About this file

This document is a Justification and Approval for a Single Source Award under the Simplified Acquisition Threshold for the U.S. International Trade Commission (USITC) to procure annual license renewals for the Prism contract writing software from the sole provider, Unison Software, Inc. The USITC has used Prism software since the 1990s, and transitioning to a new system would require significant reprogramming, data migration, and staff retraining, which is not cost-effective. The USITC conducted market research and acknowledges the availability of other contract writing systems, but Prism remains the best option to meet the agency's current needs. The total estimated value of this requirement is for one non-buyer and five buyer licenses. The period of performance is one year, with four anticipated one-year option periods from October 1, 2024, through September 30, 2029.

Justification and Approval for: Single Source Brand Name

1. REQUISITION NUMBER: 5000-OCFO-24-0018-240119 ESTIMATED TOTAL VALUE:

2. Description of supplies or Services Required to Meet Agency:

The Office of Procurement uses Prism as its contract writing system. Licensing is required to support one Non-Buyer and five Buyers.

3. Justification for Limited Competition:

Unison Software, Inc is the sole proprietor for Prism contract writing software. USITC has been using PRISM software since the 1990s. This software enables users to complete all necessary acquisition tasks efficiently and successfully. Furthermore procurement staff is well trained on the software and has integrated many of its processes utilizing Prism software. Switching to a new contract writing software will require re-programming, data migration and re-training of the staff. It is because of these reasons, competing this requirement is cost prohibitive and is not in the best interest of the Government.

5. Requiring Officer's Certification:

I certify that the facts and representations in this justification, included herein, meet the Government's need and that the supporting data which forms the basis for this justification is complete and accurate.

4. Description of Market Research Conducted and Results:

Market research was conducted via the Internet. We acknowledge there are other contract writing system software solutions.

In the future, if changes occur in the way the Commission does business, the Commission will consider other contract writing software that may meet the requirement.
