About this file

This is a Sole Source Decision memorandum justifying the award of maintenance services to TELECOM ITALIA SPA O TIM S.P.A. (TIM) for telecommunications infrastructure at three U.S. Navy installations: Naval Base Capodichino, Naval Support Site Gricignano, and Naval Gaeta Base in Italy.

The contract covers two distinct maintenance service areas: (1) Annual maintenance for the Outside Cable Plant (OSP) backbone, and (2) Annual maintenance for Switch batteries and rectifiers supporting the DSN Telephone Switch (SL100) system. The OSP infrastructure was originally designed, installed, and customized by TIM and encompasses all copper, coaxial, and fiber optic cabling supporting primary and secondary networks. TIM is the sole source because it holds exclusive proprietary knowledge and detailed schematics of the customized system interconnections and demarcation interfaces with the public network. The Switch batteries and rectifiers represent highly specialized infrastructure (including Braga Moro rectifiers and customized battery configurations) that TIM engineered specifically to meet U.S. Navy backup policies. Utilizing alternative vendors would void existing manufacturer warranties, shift liability to the Government for system failures, and legally bar third-party contractors from accessing the necessary proprietary demarcation points. The Government conducted a Sources Sought notice on August 27, 2027, which yielded zero capability statements. To mitigate permanent sole-source dependency, the Government commits to continuous market surveillance throughout the contract performance period to monitor Italian telecommunications regulations and identify future opportunities for competitive alternatives. The vendor is located at Via Gaetano Negri 1, 20123 Milano, Italy, with Unique Entity ID QXBKEK5KA987 and CAGE/NCAGE AC123.

TIM retains the exclusive proprietary knowledge and detailed schematics of the customized system interconnections.

Furthermore, utilizing an alternative vendor to perform maintenance or replace these specific components (such as the Braga Moro AGM 12V/500Ah battery racks) would immediately void the existing system warranties. Voiding these warranties would shift the liability for system failure entirely onto the Government, resulting in an unacceptable duplication of costs and undue financial strain on the command to repair or replace the customized infrastructure out-of-pocket. Therefore, to ensure uniformity, compatibility (form, fit, and function), and the preservation of all existing warranties, TIM must be utilized as the sole maintenance provider for these mission-critical power systems.

III. BARRIERS TO COMPETITION / FUTURE ACQUISITION PLAN

To identify potential sources and encourage competition, on 27 August 2027, in accordance with DFARS PGI 206.103- Maintenance Services for the Outside Cable Plant, Switch batteries, and Rectifiers 7 (see e-file 2.01b). The notice produced zero (0) results, and the Government received no capability statements.

The Government is committed to preventing permanent sole-source dependency. While TIM currently retains proprietary control over the physical OSP network demarcation interfaces, as well as the manufacturer warranties on the customized SL100 switch batteries and rectifiers, the Government will conduct continuous market surveillance throughout the performance period of this contract to identify viable alternatives.

Specifically, the Base Communications office (BCO) and the Contracting Officer will monitor the Italian commercial telecommunications market and national wholesale access regulations (AGCOM) goal is to determine whether future technical upgrades, shifts in infrastructure ownership, or changes in local telecommunications law will allow third-party contractors to legally and autonomously maintain this integrated OSP infrastructure and perform the specialized battery and rectifier maintenance without voiding proprietary warranties or violating demarcation boundaries.
