This memorandum provides justification for a sole source contract award to Agilent Technologies Inc. for upgrading the 400 MHz Nuclear Magnetic Resonance console at the United States Air Force Academy Department of Chemistry. The current Varian MercuryPlus 400 NMR console is reaching the end of its service life. Agilent Technologies acquired Varian, the original manufacturer of the console, and has over fifty years of experience building and servicing these types of instruments. As the console is an extremely complicated system with many interconnecting components, choosing a different manufacturer for the upgrade could risk integration issues and losing the instrument for an extended period. The estimated cost of the upgrade is $216,143.

SUBJECT: Justification for Other Than Full and Open Competition
1. APPLICABLE EXCEPTION

3. DESCRIPTION OF THE SUPPLIES AND/OR SERVICES REQUIRED TO MEET
THE AGENCY’S NEEDS:
The Department of Chemistry has a need to upgrade our 400 MHz Nuclear Magnetic Resonance
(NMR) console. Our current Varian MercuryPlus 400 NMR console is reaching the end of it service life. This item is on equipment account 351FC, detail #0001, and is physically located in
Fairchild Annex, bldg. 2355, room 2M180. We estimate the cost of this requirement to be
$216,143. The only acceptable source for providing this service is the Agilent Technologies, Wilmington, DE.
4. FACTS SUPPORTING THE USE OF OTHER-THAN-FULL-AND-OPEN-
COMPETITION:
Agilent Technologies Inc. acquired Varian Inc. the original company that designed and manufactured the instrument used by the chemistry department. They have been building and servicing these types of instruments for fifty years plus and are uniquely qualified to supply an ungraded NMR console for our exsiting instrument. The instrument is extremely complicated with many interconnecting pieces of circuitry. The choice of a different manufauter of a NMR console could have a significant impact on our mission because of unforeseen problems trying to integrate there hardware with the preexisting Varian system. We believe any increased costs experienced from choosing Agilent Technologies Inc. is money well spent considering the possible impact of losing this instrument for an extended period.

Based on the above information, we recommend Agilent Technologies Inc. as the only source capable of meeting the government’s requirements. The requiring activity certifies that the information provided to support this recommendation is complete and accurate to the best of our knowledge. Copies of supporting documentation can be obtained from the requiring activity.
5. TECHNICAL REQUIREMENTS PERSONNEL CERTIFICATION.
I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.
