USDA, APHIS, MARKETING AND REGULATORY SERVICES

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

(JOFOC)

LESS THAN $150,000

POLICY:

In accordance with the authority granted under FAR Part 13.4, the contracting officer must promote competition to the maximum extent practicable to obtain supplies and services from the source whose offer is the most advantageous to the Government, considering the administrative cost of the purchase.

(a) The contracting officer must not—

Solicit quotations based on personal preference; or Restrict solicitation to suppliers of well-known and widely distributed makes or brands.

(b) If using simplified acquisition procedures and not using either FACNET or providing access to the notice of proposed contract action and solicitation information through the Government-wide point of entry (GPE), maximum practicable competition ordinarily can be obtained by soliciting quotations or offers from sources within the local trade area. Unless the contract action requires synopsis pursuant to FAR 5.101 and an exception under FAR 5.202 is not applicable, consider solicitation of at least three sources to promote competition to the maximum extent practicable. Whenever practicable, request quotations or offers from two sources not included in the previous solicitation.

Each justification shall contain sufficient facts and rationale to justify the use of the specific authority cited, and shall include evidence that any supporting data that is the responsibility of technical or requirements personnel (e.g., verifying the Government’s minimum needs or schedule requirements or other rationale for other than full and open competition) and which form a basis for the justification have been certified as complete and accurate by the technical or requirements personnel.

In accordance with the authority granted under FAR Part 13, this request for a noncompetitive acquisition is hereby submitted for consideration for acquisition approval.

2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING

APPROVED:

Purchase of 8 subscriptions to Panjiva.com for the SITC analysts.

3. A DESCRIPTION OF THE SUPPLIES, EQUIPMENT, OR SERVICES

REQUIRED TO MEET AGENCY NEEDS (INCLUDING THE ESTIMATED

VALUE OF THE ACQUISITION INCLUSIVE OF OPTIONS):

This will be a subscription to panjiva.com, a website that offers import & export data.

In addition to this data, the service provides narratives and contact information on companies that import/export. Finally, they provide link analysis showing how companies and products are linked. They allow to click on company A and see who they’re affiliated with as well as who they buy/sell from. You can do this for HTS codes as well as other search criteria. Finally, we’re able to download this data for further analysis.

SITC analysts analyze pathways for the movement of regulated agricultural products.

This subscription will provide us with information we currently don’t have access to such as import data to other countries. It also provides links to companies and their pathways which will allow us to see links and find other companies that we currently don’t know about. This will allow us to identify additional companies and pathways that are dealing in regulated agricultural products.

We’ve not had this product for and there is no other product on the market that provides all the features this company does. No other future requirements will be needed as its subscription based.

The price is 32,500 per year for 8 users (all 8 analysts @ 4062.50/analyst).

They provide link analysis of pathways, companies and products for global movement of products. We can target on many different criteria to set up the search.

We can click on a company and it’ll show us who they’re affiliated to, who they sold/distributed to and companies who deal in similar products.

We can set up email alerts for imports of products or companies which we currently can’t do nor does a company provide.

6. A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS

PRACTICABLE, INCLUDING WHETHER A NOTICE WAS, OR WILL BE,

PUBLICIZED AS REQUIRED BY FEDERAL ACQUISITION REGULATION

(FAR) SUBPART 5.2, AND IF NOT, WHICH EXCEPTION UNDER FAR 5.202

INTEREST IN THE ACQUISITON:

Someone has contacted a program representative or the contracting activity in the past about this effort, project, item, or service.

BEFORE ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES,

EQUIPMENT, OR SERVICES REQUIRED:

As the sole provider with an exclusive contract with the USAF there are not barriers to competition to overcome.
