About this file

This is a Sole Source (Including Brand Name) Justification document for preventative maintenance services from Siemens Industry Inc. at Nellis Air Force Base, submitted by the Air Force Test Center (AFTC), Directorate of Contracting, Installation Contracting Division at Edwards AFB.

The document justifies a sole source award for preventative maintenance services for Siemens systems installed in the Joint Simulation Environment. The services include terminal unit performance analysis, data backup and restore services, onsite targeted maintenance, software subscription service for Desigo CC, and calibration services. The contract includes a base year plus four option years, with funding level between SAT and $750K. The justification notes that Siemens Las Vegas Area office is the only authorized service provider in Southern Nevada, and switching to another vendor could result in mission-critical downtime. A Notice of Contract Action was posted on SAM.gov from December 18th to December 23rd to confirm no other potential vendors. The current system warranty expires December 30th, 2024, and this contract will extend servicing and preventative maintenance for these mission-critical systems.

IV. Statutory authority permitting other than full and open competition.

FAR 13.501 and DAFFARS 5313.501 requires an ordering activity to justify its actions when restricting competition to a sole source or brand name in accordance with 41 U.S.C 1901. This acquisition will be made through other than full and open competition.

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).

The Electronic Warfare Group (EWG) currently has Siemens systems established and installed in the Joint Simulation Environment at Nellis Air Force Base. The current System is under Warranty through December 30th 2024. The EWG is seeking to extend the servicing and preventative maintenance for these installed systems

March 2023 CONTROLLED UNCLASSIFIED INFORMATION Page 4 of 5March 2023 CONTROLLED UNCLASSIFIED INFORMATION Page 4 of 5 are they are critical to mission success at this location.

The preventive maintenance and other services are proprietary to Siemens with no authorized resellers.

During the Market Research stage the manufacturer Siemens was contact to confirm if they have any distributors or resellers and the following response was received “The Siemens Las Vegas Area office/Branch is the only Southern Nevada area/branch that covers this geographic area and as the installing and design team we are the sole source for service.” With this information in mind a Notice of Contract Action will be posted on SAM.gov to confirm that there are no other potential vendors.

Siemens products and services have already been extensively used within the Joint Simulation Environment at the Edwards AFB and Nellis AFB locations. Switching to another brand of service or maintenance could result in unexpected downtime from receiving non manufacturer service. Potential switching the entire system to a different would also consist of a large duplication of cost and substantial downtime to switch the systems and retrain current users.

All technical data, data rights, and source code are proprietary, and the Government has no claim to this information. In order for the government to develop its own system would be a lengthy and costly process that is not expected to recover or save any future costs.

VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

While reviewing vendor capabilities and previously accomplished efforts it was determined that it would be in the best interest of the Government to directly award to Siemens Industry Inc. Siemens systems have been installed previously and are critical for the ongoing test mission. Downtime for maintenance issues must be reduced to the maximum point.

VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer has determined that the anticipated cost to the Government for this acquisition will be fair and reasonable, and the proposal will be evaluated using price analysis for commercial items in accordance with FAR Part 13.106-3. These items have been determined to be commercial items; therefore, certified cost and pricing data is not required. However, other than certified cost and pricing data will be requested to aide in the price analysis.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

During the Market Research phase, it was determined that this would be a sole source acquisition. A formal Notice of Contract Action (NOCA) was posted on SAM.gov for any potential vendor to respond to with a capability statement or quote. The NOCA was posted on December 18th with a due date of December 23rd for interested vendors.

IX. Any other facts supporting the use of Other Than Full and Open Competition.

This brand of hardware and software has been found technically acceptable on previous similar requirements in terms of offering solutions with the proper form, fit, and function to meet the requiring activity's needs.

X. List of any sources that expressed, in writing, an interest in the acquisition.

N/A other than the sole source vendor

XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.

Currently there are no plans in the future to move the Joint Simulation Environments software and hardware to a different system. We will continue to monitor the Market for any resellers or distributors that arise for future needs.

XII. Certification by the Contracting Officer.

As evidenced by my signature above, I have determined this document to be both accurate and complete to the best of my knowledge and belief.
