Source Selection Information - See RFO FAR 2.101 and 3.104-4

NOV 2024

4. Authority:

RFO FAR 13.101(b): Contracting officers may solicit from a single source based on a determination and findings (see subpart 1.5) that only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization)

5. Reason for Authority Cited: As of January 2025, all distribution activities related to Precise technologies have been transferred from NuVasive to its affiliate, Globus Medical (contract #: SPE2DE- 21-D-0036). Globus Medical will now serve as the sole distributor for these products. Precise technologies items are utilized in limb lengthening procedures for patients with limb length discrepancies, featuring internal nails that enable remote control of bone length without the need for external fixation devices. The precise system was initially contracted through ECAT. Globus Medical is the sole source capable of meeting the Government’s requirements, with no known alternative distributors for the necessary supplies.

For the upcoming emergency case on 20 February 2026 and a follow-on case on 24 March 2026, these items are essential for a patient who sustained a left tibia non-union secondary to an open tibial shaft fracture. Globus Medical is the only responsible source that can fulfill the minimal requirements of lengthening his leg to have the ability for mobility in his leg.

Market Research: The Precise System from Globus Medical is utilized in limb lengthening procedures for patients with discrepancies in limb length. Market research conducted by technical experts from NMCSD in February 2026 involved reviewing similar past procurements, searching for open market contractors, and examining mandatory sources. The search utilized platforms such as SAM.gov, FPDS-NG, Federal Prison Industries (FPI), AbilityOne, GSA Advantage, and the VA to identify potential sources capable of meeting the Government's requirements. Globus Medical Inc.

is the only source that can meet the Government’s minimum requirements to provide the requested supplies and reagents mentioned above at NMCSD. As of January 2025, all distribution activities related to Precise technologies have been transferred from NuVasive to its affiliate, Globus Medical (contract #: SPE2DE-21-D-0036). Globus Medical will now serve as the sole distributor for these products. There is an upcoming emergency case on 20 February 2026 and a follow-on case on 24 March 2026. A Notice of Intent (HT941026N0027) was posted from February 12 - 16, 2026, and no responses were received. Therefore, recommend executing a sole source award to Globus Medical Inc. (UEI: UUCZWL5MJ759 CAGE: 339U6).
