About this file

This is a Justification and Approval for Other Than Full and Open Competition (Sole Source) document issued by the Department of Transportation/Maritime Administration at the U.S. Merchant Marine Academy Division of Procurement.

The acquisition concerns a Long Term System Support Program (LTSSP) for a Kongsberg Maritime Inc. K-Sim Neptune Engine Room Simulator located in Fulton Hall, with a related K-Sim Navigational Simulator in Samuels Hall. The required services include PC hardware replacements, software updates, remote technical support, and scheduled site visits to support midshipmen training for STCW competencies and sea-time requirements. The solicitation number is FY26 MMAPR530126000037. The initial estimated cost is $89,974.00, though the Contracting Officer subsequently approved the justification with a revised estimated cost of $382,957.00 to account for a base year plus four option years. The sole source justification is based on the proprietary nature of Kongsberg Maritime Inc.'s software and hardware interfaces, with no alternative commercial sources available for software updates and troubleshooting support. No market research was conducted, no efforts were made to increase competition, and no other sources expressed interest in the acquisition. The price was determined to be fair and reasonable. The Contracting Officer approved the sole source justification under FAR 6.103-1, authorizing award to the only responsible source without full and open competition.
