PART II – JUSTIFICATION

(iv) Statutory Authority and Supporting Rationale

This justification cites FAR Subpart 8.405-6(a)(1)(i)(C) authority which states, “In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order [BPA] provided that the original order [BPA] was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.”

The original BPA EP10H001470 was issued to Omnifics on a competitive basis on May 20, 2010. The services required under this LSJ is to provide a logical continuation of services currently being performed by the incumbent, Omnifics, Inc. as well as to continue to acquire additional furniture systems from Omnifics. The relationship between the initial competitively awarded BPA and this follow-on BPA qualifies as logical since the following supporting rationale in terms of scope, period of performance, or value apply:

· This follow-on is associated with moves/relocations/renovations, additions, changes, and similar needs to the scope of services provided under the original BPA with some services taking place under stringent timeframe (March of 2016 Potomac Yard relocation);

· This follow-on will provide the same reconfiguration/construction services for new Haworth furniture systems to locations where proprietary Haworth furniture systems/services already exists and have been ordered as the identical statement of work (SOW) will be used;

· This follow-on will maintain the continuity of the existing furniture system used throughout EPA which include compatibility with all existing systems, electronics, telecom, continuity of design; and

· This follow-on will minimize inefficiencies associated with switching furniture systems, transitioning between new contractor support that include the learning curves and duplicative costs, and the additional costs that would result from re-procurement and the lost returns on active service warranties provided by the incumbent contractor. The introduction of any systems furniture other than Haworth will include the following costly requirements:

· Modifications to the building electrical and telecommunications systems,

· Complete tear-down of workstations in a suite for compatibility/design integrity; and

· Requirement to maintain additional inventories and an inability to deplete the existing Haworth inventory.

· This action will result in a similar overall value for the logical follow-on to that of the original BPA as the duration of the follow-on is also for a five (5) year performance period with an adjustment for additional services are needed for long-term Agency re-organizational demands as well as capacity shortages under the current BPA.

(v) Contracting Officer’s Best Value Determination

In accordance with FAR Subpart 8.404(d), the supplies offered on the schedule are listed at fixed prices and the services offered on the schedule are priced either at hourly rates, or at a fixed price for performance of a specific task (e.g., installation, maintenance, and repair) that have already been determined by GSA to be fair and reasonable. The ordering activity will make a determination prior to award with supporting evidence that the award represents the best value to the Government in terms of the expected outcome of an acquisition and that it provides the greatest overall benefit in response to the requirement. The Government will also seek additional discounts before placing a follow-on BPA. A determination and finding will be prepared to demonstrate that the use of the Federal Supply Schedule (FSS) is the best procurement approach.

The ordering activity’s Contracting Officer will consider the level of effort and the mix of labor proposed to perform the services being ordered when determining that the total price is reasonable and will only place a BPA with Omnifics, Inc. if it represents the best value. Services are expected to represent approximately 18% or $1,456,000.00 ($291,200.00) of the overall requirement.

(vi) Market Research

Based on such factors as urgency, estimated dollar value, complexity, and past experience, market research consisted of examining the following FSS 71/71 II K schedule holder’s pricelist:

(1) Nucraft GS-27F-022CA

(2) ISE, Inc. GS-28F-7023G

(3) Bernhardt Furniture Company/Bernhardt Design GS-28F-7040G

(4) Krug, Inc. GS-28F-0021J

(5) Cabot Wren (Hancock & Moore, Inc.) GS-28F-0049M

After examining these schedules the Contracting Officer found no evidence of these vendor’s pricing and/or ability to provide the required services offered better pricing or terms and conditions than that of the incumbent. The vendors used in the market survey were obtained from the sources sought under the original BPA and some vendors are a part of the furniture system currently being used in some areas within EPA. There was no evidence that the Agency would realize any meaningful cost reductions through other vendors.

(vii) Any other facts supporting the justification

EPA must vacate the Potomac Yard North building by March 1, 2016 and this follow-on BPA will be used to satisfy the Government’s need. Prior to relocating 450 North employees to Potomac Yard South, there are approximately 1,200 employees at Potomac Yard South that must be relocated to accommodate the 450 North employees. Some of the Potomac Yard employees will be relocating to the WJC West Basement. In addition to the massive Potomac Yard moves, the EPA is anticipating a massive influx of new hires at the Federal Triangle Complex (WJC locations). Due to the new hires and relocation of employees, it is anticipated that workstation will be disassembled and new furniture and workstations will be purchased. These moves and new hires were not anticipated during the initial BPA.

(viii) Actions Taken to Remove Barriers that Restrict Competition

This action is a logical follow-on. Since the logical follow-on authority under FAR Subpart 8.405-6(a)(1)(i)(C) is a one-time statutory authority, for future Agency needs, the Government anticipates that new furniture solution requirements will be competitively procured.

(ix) Contracting Officer’s Certification Statement

The ordering activity contracting officer’s certification and signature that the justification is accurate and complete to the best of the contracting officer’s knowledge and belief is provided below under Part IV.

(x) Technical/Requirement Personnel’s Certification Statement
