About this file
This is a Memorandum justifying the use of other than full and open competition for a simplified acquisition under the U.S. Navy's Maritime Sealift Command (MSC). The procurement is for a critical ship equipment part: an impeller (Part Number 3-0478-01) for the USNS ROBERT E PEARY (T-AKE 5), to be sourced from Air & Liquid Systems Corporation (Buffalo Pumps). The specific requirement is to repair the No. 2 Central SW Cooling Pump, with a required delivery date of 18FEB2026.
The justification for single-source procurement is based on multiple factors: the part is critical ship equipment where failure could pose a hazard to the ship, crew, or environment; it requires standardization per MSC's initiative; and it must be a direct replacement part compatible with existing equipment. An active Casualty Report (CASREP 25009) indicates that if another pump fails, the vessel will be unable to get underway due to crossing T-AKE red lines. The estimated production lead time is 165 days, and the requirement was initially identified on 30JUN2025, with the delay attributed to technical research.

MEMORANDUM
Subj: USE OF OTHER THAN FULL AND OPEN COMPETITION FOR AN ACQUISITION UNDER
THE SIMPLIFIED ACQUISITION THRESHOLD
Ref: (a) USNS ROBERT E PEARY (T-AKE 5) PR Number(s): N23195-5181-W563/1301284311
I. BACKGROUND:
1. In considering the references, FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contacting Officers may solicit from one source if the Contracting Officer determines that, under the circumstances of the contract action, only one source is reasonably available (e.g., urgency, exclusive licensing, brand-name, or industrial mobilization).
2. As required by FAR 13.106-3(b) (3) (i), this memorandum explains the absence of competition for this acquisition because only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.
II. DESCRIPTION OF ITEM OR SERVICE:
1. Provide a description of the item or service required, to include
DESCRIPTION P/N QTY
IMPELLER 3-0478-01 1
a) The name of the required source or brand name:
Suggested Source of Supply (CAGE/Vendor ID: 83130) MFG Name: AIR & LIQUID SYSTEMS CORPORATION Div: DBA BUFFALO PUMPS Address: 874 OLIVER ST
NORTH TONAWANDA, NY 14120-3210
Country: USA
b) The required delivery date/period of performance and:
18FEB2026
c) Its intended use:
TO REPAIR NO.2 CENTRAL SW COOLING PUMP
2. List the source(s) or known vendor(s) who are able to provide the above-described item or service.
- AIR & LIQUID SYSTEMS CORPORATION
- ECI DEFENSE GROUP
III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN COMPETITION IS BASED
ON THE FOLLOWING (select all that apply):
A. _____ Only one responsible source (select all that apply):
2 Ver 2.0 (01 July 2018)
1. _______ RESTRICTIVE RIGHTS: the source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service.
a. Explain what is subject to the restrictive rights:
b. If drawings are included, who is identified as “owning” the drawings.
2. _______ EXCLUSIVE LICENSING AGREEMENTS: The item or service is only available from the Original Equipment Manufacturer (OEM), or there is ONLY ONE authorized distributor or technical representative for the OEM.
a. Identify the OEM and explain the circumstances surrounding why the item or service is only available from the OEM.
b. Identify the distributor / authorized technical representative for the item or service. Provide evidence of the exclusive licensing agreement as an attachment to this document. (NOTE: If there is more than one distributor / authorized technical representative, then use Part B – Brand Name.)
3. __X___ OTHER REASON:
a. _X___ CRITICAL SHIP EQUIPMENT: The required item is critical ship equipment, the failure of which poses a hazard to the ship, the crew or the environment.
SMS Procedure Number: 10.6-002-01-AKE
b. _X____ STANDARIZATION / BRAND NAME: Per MSCs standardization initiative, only the specified make/model of the equipment/parts will satisfy the Government’s needs for additional units or replacement items.
3 Ver 2.0 (01 July 2018)
Identify Make / Model Number(s):
X2319611005, PUMP, CNTFGL 7300GPM 1150RPM T-ALT 305
i. Identify other vessels with this Make / Model:
ALL T-AKE CLASS SHIPS
c. _X_____ FORM, FIT, and FUNCTION: Item is direct replacement parts / components for existing equipment and must be compatible in terms of form, fit, and function with existing equipment / configurations.
i. Identify Make / Model of existing equipment:
DESCRIPTION P/N QTY
IMPELLER 3-0478-01 1
ii. Describe how the equipment must be compatible with the existing configuration.
Part must be able to fit in to tight location as per all ready install part. Any modification to parameter may result in part no being able to be installed without further equipment modification.
d. __X____ OTHER: Other reasons not identified above:
MSC does not have manufacturing and technical information required to evaluate and determine whether non-OEM component and replacement parts offered are equivalent to the OEM component and replacement parts. T-AKE engines require special tools and technical expertise unique to these engines; only approved provider is authorized to work on the highly sophisticated equipment. OEM reps have access to provide parts and technical data/ drawings from the original manufacturer as required by USCG and ABS certification, for maintenance as noted under SOW.
4. __X_____ UNUSUAL AND COMPELLING URGENCY: The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits. Urgent requirements are supplies or services that will result in work stoppage or are mission critical and the routine processing time would injure the Government. The determination that the procurement for the above is an urgent and compelling requirement is based on the following:
a. Date on which the requirement was identified: 30JUN2025
b. Required delivery date / Period of Performance: TBD
c. If the difference between a. and b. is more than one week, explain the delay in submitting the requirement.
DELAYED DUE TO TECHNICAL RESEARCH
4 Ver 2.0 (01 July 2018)
d. Estimated production lead-time:165 DAYS
e. Explanation of why delivery / commencement of services by the date required is needed: (explain the impact to the mission, any special circumstances or conditions, etc.)
Active CASREP required for SALT water pump should another pump fail vessel will be unable to get underway due to crossing T-AKE red lines.
f. CASREP Number:25009
IV. ANTICIPATED DOLLAR VALUE OF PROCUREMENT:
