About this file

This document is a Sole Source Notice of Intent-Sources Sought issued by the Defense Information Systems Agency (DISA) for PKWare software maintenance support. DISA intends to negotiate a sole source contract with PKWare, Inc. for annual software maintenance of PKZip for zSeries, software maintenance Standard 16.1, and PK Encrypt for Z, software maintenance Standard 17.0. The base year contract period is from October 1, 2025, through September 30, 2026, with an unfunded CLIN to accommodate potential additional license needs.

The sole source justification is based on PKWare being the Original Equipment Manufacturer (OEM) and the only source for software maintenance of their licensed products, with proprietary rights to the source code. The contract will be a Firm Fixed Price (FFP) type, with the current incumbent PKWare, Inc. being a Large Business (CAGE: 0G2W6). Potential alternative vendors must submit a detailed capability statement within 15 days of the notification, though no reimbursement will be provided for preparing such statements. The North American Classification System (NAICS) code 513210 for Software Publishers will be used to determine company size status.

NOTICE OF INTENT-SOURCES SOUGHT

The Defense Information Systems Agency/Defense Information Technology Contracting Organization intends to negotiate a sole source contract with PKWare, Inc. for software support. A sole source Justification & Approval document is being coordinated and, upon approval, a copy of it will be posted here on SAM.gov to comply with the public display requirements of FAR 6.305.

The objective of this effort is to obtain annual software maintenance from the Original Equipment Manufacturer (OEM) for PKZip for zSeries, software maintenance, Standard 16.1 and PK Encrypt for Z, software maintenance, Standard 17.0. The award will include an unfunded CLIN for each contract year, to accommodate the potential need for additional PKWare licenses due to increased or new customer requirements and increased hardware capacity due to hardware tech refreshes. Software maintenance includes the receipt of new versions and releases of software products. The period of performance for the base year is 1 October 2025 through 30 September 2026. This software is incorporated in the Operation Center’s mainframe environment.

PKWare, Inc. is the OEM and the only source for software maintenance of the licensed PKWare products. PKWare owns all proprietary rights to the source code and has not released the product source code to any authorized third party vendors to maintain. A sole source situation has occurred due to the PKWare software product being deeply embedded into DISA and its mission partners’ applications. Acquiring a different product would cost DISA and its mission partners a large, unbudgeted financial burden.

DISA policy mandates that all software in the enterprise must have an active maintenance contract in order to ensure the most recent software versions are provided, as well as, published patches and fixes. PKWare has confirmed that software maintenance for the DISA licenses is only available from PKWare, as such, all maintenance contracts for this software have been awarded to the OEM

At this time, the incumbent contractor PKWare, Inc. is the only source capable of providing all necessary services because PKWare is the only source from which to purchase software maintenance.

The statutory authority for other than full and open competition is 10 USC 2304 (c) (1), as implemented by FAR 6.302-1(a)(2)(iii), only one responsible source and no other supplies or services will satisfy agency requirements. Companies who believe they can provide this service must indicate their interest in writing within 15 days of this notification and include a detailed capability statement. No reimbursement for any cost connected with providing capability information will be provided. All responsible sources will be considered in evaluating the determination to issue a sole-source contract. Quotations or proposals received in response to this notice cannot be accepted since this synopsis cannot be considered a request for quote or a request for proposal. A solicitation will NOT be posted to SAM.gov due to the sole source nature of the requirement.

The North American Classification System (NAICS) code 513210- Software Publishers will be used for determining company size status.
