About this file
This document is a Contracting Officer's Determination for a sole source contract with G. Herbert Pritchett & Associates Inc. for appraisal services related to land acquisition for the Federal Bureau of Prisons. The contract covers approximately 750 acres of land in Letcher County, Kentucky, comprising 10 parcels including 6 dwellings and 18 gas wells, with specific focus on mineral rights and energy production. The contract is a fixed-price purchase order using LRL funds for fiscal year 2025, with the justification primarily being continuity and consistency, as the contractor has already completed initial appraisals and developed deep understanding of the specific properties.
The sole source determination is based on FAR 13.106-1(b)(1), citing that the original appraiser has unique expertise, proprietary data, and is the licensed certified appraiser. The document emphasizes that engaging a new contractor would require duplicative efforts, potentially increase costs, and delay project milestones. The contract is time-sensitive and begins on behalf of the Federal Bureau of Prisons, with the contractor having already conducted site visits and being familiar with existing land rights and uses.

5. Reasons for Authority Cited:
This request is to provide continuity and consistency for the project. G. Herbert Pritchett & Associates Inc has already conducted the initial appraisals and completed the initial work. A new contractor could result in a need to reappraise all assets, increase cost and time which will not align with project milestones. The appraiser has already developed a deep understanding of the specific properties, land use, and valuation complexities of these assets, particularly regarding the mineral rights and energy production. Their expertise ensures accuracy and reliability in the product they provide.
Engaging a new appraisal contractor would require duplicative efforts to review prior work, verify assumptions, conducting new site visits, leading to additional costs and delays. The original contractor can complete the follow-on work without further delay to the Federal Bureau of Prisons project.
6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 do not apply due to the dollar threshold, apply and will be followed, or □ do not apply due to an exception at 5.202, FAR 5.202{a){5).
