SOLICITATION #693JJ924R000035

PART I - THE SCHEDULE

SECTION B - SUPPLIES OR SERVICES AND PRICES/COSTS

B.1 SUPPLIES/SERVICES/REQUIREMENTS

The Contractor shall provide the qualified personnel, facilities, materials, equipment, and services (except as identified in Section H.8, Government Furnished Property/Test Items) necessary to perform the procurement, receipt, inventory, inspection, testing, reporting, storage, and disposal of motor vehicle equipment. The Office of Vehicle Safety Compliance (OVSC) of the National Highway Traffic Safety Administration (NHTSA) requires engineering services to collect data in support of its enforcement program for federal motor vehicle safety standard (FMVSS) No. 108, Lamps, Reflective Devices, and Associated Equipment and FMVSS No. 125, Warning Devices.

B.2 CONTRACT TYPE

This is an Indefinite Delivery, Indefinite Quantity (IDIQ), Firm-Fixed-Price (FFP) Contract, with Cost Reimbursement elements for Contractor Purchased Test Items (CPTI). Under this Contract¸ the Government shall issue Delivery Orders in accordance with Federal Acquisition Regulation (FAR) 16.5 – Indefinite-Delivery Contracts.

B.3 MINIMUM/MAXIMUM OBLIGATIONS

B.3.1 Minimum obligation

Minimum Obligation – Upon execution of the Base Contract, the Government will order the supplies and services of the Known Requirements under B.4.2 in the amount of $TBD at award.

This amount represents the “minimum obligation of the Government.”

NOTE: The number of tests identified in Section B.4.2 represents the total number of known tests to be conducted during the Base Period (Contract Year

1) and not the guaranteed minimum obligation of each contract awarded as a result of this RFP. The guaranteed minimum number of tests to be ordered for each awarded contract will depend upon the number of contracts awarded and the proposed lowest price for the known test by the offeror. Each awarded contract will include a guaranteed minimum obligation amount for the Kick- Off Meeting.

"Standards Enforcement Program for Laboratory Testing to FMVSS No. 108, "Lamps, reflective devices, and associated equipment." and FMVSS No. 125, "Warning devices".

B.3.2 Maximum obligation

Maximum Obligation – The Contractor shall be obligated to provide services and support up to the total not-to-exceed amounts specified in Sections B.4.2 through B.4.8. The overall contract ceiling amount is $TBD at award. The ceiling amount may be increased upon execution of a bilateral modification.

Note: The Contracting Officer is the only individual who can legally commit or obligate the Government to the expenditure of public funds. No cost chargeable to the proposed contract can be incurred before receipt of a fully executed contract or specific written authorization from the Contracting Officer.

B.4 CONTRACT PRICES

B.4.1 Contract Prices

This Contract includes three “Periods”: The “Base Period” which is the first 24 months of the contract term (composed of Contract Year 1 and Contract Year 2), an Option Period which, if exercised, begins at the end of the Base Period and continues for an additional 36 months (composed of Contract Year 3, 4, and 5) and an Option to Extend Services which, if exercised, begins at the end of the Option Period and continues for up to six (6) months (composed of Contract Year 5.5).

Testing services are priced by Contract Year. The price in effect at the time a test is ordered shall apply to that test regardless of when the test is conducted and finished. Test prices shall apply for payment purposes and shall include all charges, including, if applicable, charges for storage and disposal1 .

Upon delivery and acceptance of supplies and services described in Section C, Statement of Work (SOW) and each awarded Delivery Order, the Government will pay to the Contractor the fixed prices set forth in Sections B.4.2 through B.4.8 - Price Schedules, and will reimburse the Contractor at actual cost for the cost reimbursement Contract Line Item Number (CLIN)s identified in Section B.

Except for the Known Requirements (i.e., guaranteed minimum order quantity), identified in Section B.4.2, the Government is not under any obligation to order any additional services under this Contract. The Government reserves the right, at its option, to increase the quantities of testing services provided under this Contract up to the “Total Not-To-Exceed” amount specified for each contract period.

B.4.2 PRICE SCHEDULE – BASE PERIOD (CONTRACT YEAR 1) – KNOWN

REQUIREMENTS

(Prices shall cover the Period of Performance from TBD through TBD.)

1 Under no circumstances, nor at any time, will storage or disposal costs be permitted as a separate cost item. Storage costs for work described in Statement of Work, Section C.9.1 – Storage/Disposing, if any, must be included in the test prices set forth in Section B.

