About this file

This is a Justification for Other Than Full and Open Competition (JOFOC), commonly referred to as a "Sole Source" justification, submitted by the Federal Railroad Administration Headquarters, Office of Acquisition Management.

The FRA seeks to award a sole-source contract to Berekley Simulation Software for annual maintenance of two Rail Traffic Controller (RTC) software perpetual licenses. RTC is an operations simulation tool used to model train movements and is widely utilized by FRA grantees for project development. The FRA requires this maintenance to enable the agency to review RTC models developed through its grants program. The contract covers annual maintenance for the period July 15, 2026 through July 14, 2027 at a cost of $12,800, with a total contract value of $39,600 including the base year plus two one-year option periods. The justification cites statutory authority under FAR 6.103-1, establishing that Berekley Simulation Software is the sole developer and distributor of the RTC software and that no alternative sources or suppliers can satisfy the agency's requirements. Exception 5.202(a)(10) applies, as the acquisition meets conditions described in FAR 6.302-3. A notice of intent to sole source was published by the Contracting Officer on July 15, 2026, and will remain published for 10 days prior to solicitation. The FRA will conduct a thorough cost analysis to ensure all proposed costs are fair and reasonable.
