in a contract a separate SF-1444 should be prepared for each wage determination to which a class(es) is to be conformed.

The process for preparing a conformance request is as follows:

1) When preparing the bid the contractor identifies the need for a conformed occupation(s) and computes a proposed rate(s).

2) After contract award the contractor prepares a written report listing in order the proposed classification title(s) a Federal grade equivalency (FGE) for each proposed classification(s) job description(s) and rationale for proposed wage rate(s) including information regarding the agreement or disagreement of the authorized representative of the employees involved or where there is no authorized representative the employees themselves. This report should be submitted to the contracting officer no later than 30 days after such unlisted class(es) of employees performs any contract work.

3) The contracting officer reviews the proposed action and promptly submits a report of the action together with the agency's recommendations and pertinent information including the position of the contractor and the employees to the Wage and Hour Division U.S. Department of Labor for review (See 29 CFR 4.6(b)(2)(ii)).

4) Within 30 days of receipt the Wage and Hour Division approves modifies or disapproves the action via transmittal to the agency contracting officer or notifies the contracting officer that additional time will be required to process the request.

5) The contracting officer transmits the Wage and Hour decision to the contractor.

6) The contractor informs the affected employees.

Information required by the Regulations must be submitted on SF-1444 or bond paper.

When preparing a conformance request the ""Service Contract Act Directory of Occupations"" (the Directory) should be used to compare job definitions to ensure that duties requested are not performed by a classification already listed in the wage determination. Remember it is not the job title but the required tasks that determine whether a class is included in an established wage determination.

Conformances may not be used to artificially split combine or subdivide classifications listed in the wage determination."