*Reimbursement for CPTI Contract Line Item Numbers (CLINs) (1017, 2017, 3017, 4017, 5017, and 6017) are cost reimbursement CLINs for Delivery Orders. At Delivery Order issuance, NHTSA will provide the Contractor with an estimate for the CPTI (if applicable), or the Contractor will provide the Government with an estimate. The Delivery Order will identify the test item product identification (i.e., make and model of motor vehicle equipment), delivery requirements, quantities ordered, and estimated cost (See Section C.6.6, Test Items/Models). Reimbursement for CPTI will be based on the actual cost paid by the Contractor (CLINs 1017, 2017, 3017, 4017, 5017, and 6017) to the motor vehicle equipment manufacturer/dealer for the test items (including any associated tax, if not otherwise exempted, and shipping and handling costs as applicable) along with the firm fixed price service charge (CLINs 1016, 2016, 3016, 4016, 5016, and 6016). The Contractor’s invoice for the cost reimbursement CLINs shall include copies of the actual vendor invoices.

The CPTI identified by the Government may be subject to change provided that (1) the cost for the test item does not exceed the funds available for procuring the CPTI and that

(2) the Contractor has not begun fulfilling the order. Under these circumstances, the Contracting Officer may direct the Contractor to stop any acquisition of CPTI until the changed specifications are provided.

The Delivery Order will include a not-to-exceed amount for the cost reimbursement CLIN. If the estimated costs for CPTI will exceed the not-to-exceed amount identified in the Delivery Order, the Contractor shall notify the Contracting Officer and the COR prior to incurring said costs. The Contractor shall not proceed with the purchase until given approval by the Contracting Officer. Please note that the Government will reimburse the Contractor for actual costs incurred for the cost reimbursement CLIN in accordance with FAR Part 31.

"Standards Enforcement Program for Laboratory Testing to FMVSS No. 108, "Lamps, reflective devices, and associated equipment." and FMVSS No. 125, "Warning devices".

**Optional CLINS FMVSS No. 108 Front Lamp (Isocandela Plots) (CLINs 1018, 2018, 3018, 4018, 5018, and 6018) and FMVSS No. 108 Front Lamp (Optional Photometry and Color Testing) (CLINs 1019, 2019, 3019, 4019, 5019, and 6019) are optional “add-on” CLINs for Delivery Orders that may be required. These CLINs cannot be priced at the time of contract award and will be priced separately, on a firm fixed price basis, at the Delivery Order level.

At Delivery Order issuance, the Contractor will provide NHTSA with a firm fixed price for these CLINs based on the quantity ordered and the type of lamp to be tested. For FMVSS No. 108 Front Lamp (Isocandela Plots), the Contractor shall indicate the minimum resolution (e.g., max. scan spacing [degrees]) expected. All firm fixed prices shall be provided on a per lamp basis.

C.3 BACKGROUND

The National Highway Traffic Safety Administration (NHTSA) is an Operating Administration of the United States Department of Transportation (DOT), and its mission is to save lives, prevent injuries, and reduce economic costs associated with motor vehicle crashes. As part of its mission, NHTSA promulgates Federal Motor Vehicle Safety Standards (FMVSS).

Manufacturers of motor vehicles and motor vehicle equipment are required to certify that each product they sell in the United States meets the requirements of all applicable safety standards.

NHTSA’s Office of Vehicle Safety Compliance (OVSC) is charged with determining whether manufacturers meet the applicable safety standards. This contract effort will enable the Agency to meet its mission by assuring that motor vehicles meet the requirements in FMVSS No. 108, Lamps, Reflective Devices, and Associated Equipment and FMVSS No. 125, Warning Devices.

FMVSS No. 108, Lamps, Reflective Devices, and Associated Equipment, establishes requirements for original and replacement lamps, reflective devices, and associated equipment.

The purpose of this standard is to reduce traffic accidents and deaths and injuries resulting from traffic accidents, by ensuring adequate illumination of the roadway and by enhancing the conspicuity of motor vehicles on public roads so that their presence is perceived and their signals understood, both in daylight and in darkness or in other conditions of reduced visibility. The standard applies to passenger cars, multipurpose passenger vehicles (MPVs), trucks, buses, trailers (except pole trailers and trailer converter dollies), and motorcycles as well as to lamps, reflective devices, and associated equipment for replacement of like equipment on the vehicles mentioned above. The requirements for compliance testing of motor vehicle lighting equipment are specified in TP-108-13 as applicable.

FMVSS No. 125, Warning Devices, establishes requirements for devices, without self-contained energy sources, that are designed to be carried in motor vehicles and used to warn approaching traffic of the presence of a stopped vehicle. This does not include devices designed to be permanently affixed to the vehicle. The purpose of this standard is to reduce deaths and injuries due to rear end collisions between moving traffic and disabled vehicles. The requirements for compliance testing for motor vehicle warning devices are specified in TP-125-01 as applicable.

"Standards Enforcement Program for Laboratory Testing to FMVSS No. 108, "Lamps, reflective devices, and associated equipment." and FMVSS No. 125, "Warning devices".
